Council Meeting Minutes April 13, 2021

 

REGULAR MEETING OF THE CITY COUNCIL

TUESDAY APRIL 13, 2021

 

A meeting of the Mayor and Council of the City of Plainview, Nebraska, was held at the Council Chambers in said City on the 13th day of April at 6:30 o’clock P.M. 

 

Roll call was held and present were: Mayor Schlote; Council Members: Alder, Smith and Yosten. Absent: Sanne

 

The Pledge of Allegiance was then recited.

 

Mayor Schlote opened the meeting and announced to individuals in attendance that a full copy of the new Nebraska Open Meetings Act was posted on the east wall of the Council Chambers.

 

Notice of the meeting was given in advance thereof by Publication, a designated method for giving notice, as shown by the Affidavit of Publication attached to these minutes.  Notice of this meeting was given to the Mayor and all Members of the Council and a copy of their acknowledgment of receipt of notice and the agenda is attached to the minutes.  Availability of the agenda was communicated in the advance notice and in the notice to the Mayor and Council of this meeting.  All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.

 

Jeremy Tarr was present as City Administrator

Courtney Retzlaff was present as City Clerk.

Bruce Curtiss was present as City Attorney.

 

Smith moved to approve the regular meeting minutes from March 9th. Alder seconded the motion. Motion carried 3-0.

 

Smith moved to approve claims and payroll. Alder seconded the motion. Motion carried 3-0.

 

No Manor report was given.

 

Police Chief Neumann presented the monthly department report. Questions were answered on dog at large calls.

 

Economic Development Director Susan Norris stated that the City is waiting on release of funds for the NAHTF 4-plex housing grant and the DTR grant. Deadlines for business owners to submit applications for the DTR grant may be adjusted in relation to the release of funds. PCED is working on a grant for all police departments in the county for necessary equipment upgrades.

 

City Superintendent Curt Hart gave the monthly report on the work the city maintenance workers have completed.

 

City Attorney Bruce Curtiss reported on phone calls received in relation to Ordinance 964 passed in March. Curtiss introduced Kyle Petersen who has opened an office in Plainview and is working alongside Curtiss. Curtiss asked for the council to approve Petersen to serve as Assistant City Attorney to provide legal aid to the City of Plainview in Curtiss’ absence. Smith moved to approve the appointment. No second was received and motion did not pass. Council member Alder asked to have time to meet with Petersen before making any appointments.

 

Mayor Schlote read the following proclamation for Arbor Day 2021:

 

WHEREAS, In 1872, J. Sterling Morton proposed to the Nebraska Board of Agriculture that a special day be set aside for the planting of trees, and

 

WHEREAS, this holiday, called Arbor Day, was first observed with the planting of more than a million trees in Nebraska, and

 

WHEREAS, Arbor Day is now observed throughout the nation and the world, and

 

WHEREAS, trees can reduce the erosion of our precious topsoil by wind and water, cut heating and cooling costs, moderate the temperature, clean the air, produce life-giving oxygen, and provide habitat for wildlife, and

 

WHEREAS, trees are a renewable resource giving us paper, wood for our homes, fuel for our fires and countless other wood products, and

 

WHEREAS, trees in our city increase property values, enhance the economic vitality of business areas, and beautify our community, and

 

WHEREAS, trees, wherever they are planted, are a source of joy and spiritual renewal

 

NOW THEREFORE, I, Brian Schlote, Mayor of the City of Plainview, Nebraska, do hereby proclaim April 24, 2021 as Arbor Day in the City of Plainview, Nebraska, and I urge all citizens to celebrate Arbor Day and to support the efforts to protect our trees and woodlands, and

 

FURTHER, I urge all citizens to plant trees to gladden the heart and promote the well-being of this and future generations.

 

City Clerk Retzlaff presented the ADA Action Plan for the City of Plainview. No updates were necessary for any of the City facilities and Retzlaff added City Administrator Tarr as a contact. Smith moved to approve the ADA Action Plan as presented. Yosten seconded the motion. Motion carried 3-0.

 

Recommendations from the pool board for summer employment, wages and season admission prices were presented to the council.

 

Alder moved to approve the hire of the following pool employees: Sophie MacGregor, manager; Brittani Gutz, Lauren Darnall, Spencer Knaak, Heather Pendergast, Allison Hardisty, Leighton Medina and Emma King, full-time lifeguards; Hayley Miller, Teya Boyer, Roni Prewitt and Derek Rix, part-time guards. Smith seconded the motion. Motion carried 3-0.

 

Smith moved to approve the recommended wages for pool employees: Manager $11.00/hour, full-time guards $9.75/hour and part-time guards $9.00/hour. Alder seconded the motion. Motion carried 3-0.

 

Alder moved to approve the recommended season admission prices: family pass with up to 4 members, $100.00; family pass with more than 4 members, $125.00; single pass, $60.00; Daily pass prices Jr. High-Adult, $3.00; K-6 $2.00; 5 and under- free. Pool Party price will be $75.00 per hour. Yosten seconded the motion. Motion carried 3-0.

 

City Administrator Tarr stated the City would be re-advertising for an additional pool manager.

 

Recommendations for seasonal park employees were presented. Smith moved to approve Eli Lanham, Brett Norris and William Christiansen for the summer. Yosten seconded the motion. Motion carried 3-0.

 

Wages for seasonal park employees were recommended. Alder moved to approve wages as follows: Eli Lanham, $11.00/hour; Brett Norris, $9.50/hour; William Christiansen, $9.00/hour. Smith seconded the motion. Motion carried 3-0.

 

City Administrator Tarr stated the City would be advertising for seasonal C&D employment.

 

Discussion was held on hiring 2 part-time police officers. Dan Hallock and Kristy Hallock both reside in Plainview and currently are certified officers on other departments. Police Chief Neumann stated they would pick up shifts as they are able to assist the department. Alder moved to approve the hire of both Dan Hallock and Kristy Hallock. Smith seconded the motion. Motion carried 3-0.

 

Smith moved to approve wages for Dan Hallock and Kristy Hallock at $18.00/hour. Alder seconded the motion. Motion carried 3-0.

 

Alder made a motion to approve the contract with Bud’s Sanitary Service, LLC for February 1, 2021 through January 31, 2026 at a cost of $57,024.00 annually. Yosten seconded the motion. Motion carried 3-0.

 

Two applications for Keno grants were received for the quarter.

 

The first application was from the Plainview Pirate Speech Team for purchase of an industrial printer. Jacquie King and Michelle Mosel were present to speak on the success of the team and the benefit the printer would have to not only the speech team, but also other programs within the school system. Smith moved to approve the Keno grant in the amount of $1,500. Yosten seconded the motion. Motion carried 3-0.

 

The second application was from the Plainview Chamber of Commerce for funding of the annual Klown Festival. Chamber board members present stated that due to the flood and COVID-19 circumstances the previous years, donations for the event from area businesses were down. The board does not plan to utilize Keno funds going forward for the event. Alder moved to approve the grant for $3,500.0 Smith seconded the motion. Motion carried 3-0.

 

Dr. Jim Thor was present to submit a request for closure of downtown streets for the Highway20HotRod Association Car Show to be held on June 12, 2021. The committee would like to use the same streets as in previous years. The following streets were presented for use by the Car Show: Locust Avenue from West Street to King Street, Main Street from Highway 20 to Front Street, Maple Street from Highway 20 to the alleyway south of Keystone Bar and Elm Street from Front Street to Plainview Telephone storage building on North Elm. Alder moved to allow the street closures. Yosten seconded the motion. Motion carried 3-0.

 

Smith moved to allow fireworks for Klown Days on June 5, 2021 with an alternate date of July 5, 2021 for the Manor/CHI Celebration. Alder seconded the motion. Motion carried 3-0.

 

Discussion on the NDEE SRF Sewer Loan refinancing will be brought back to the May meeting.

 

Special Designated Liquor Licenses for Klown Days and Highway20HotRod Association Car Show were discussed.

 

The first application was from the Chamber of Commerce for a beer garden during the annual BBQ on June 5, 2021 from 5:00 to 8:00 PM. The area will be fenced off and will be around the basketball court at the Bandshell. Smith moved to approve the liquor license. Alder seconded the motion. Motion carried 3-0.

 

The second application was from Keystone for a cornhole tournament to be held on June 4, 2021 from 5:00 PM to 2:00 AM. The area to be fenced off will be adjacent to Keystone on the 200 block of south Maple Street. Smith moved to approve the liquor license. Yosten seconded the motion. Motion carried 3-0.

 

The third application was from Keystone for the Highway20HotRod Association Car Show on June 12, 2021 from 9:00 AM to 5:00 PM. The area designated would follow the same street closures as requested for the Car Show. Smith moved to approve the liquor license. Alder seconded the motion. Motion carried 3-0.

 

Several properties were recommended by the health board to the council for nuisances.

 

A discussion on the property at 306 N 6th Street, Plv College Add Sub Div of S1-2 Outlot Ablk 1 Lot 10 & S1-2 Lot 11. The property went through the nuisance abatement process last year with the owner attending a public hearing and stating that necessary repairs had been made to the structure. The property is still in need of repairs to the structure as there are large holes in the house. There is also debris and overgrown vegetation that needs to be removed from the property. Smith moved to deem the property as a nuisance. Alder seconded the motion. Motion carried 3-0.

 

The property at 101 W Congress, Plainview Pacific Townsite Co 1st add Blk 12 Lots 20-21-22 was discussed as there is a trailer of tin and miscellaneous junk on the property. Neumann stated the property has been cleaned up and is no longer a nuisance.

 

The property at 222 E Locust, Plainview Pacific Townsite Co 1st Add Blk 10 Lots 1&2 has several appliances, garbage and furniture on the property that needs disposed of properly. Smith moved deem the property as a nuisance. Alder seconded the motion.  Motion carried 3-0.

 

The property at 205 N 7th Street, Plainview Peed’s 2nd Add Blk 10 Lots 9&10 has appliances, garbage and miscellaneous junk on the property that need to be disposed of properly. Neumann stated there had been some cleanup completed and he will speak to the owners.

 

The property at 511 East Pilcher Plainview Peed’s 2nd Add Blk 8 E1-2 Lot 5&6 has garbage and debris that needs to be properly disposed of. Smith moved to deem the property as a nuisance. Alder seconded the motion. Motion carried 3-0.

 

The property at 214 S Maple, Plainview O.T. Blk 6 S 50’ Lot 23 & N 10’ Lot 22 contains unlicensed/inoperable vehicles and equipment in addition to tires and other junk and debris that needs to be disposed of properly. The garage on the property has partially fallen in which needs to be removed. Alder moved to deem the property as a nuisance. Smith seconded the motion. Motion carried 3-0.

 

The property at 208 S Maple, Plainview O.T. Blk 6 Lot 26 has unlicensed/inoperable vehicle, garbage, junk and mattresses that need to be disposed of properly. Smith moved to deem the property as a nuisance. Alder seconded the motion. Motion carried 3-0.

 

The property at 214 E Locust, Plainview Pacific Townsite Co 1st Add Blk 10 Lots 3-4-5 has tires, old wood and garbage that need to be disposed of properly. Alder moved to deem the property as a nuisance. Smith seconded the motion. Motion carried 3-0.

 

The property at 107 S Pine, Plainview Pacific Townsite Co 1st Add Blk 1 Lots 23&24 has unlicensed/broken down vehicles, garbage and junk that needs to be disposed of properly. Smith moved to deem the property as a nuisance. Alder seconded the motion. Motion carried 3-0.

 

Council member Smith asked that the police department submit a list of unlicensed and inoperable vehicles to the health board as needed to go through the nuisance abatement process.

 

A follow up on the property at 112 S Elm Street was held and after discussion the council will take no action to obtain clear title until the tax sale to be held in October of 2021.

 

Building permit were recommended for 2 properties by the zoning board.

 

The first was for a storage shed at 86292 536 Ave by Ardin Miller. The property is within the one-mile jurisdiction of Plainview and meets all zoning requirements. Alder moved to approve the permit. Yosten seconded the motion. Motion carried 3-0.

 

The second was for a privacy fence at 101 S 4th Street Plainview Pacific Townsite Co 1st Add Blk 5 180’x150’ by Seth Noble. The structure meets all requirements for R-3 residential. Smith moved to approve the building permit. Yosten seconded the motion. Motion carried 3-0.

 

Discussion was held on paving projects in the City of Plainview and moving forward with engineering for several streets. This is the first step in starting paving projects and there would be more meetings for the public to discuss the projects. Concerns were heard from members of the community about possible assessments against property owners. The benefits that paving streets can provide was also discussed. Paving of Lincoln Avenue between the ballfields was questioned and City Administrator Tarr suggested using a G.O. Bond for financing which would go on the general ballot for a vote of the public. Alder moved to continue with engineering on the following paving projects: Lincoln Avenue between 2nd and 3rd Streets, Lincoln Avenue between 3rd and 4th Streets, Ellsworth Avenue between 2nd and 3rd Streets, Ellsworth Avenue between 3rd and 4th Streets, Euclid Avenue between 2nd and 3rd Streets, Euclid Avenue between 3rd and 4th Streets, Pilcher Avenue between 4th and 5th Streets, Pilcher Avenue between 5th and 6th Streets and Sixth Street between Pilcher and Woodland Avenues. Smith seconded the motion. Motion carried 3-0.

 

It was moved by Smith, seconded by Yosten to adjourn the meeting. Motion carried 3-0.
