City Council Meeting May 11 2021

 

REGULAR MEETING OF THE CITY COUNCIL

TUESDAY MAY 11, 2021

 

A meeting of the Mayor and Council of the City of Plainview, Nebraska, was held at the Council Chambers in said City on the 11th day of May at 6:30 o’clock P.M. 

 

Roll call was held and present were: Mayor Schlote; Council Members: Alder, Smith, Yosten and Sanne Absent: None

 

The Pledge of Allegiance was then recited.

 

Mayor Schlote opened the meeting and announced to individuals in attendance that a full copy of the new Nebraska Open Meetings Act was posted on the east wall of the Council Chambers.

 

Notice of the meeting was given in advance thereof by Publication, a designated method for giving notice, as shown by the Affidavit of Publication attached to these minutes.  Notice of this meeting was given to the Mayor and all Members of the Council and a copy of their acknowledgment of receipt of notice and the agenda is attached to the minutes.  Availability of the agenda was communicated in the advance notice and in the notice to the Mayor and Council of this meeting.  All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.

 

Jeremy Tarr was present as City Administrator

Courtney Retzlaff was present as City Clerk.

Bruce Curtiss was present as City Attorney.

 

Alder moved to approve the regular meeting minutes from April 13th. Smith seconded the motion. Motion carried 4-0.

 

Smith moved to approve claims and payroll. Sanne seconded the motion. Motion carried 4-0.

 

No Manor report was given.

 

Police Chief Neumann reported on department activity for April. Neumann stated that Officer Dietz will be attending training for his certification in the fall.

 

Susan Norris gave updates on the NAHTF Housing Grant and DTR Grant applications from business owners that were received during round one. The DTR Committee will meet in the coming weeks to review the applications.  

 

City Superintendent Curt Hart reported that the maintenance staff has repaired concrete, replaced curb stops and started mowing parks and ballfields. Painting will begin on the pool to prepare for opening for the season.

 

A motion was made by Sanne to appoint Kyle Petersen as the Assistant City Attorney. Alder seconded the motion. Motion carried 4-0.

 

City Administrator Tarr stated that paperwork had been signed with NDEE to refinance the City’s SRF Sewer Loan. The interest rate has been lowered from 2.75% to .5% with the administrative fee changing 1% to .5%.

Approval was given for the sale of a lot on North 5th Street in the amount of $2,000 as recommended by the LB840 board. A gravel road on 5th Street extending north from Euclid along with water and sewer service will need to be installed. Alder moved to approve the sale. Smith seconded the motion. Motion carried 4-0. 

Sanne moved to approve payment for CDS Housing Administration Services in the amount of $175.00 for project PLVW-HR-17. Smith seconded the motion. Motion carried 4-0.

 

The council discussed Special Designated Liquor license applications for 3 organizations.

 

The Chamber of Commerce applied for an SDL for June 5, 2021 from 9:00 AM – 5:00 PM for the sand volleyball tournament to be held in the Bandshell Park. Sanne moved to approve the license. Alder seconded the motion. Motion carried 4-0.

 

13/20 applied for 3 SDL licenses for Street Dances/Karaoke and Family Games all to be held on Main Street outside the business. 

 

The first was on June 4, 2021 from 3:00 PM to 2:00 AM for a Street Dance/Karaoke. Smith moved to approve the license. Alder seconded the motion. Motion carried 4-0.

 

The second was on June 5, 2021 from 10:00 AM – 2:00 AM for Family Games and Street Dance/Karaoke. Smith moved to approve the license. Alder seconded the motion. Motion carried 3-1 with Sanne voting nay.

 

The third was for a Street Dance/Karaoke on June 12, 2021 from 5:00 PM to 2:00 AM. Smith moved to approve the license. Alder seconded the motion. Motion carried 4-0.

 

Keystone Bar applied for an SDL for a Street Dance to be held on June 5, 2021 in the street between Keystone and Madison County Bank. Sanne moved to approve the license. Yosten seconded the motion. Motion carried 4-0.

 

Discussion was held on several properties that had previously been issued nuisance letters in April.

 

The property at 306 N 6th Street, Plv College Add Sub Div of S1-2 Outlot A Blk 1 Lot 10 & S1-2 Lot 11 did not complete the cleanup indicated. Alder moved to set a public hearing. Smith seconded the motion. Motion carried 4-0.

 

The property at 222 E Locust, Plainview Pacific Townsite Co 1st Add Blk 10 Lots 1&2 had been cleaned up and was no longer deemed a nuisance. Sanne moved to remove the property from the nuisance list. Alder seconded the motion. Motion carried 4-0.

 

The property at 511 E Pilcher, Plainview Peed’s 2nd Add Blk 8 E1-2 Lot 5& 6 had completed some cleanup however council discussed that there were still items needing to be addressed. Alder moved to set a public hearing. Smith seconded the motion. Motion carried 4-0.

 

The property at 214 S Maple, Plainview O.T. Blk 6 50’ Lot 23 and N 10’ Lot 22 had not met all requirements stated in the nuisance letter. Smith moved to set a public hearing. Alder seconded the motion. Motion carried 4-0.

 

The property at 208 S Maple, Plainview O.T. Blk  Lot 26 did not address the requirements for cleanup stated in the nuisance letter. Smith moved to set a public hearing. Sanne seconded the motion. Motion carried 4-0.

 

The property at 214 E Locust, Plainview Pacific Townsite Co 1st Add Blk 10 Lots 3-4-5 had not been cleaned up in accordance with the nuisance letter. Sanne moved to set a public hearing. Alder seconded the motion. Motion carried 4-0.

 

The property at 107 S Pine, Plainview Pacific Townsite Co 1st Add Blk 1 Lots 23&24 had cleaned up but still had items that needed to be addressed. Sanne moved to set a public hearing. Smith seconded the motion. Motion carried 4-0.

 

Public hearings for the above properties will be held during the regular council meeting on June 8, 2021.

 

Discussion was also held on issuing citations and fines for unlicensed vehicles.

 

The health board had several recommendations for nuisance properties.

 

The first property at 105 S King Street, Plainview Pioneer Townsite Co Add Blk 10 Lot 10. The property contains inoperable and unlicensed vehicles, miscellaneous junk and debris in the yard and the garage has a hole in the roof that needs to be repaired. Sanne moved to send a nuisance letter. Alder seconded the motion. Motion carried 4-0.

 

The next property is at 205 N 7th Street, Plainview Peed’s 2nd Add Blk 10 Lots 9&10. There are appliances, garbage and miscellaneous junk around the property that need to be disposed of properly. Alder moved to send a nuisance letter. Smith seconded the motion. Motion carried 4-0.

 

The property at 103 N Pine Street, Plainview Chilvers 6th Add Blk 9 Lot 11 has trash bags on the front porch and miscellaneous junk in the rear of the property. Sanne moved to send a nuisance letter. Alder seconded the motion. Motion carried 4-0.

 

The property at 107 N Pine Street, Plainview Chilvers 6th Add Blk 9 Lot 9 contains miscellaneous junk in the backyard that needs to be disposed of properly. Alder moved to send a nuisance letter. Smith seconded the motion. Motion carried 4-0.

 

The property at 604 E Park Avenue, Plainview 4-27-4 T.L. 5 .43A contains several unlicensed/inoperable vehicles, boats and campers as well as iron and miscellaneous junk. The current fence on the property is falling in and needs to be removed as is does not meet height requirements for C-1 zoning. Smith moved to send a nuisance letter. Alder seconded the motion. Motion carried 4-0.

 

The property at 104 N Main Street, Plainview Chilvers 1st Add Blk 2 Lot 2 & 8’ Lot 3 has an inoperable vehicle in the front of the property and miscellaneous junk in the front and rear of the property. Alder moved to send a nuisance letter. Smith seconded the motion. Motion carried 4-0.

 

Building permit recommendations from the zoning board were presented for council approval.

 

The first permit was at 108 S Main, Plainview O.T. Blk 2 Lot 2 for a 6’ privacy fence. The structure meets all C-2 zoning regulations. Smith moved to approve the building permit. Yosten seconded the motion. Motion carried 4-0.

 

The property at 103 S 2nd Street, Plainview Pacific Townsite Co 1st Add Blk 3 Lots 29-32 submitted 2 applications. The first was for a storage building. The structure meets all requirements for R-3 zoning regulations. The second was for a 6’ privacy fence and meets all R-3 regulations. Sanne moved to approve both permits. Yosten seconded the motion. Motion carried 4-0.

 

The final application was for the 4-plex located on North 4th Street, Lots 1-12 Block 23 College Addition. The structure meets all R-3 zoning regulations. Sanne moved to approve the permit. Smith seconded the motion. Motion carried 4-0.

 

Sanne moved to approve the 20-DTR-005 CDBG Construction Management contract. Alder seconed the motion. Motion carried 4-0.

 

Sanne moved to approve payment in the amount of $615.00 for 19-PP-001 Drawdown #5. Smith seconded the motion. Motion carried 4-0.

 

Alder moved to approve payment in the amount of $2,715.00 for 20-DTR-005 Drawdown #1. Smith seconded the motion. Motion carried 4-0.

 

The pool board recommended hiring Allison Hardisty and Brittany Smith as assistant managers for the swimming pool. Sanne moved to approve the hires. Smith seconded the motion. Motion carried 4-0.

 

The pool board recommended wages for the assistant managers with Allison Hardisty paid $10.50 per hour and Brittany Smith $11.00 per hour. Sanne move to approve the wages. Smith seconded the motion. Motion carried 4-0.

 

Sanne moved to hire Kenny Hart for seasonal maintenance worker. Alder seconded the motion. Motion carried 4-0.

 

Sanne moved wage for Kenny Hart at $12 per hour. Alder seconded the motion. Motion carried 4-0.

 

A brief discussion on the LEOP Plan and necessary updates was held. The council would like to schedule an evening meeting with all entities in the City that are listed in the plan to discuss changes.

 

Discussion was held on possible updates to the current Ordinance regulating chickens within city limits. Currently no chickens are allowed in the City of Plainview and there are citizens that would like to change this. Further discussion will be held at the June council meeting.

 

Discussion was held on possible updates to hours of fireworks allowed in the City of Plainview. The 4th of July is on a Sunday this year and council member Alder expressed that he would like to have hours on July 3rd extended to midnight. City Clerk Retzlaff asked if the council passing a motion to allow extended hours as needed would be legal without the need to change the Ordinance. City Attorney Curtiss will check and discussion will be held at the June meeting.

 

Council comments included the necessary steps to follow for issuing citations for unlicensed vehicles and Curtiss will prepare an outline for the City to follow. A welcome to Kyle Petersen was also extended by the council.

 

City Administrator Tarr stated that he would like to begin budget workshops for the council starting in June.

 

It was moved by Smith, seconded by Sanne to adjourn the meeting. Motion carried 4-0.
