City Council Meeting Minutes March 9, 2021

 

REGULAR MEETING OF THE CITY COUNCIL

TUESDAY MARCH 9, 2021

 

A meeting of the Mayor and Council of the City of Plainview, Nebraska, was held at the Council Chambers in said City on the 9th day of March at 6:30 o’clock P.M. 

 

Roll call was held and present were: Mayor Schlote; Council Members: Alder, Smith, Yosten and Sanne. Absent: None

 

The Pledge of Allegiance was then recited.

 

Mayor Schlote opened the meeting and announced to individuals in attendance that a full copy of the new Nebraska Open Meetings Act was posted on the east wall of the Council Chambers.

 

Notice of the meeting was given in advance thereof by Publication, a designated method for giving notice, as shown by the Affidavit of Publication attached to these minutes.  Notice of this meeting was given to the Mayor and all Members of the Council and a copy of their acknowledgment of receipt of notice and the agenda is attached to the minutes.  Availability of the agenda was communicated in the advance notice and in the notice to the Mayor and Council of this meeting.  All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.

 

Jeremy Tarr was present as City Administrator

Courtney Retzlaff was present as City Clerk.

Bruce Curtiss was present as City Attorney.

 

Sanne moved to approve the regular meeting minutes from February 9th and the special meeting minutes from March 3rd. Smith seconded the motion. Motion carried 4-0.

 

Sanne moved to approve claims and payroll. Alder seconded the motion. Motion carried 4-0.

 

No Manor report was given.

 

Police Chief Neumann presented on February activity of the department.

 

Susan Norris, Economic Development Director, updated on the NAHTF Grant, the DTR Grant Business Owners meeting to be held on March 11th at 5:00 PM at the library, and the upcoming Backroads Tour across Northeast Nebraska that includes 5 Plainview businesses.

 

City Superintendent Curt Hart presented his monthly report.

 

Dennis Johnson of Bush & Roe Financial presented an overview of the City’s Property and Casualty insurance coverage for the upcoming year. Johnson stated that the City should receive a dividend payment at the end of the month.

 

Austin Partridge of First National Capital Markets presented on the refinancing options available for the City’s NDEE SRF Sewer Loan. The current interest rate is 3.75% and new rates currently are at 1.05%. Refinancing at the lower rate would save the City $35,258.22 over the life of the loan. The council will revisit at the April council meeting.

 

At 7:00 PM Mayor Schlote opened the Public Hearing for the CDBG 19PP011 Plainview DTR Planning Grant

 

Susan Norris reported that the City of Plainview was awarded $43,000 in CDBG Planning funds for development of a DTR Plan, with the award to include $40,000 for planning activities and $3,000 for general administration of the grant. The City of Plainview was to provide a minimum of $10,000 in matching funds, bringing the total project budget to $53,000. All funds will be utilized within a designated Slum & Blighted area. Total CDBG funds expended to date include $40,000 for planning activities and $1,605 for general administration. Local matching funds of $11,000 have been provided by the City of Plainview, which brings the current project cost to $52,395 as of March 1, 2021.

 

There were no comments about the Planning Grant from the public.

 

Smith moved to close the public hearing at 7:04 PM. Sanne seconded the motion. Motion carried 4-0.

 

Sealed bids for haying of the 9 acres surrounding the City lagoon were opened by Mayor Schlote. The first bid was received from Tim Johnston of Osmond in the amount of $565. The second bid was from Trent Tarr of Plainview for $50 per acre for a total bid of $450. Smith moved to accept the bid from Johnston for $565. Yosten seconded the motion. Motion carried 4-0.

 

City Administrator Tarr presented dates for extended hours at the transfer station in April. The City would not be offering a free clean-up weekend but instead would have the transfer station open on April 10th and 24th for use. Tarr will have to approve the hours with the NDEE. Sanne moved to approve the extended hours at the transfer station. Alder seconded the motion. Motion carried 4-0.

 

The zoning board recommended three building permits for approval by the council.

 

An application for construction of a new single family home at 507 N 5th Street was submitted by Caden Alexander. The structure meets all R-1 zoning regulations. Sanne moved to approve the permit. Smith seconded the motion. Motion carried 4-0.

 

An application for a house addition at 307 N 4th Street was submitted by Dalton Goetzinger. The structure meets all R-2 zoning regulations. Sanne moved to approve the permit. Alder seconded the motion. Motion carried 4-0.

 

An application for a house addition at 202 S 2nd Street was submitted by David Mosel. The structure meets all R-3 zoning regulations. Sanne moved to approve the permit. Alder seconded the motion. Motion carried 4-0.

 

Discussion was held on 2 RBDG/IRP loan applications.

 

The first is for Pure Revival, LLC, a new hair salon and spa located at 104 S. Main Street. The total loan amounts would be $52,500 with the LB840 match of $12,625. Blake and Bree Nincehelser were present to explain the business. Bree Nincehelser and Jacquie King will be the owner/operators of Pure Revial, LLC. Sanne moved to approve the LB840 match of $12,625. Alder seconded the motion. Motion carried 4-0.

 

The second is for Mary’s Restaurant in the amount of $81,200 for purchase of the American Legion Building at 108 S. West Street. The LB840 match would be $15,131 as Mary’s contributed a down payment of $18,676 towards the project. Alder moved to approve the LB840 match of $15,131. Smith seconded the motion. Motion carried 4-0.

 

Council member Sanne introduced the following resolution and moved for its adoption:

 

RESOLUTION #628             

 

WHEREAS, there are federal funds available under Section 5311 of the Federal Transit Act and for the Nebraska Public Transportation Assistance Program, and

 

WHEREAS, the City of Plainview HandiVan desires to apply for said funds to provide public transportation in the city of Plainview area.

 

NOW THEREFORE, BE IT RESOLVED; the Plainview City Council hereby instructs the Plainview HandiVan and the City of Plainview to apply for said funds. Said funds are to be used for the Plainview HandiVan’s transportation operations in the FY 2021-2023 Application for Public Transportation Assistance.

 

 

Council member Yosten seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Alder, Smith, Yosten and Sanne. Nay: None. Whereupon the Mayor declared said motion carried and Resolution #628 is passed

and adopted.

 

Mayor Schlote read the following proclamation for National Library Week 2021

 

WHEREAS, libraries of all types are at the heart of their cities, towns, schools, and campuses,

serving their communities;

 

WHEREAS, libraries are accessible and inclusive places that foster a sense of belonging and

community;

 

WHEREAS, today's libraries and their services extend far beyond the four walls of a building and everyone is welcome to use their resources;

 

WHEREAS, for people lacking broadband at home, libraries provide access to computers and

wi-fi;

 

WHEREAS, libraries strive to develop and maintain programs and collections that are as diverse

as the populations they serve and ensure equity of access for all;

 

WHEREAS, libraries offer opportunities for everyone to explore new worlds and become their

best selves through access to technology, multimedia content, and educational programs;

 

WHEREAS, in times of crisis, libraries, librarians, and library workers play an invaluable role in supporting their communities both in person and virtually;

 

WHEREAS, to adapt to our changing world, libraries are expanding their resources and

continuing to meet the needs of their patrons;

 

WHEREAS, libraries are cornerstones of democracy, promoting the free exchange of

information and ideas for all;

 

WHEREAS, libraries have long served as trusted and treasured institutions for all members of

the community regardless of race, ethnicity, creed, ability, sexual orientation, gender identity,

or socio-economic status;

 

WHEREAS, libraries, librarians, and library workers are joining library supporters and advocates across the nation to celebrate National Library Week;

 

NOW, THEREFORE, be it resolved that I Brian Schlote, Mayor, proclaim National Library Week, April 4-10, 2021. During this week, I encourage all residents to visit their library to access

resources and services. Because of you, Libraries Transform lives and communities.

 

Mayor Schlote read the following proclamation for Nebraska Public Transportation Week 2021:

 

WHEREAS: Nebraska Public Transportation week has been declared for April 11-17, 2021

 

AND WHEREAS: The date was chosen to honor the public transportation systems across Nebraska, including the local system better known as the Plainview Handivan.

 

AND WHEREAS: Public transportation systems across the state of Nebraska are celebrating public transportation during this time frame.

 

AND WHEREAS: Every year thousands of Nebraska citizens are able to participate in using public transportation to help them remain independent.

 

AND WHEREAS: Plainview has continued to support the use of public transportation throughout the year.

 

AND WHEREAS: Plainview recognizes the hard work and dedication that the city staff and especially the drivers do to help make the Plainview Handivan service an integral part of the lives of many residents in the community.

 

NOW THEREFORE BE IT RESOLVED that by virtue of the authority invested in me as Mayor of the City of Plainview, Nebraska, I, Brian Schlote, do hereby issue this proclamation to celebrate public transportation and I do hereby declare April 11-17, 2021 to be "Public Transportation Week".

 

Council member Sanne introduced the following resolution and moved for its adoption:

 

RESOLUTION #629        

 

 

WHEREAS, the Mayor and City Council of the City of Plainview has received a request to establish Program Guidelines for the Downtown Commercial Rehabilitation Improvement Program;

 

AND WHEREAS, it is in the best interest of the City to adopt the guidelines that have been approved for use with the awarded CDBG Downtown Revitalization Grant;

 

NOW THEREFORE BE IT RESOLVED, BY THE MAYOR AND COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA, THAT the attached program guidelines will be adopted

 

Council member Alder seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Alder, Smith, Yosten and Sanne. Nay: None. Whereupon the Mayor declared said motion carried and Resolution #629 is passed

and adopted.

 

Motion was made by Sanne and seconded by Smith to approve Ordinance No. 962 on its first reading.  Upon roll call vote, the following members voted AYE:  Alder, Smith, Yosten and Sanne. The following voted NAY: none.  Motion carried 4-0.  Whereupon the Mayor declared said Ordinance No. 962 approved on its first reading.

 

It was moved by Sanne and seconded by Alder to waive the second and third readings and approve Ordinance No. 962. Upon roll call vote, the following members voted AYE: Alder, Smith, Yosten and Sanne. The following voted NAY: none.  Motion carried 4-0.  Whereupon the Mayor declared Ordinance No. 962 approved on its second and third readings.

 

ORDINANCE #962

 

 

AN ORDINANCE ADOPTING A SUPPLEMENT TO THE CODE OF ORDINANCES FOR THE CITY OF PALINVIEW, NEBRASKA ADOPTING THE STATE LAW CHANGES MADE BY THE LEGISLATURE WHICH ARE SPECIFIC AND MANDATORY AND NECESSARY TO BRING THE CITY ORDINANCES AND CODE SECTIONS INTO CONFORMITY WITH STATE LAW AND AMENDING, RESTATING, REVISING, UPDATING, CODIFYING AND COMPILING CERTAIN ORDINANCES OF THE CITY DEALING WITH THE SUBJECTS EMBRACED IN THE CODE OF ORDINANCES, AND PROVIDING PENALITES FOR THE VIOLATION OF THE CODE OF ORDINANCES.

 

NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA:

 

Section 1. That the Code of Ordinances of the City of Plainview shall continue in full force and effect and shall hereby adopt and incorporate by reference certain State law changes made by the Legislature which are specific and mandatory and necessary to bring the City Ordinances and Code sections into conformity with State law.

 

Section 2. The State law changes identified above affect the following chapters of the City Code of Ordinances:

 

1.      To amend §10-109 License; City Powers and Duties.

2.      To amend §10-106 Licensee, Requirements.

3.      To amend §1-514(2) and amend §1-515 Council Meetings; When; Quorum; Votes.

4.      To amend §2-202 Planning Commission.

5.      To amend §1-716 Recall Procedure.

6.      To amend §1-203 City Clerk.

7.      To amend §1-204 City Treasurer.

8.      To create §1-819.5 Debt Collection; Authority to Contract with Collection Agency.

9.      To amend §1-803 Proposed Budget Statement; Hearing; Adoption; Certification of Tax Amount.

10.  To amend §1-503 Open to Public; Notice; Agenda.

11.  To amend §1-709 Special Elections.

12.  To amend §10-701.1 License to Sell; Issuance.

13.  To amend §10-701.3 Rights to License;

14.  To amend §10-702.3 Misrepresentation by Person Under the Age of 21 to Obtain Tobacco.

15.  To amend §10-702.2 Sale of Tobacco to Persons Under the Age of 21.

16.  To amend §10-702.1 Use of Tobacco by Persons Under the Age of 21.

17.  To amend §3-1101 Discontinuance of Service; Notice Procedure.

 

Section 3. All other portions of the code book not identified in Section 2 herein remain unaffected and shall continue in full force and effect as currently written.

 

Section 4. All prior ordinances, pertaining to the subjects treated in this supplement to the Code of Ordinances, shall be deemed repealed from and after the effective date of this ordinance except as they are included and re-ordained in whole or in part in this supplement to the Code of Ordinances; provided, this repeal shall not affect any offense committed or penalty incurred or any right established prior to the effective date of this ordinance, nor shall this repeal affect the provisions of ordinances levying taxes, appropriating money, annexing or detaching territory, establishing franchises, or granting special rights to certain persons, authorizing the purchase or sale of real or personal property, granting or accepting easements, plat or dedication of land to public use, vacating or setting the boundaries of streets or other public places; nor shall this repeal affect any other ordinance of a temporary or special nature or pertaining to subjects not contained in or covered by this supplement to the Code of Ordinances.

 

Section 5. This ordinance adopting the supplement to the Code of Ordinances shall be a sufficient publication of any ordinance included in it and not previously published according to law. At least one copy of this supplement to the Code of Ordinances shall be on file in the office of the City Clerk and available for inspection by members of the public during the hours the office is open for the ordinary transaction of business. The Clerk shall file a copy of this supplement to the Code of Ordinances with the County Clerk.

 

Section 6. This ordinance adopting this supplement to Code of Ordinances shall take effect from and after its passage, approval, and publication or posting as required by law.

 

Motion was made by Sanne and seconded by Smith to approve Ordinance No. 963 on its first reading.  Upon roll call vote, the following members voted AYE:  Alder, Smith, Yosten and Sanne. The following voted NAY: none.  Motion carried 4-0.  Whereupon the Mayor declared said Ordinance No. 963 approved on its first reading.

ORDINANCE #963

 

AN ORDINANCE DETERMINING THE NEED FOR PARTICIPATION, AND    AUTHORIZING AND DIRECTING SUCH PARTICIPATION BY THE CITY OF PLAINVIEW, NEBRASKA, IN THE OPERATION OF MUNICIPAL ENERGY AGENCY OF NEBRASKA AND TO PRESCRIBE THE TIME WHEN THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT.

 

BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL MEMBERS OF THE CITY OF PLAINVIEW, NEBRASKA:

 

Section 1. The City Council hereby finds and declares that, in consideration of the present and future needs of this City for electric power and energy, and the inadequacy and unsuitability of the City’s supply of electric power and energy available to meet those needs, and in consideration of the economic and other advantages which will be realized by cooperative action with other municipalities, it would be in the public welfare and in the interest of the customers of the City’s electric utility that the City become a participant in the Municipal Energy Agency of Nebraska, an agency which has been formed pursuant to the Municipal Cooperative Financing Act contained in the Nebraska Revised Statutes §18-2401 et seq., as a participation municipality. At the present time, the Agency is comprised of the municipalities of:

 

            Nebraska:        Alliance, Ansley, Arnold, Bayard, Beaver City, Benkelman, Blue Hill,       

                                    Bridgeport, Broken Bow, Burwell, Callaway, Chappel, Crete, Curtis,

                                    Fairbury, Falls City, Gering, Grant, Imperial Public Power District,

                                    Kimball, Lyman, Mitchell, Morrill, Nebraska City, Neligh, Oxford,

                                    Pender, Pierce, Red Cloud, Shickley, Sidney, Stuart, West Point, Wisner;

            Colorado:        Aspen, Delta, Fleming, Fort Morgan, Fountain, Glenwood Springs,                                                 Gunnison, Haxtun, Julesburg, Lyons, Oak Creek, Wray, Yuma;

            Iowa:               Breda, Indianola Municipal Utilities, Sargeant Bluff, Wall Lake,

                                    Waverly Light and Power;

            Wyoming:       Basin, Torrington

 

It is anticipated that there may be other municipalities that may become participants pursuant to the provisions of the Municipal Cooperative Financing Act.

 

The general description of the business in which the Agency engages, and the location and method of operation of the proposed plants and systems of the Agency are:

 

            To generate and supply electrical energy and engage in the ownership and operation of                  power projects as defined in the Municipal Cooperative Financing Act, within and                        without the State of Nebraska, and exercise all other powers granted by law relating to                 the above activities. The principal place of business shall be Lincoln, Nebraska.

 

Section 2. It is hereby ordered and directed that the City of Plainview, Nebraska, acting through its Mayor and City Clerk, become a participating municipality in Municipal Energy Agency of Nebraska, an organization which has been created pursuant to the Municipal Cooperative Financing Act contained in the Nebraska Revised Statutes §18-2401 et seq. and do all things necessary to become a participant in such Agency. This would include the submission of an application to the Municipal Energy Agency of Nebraska expressing this City’s desire and need to become a participating municipality and the appointment of a director to the Agency.

Section 3. This Ordinance shall be in full force and take effect after its passage, approval, and publication as provided by law.

 

 

The council appointed a director and alternate director to represent the City of Plainview on the MEAN Board of Directors. Sanne moved to appoint Jeremy Tarr as the director and Bob Smith as the alternate representative for the City. Yosten seconded the motion. Motion carried 4-0.

 

Council member Sanne introduced the following resolution and moved for its adoption:

 

 

RESOLUTION #630        

 

 

WHEREAS, the Mayor and City Council of the City of Plainview has received a request to establish a Tenant Selection Policy;

 

AND WHEREAS, it is in the best interest of the City to adopt the guidelines that have been approved for use with the awarded Nebraska Affordable Housing Trust Fund Program;

 

NOW THEREFORE BE IT RESOLVED, BY THE MAYOR AND COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA, THAT the attached program guidelines will be adopted

 

Council member Alder seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Alder, Smith, Yosten and Sanne. Nay: None. Whereupon the Mayor declared said motion carried and Resolution #630 is passed

and adopted.

 

A brief discussion on the presentations from engineering firms held on March 3rd was held. Council members stated that Miller & Associates presentation on potential solutions to address the Administrative Order for nitrate levels issued by the NDEE provided more information than JEO Consulting Group. Sanne moved to appoint Miller and Associates as the engineer for future water department projects. Alder seconded the motion. Motion carried 4-0.

 

 

Council member Sanne introduced the following resolution and moved for its adoption:

 

RESOLUTION #631

 

            WHEREAS, the City of Plainview, Nebraska recognizes that a properly functioning public water supply system is necessary to the health and welfare of the citizens of Plainview; and

 

            WHEREAS, the Mayor and City Council have determined that portions of the City of Plainview public water supply system are in need of significant repair and improvement; and

 

            WHEREAS, funding for the cost of the Preliminary Engineering Report and/or other eligible planning grant activities of the City of Plainview public water supply system may be obtained by grant from the Nebraska Department of Environment and Energy, subject to certain requirements and obligations;

 

            NOW, THEREFORE BE IT RESOLVED by the Mayor and City Council of the City of Plainview, Nebraska that they should make application for a grant from the Nebraska Department of Environment and Energy; and

 

            BE IT FURTHER RESOLVED, Brian Schlote, Mayor, is hereby directed to execute the application and all other documents necessary to facilitate the grant between the Nebraska Department of Environment and Energy to the City of Plainview, Nebraska for the purpose of planning for the repairing and improving the City of Plainview public water supply system; and

 

            BE IT FURTHER RESOLVED THAT  Courtney Retzlaff, City Clerk/Treasurer be authorized and directed to sign the payment or outlay request forms, sign all necessary documents to furnish such assurances to the State of Nebraska as may be required by law or regulations, and to receive payment on behalf of the applicant.

 

Council member Yosten seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Alder, Smith, Yosten and Sanne. Nay: None. Whereupon the Mayor declared said motion carried and Resolution #631 is passed

and adopted.

 

Discussion was held on the property located at 112 S Elm and the steps necessary for the City to obtain a clear title and deed. City Attorney Curtiss will get in contact with the Pierce County Attorney and bring back additional information to the April council meeting.

 

 

It was moved by Smith, seconded by Sanne to adjourn the meeting. Motion carried 4-0.
