City Council Meeting March 14 2023

 

REGULAR MEETING OF THE CITY COUNCIL

TUESDAY, MARCH 14, 2023

 

A meeting of the Mayor and Council of the City of Plainview, Nebraska, was held at the Council Chambers in said City on the 14th day of March at 6:30 o’clock P.M. 

 

Roll call was held and present were: Mayor Smith; Council Members: Alder, Born, Janovec and Sanne Absent: None

 

The Pledge of Allegiance was then recited.

 

Mayor Smith opened the meeting and announced to individuals in attendance that a full copy of the new Nebraska Open Meetings Act was posted on the east wall of the Council Chambers.

 

Notice of the meeting was given in advance thereof by Publication, a designated method for giving notice, as shown by the Affidavit of Publication attached to these minutes.  Notice of this meeting was given to the Mayor and all Members of the Council and a copy of their acknowledgment of receipt of notice and the agenda is attached to the minutes.  Availability of the agenda was communicated in the advance notice and in the notice to the Mayor and Council of this meeting.  All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.

 

Jeremy Tarr was present as City Administrator

Courtney Retzlaff was present as City Clerk.

Bruce Curtiss was present as City Attorney.

 

Sanne moved to approve the regular meeting minutes from February 14th. Janovec seconded the motion. Motion carried 4-0.

 

Alder moved to approve claims and payroll. Sanne seconded the motion. Motion carried 4-0.

 

Police Chief Hallock reported that February was a busy month for calls. Hallock also reported that a recent investigation into child pornography resulted in the FBI arresting the suspect in Chicago. A presentation on the dangers of opioid overdoses will be held on March 21st at 7:00 PM at the high school. The public is invited to attend.

 

Economic Development report was submitted by Susan Norris.

 

Motion was made by Sanne and seconded by Alder to approve Ordinance No. 985 on its first reading. Upon roll call vote, the following members voted AYE: Alder, Born, Janovec and Sanne. The following voted NAY: None. Motion carried 4-0. Whereupon the Mayor declared said Ordinance No. 985 approved on its first reading.

 

Motion was made by Sanne and seconded by Alder to approve Ordinance No. 985 on its second and third readings. Upon roll call vote, the following members voted AYE:  Alder, Born, Janovec and Sanne. The following voted NAY: None. Motion carried 4-0. Whereupon the Mayor declared said Ordinance No. 985 approved on its second and third reading.

 

ORDINANCE #985

 

AN ORDINANCE ADOPTING A SUPPLEMENT TO THE CODE OF ORDINANCES FOR THE CITY OF PLAINVIEW, NEBRASKA ADOPTING THE STATE LAW CHANGES MADE BY THE LEGISLATURE WHICH ARE SPECIFIC AND MANDATORY AND NECESSARY TO BRING THE CITY ORDINANCES AND CODE SECTIONS INTO CONFORMITY WITH STATE LAW AND AMENDING RESTATING, REVISING, UPDATING, CODIFYING AND COMPILING CERTAIN ORDINANCES OF THE CITY DEALING WITH THE SUBJECTS EMBRACED IN THE CODE OF ORDINANCES, AND PROVIDING PENALTIES FOR THE VIOLATION OF THE CODE OF ORDINANCES.

 

 

Council member Janovec introduced the following resolution and moved for its adoption:

 

 

 RESOLUTION #668

 

WHEREAS, there are federal funds available under Section 5311 of the Federal Transit Act and for the Nebraska Public Transportation Assistance Program, and

 

WHEREAS, the City of Plainview HandiVan desires to apply for said funds to provide public transportation in the city of Plainview area.

 

NOW THEREFORE, BE IT RESOLVED; the Plainview City Council hereby instructs the Plainview HandiVan and the City of Plainview to apply for said funds. Said funds are to be used for the Plainview HandiVan’s transportation operations in the FY 2023-2025 Application for Public Transportation Assistance.

 

Council member Born seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Alder, Born, Janovec, Sanne. Nay: None. Whereupon the Mayor declared said motion carried and Resolution #668 is passed and adopted.  

 

City Administrator Tarr gave the City Superintendent report. Tarr stated that Phase 2 of the 62-1 Well (Weiseth) rehab showed that the column inside is no good. Chris Miller of Miller & Associates advised that the City move to the next option for obtaining a new drinking water source. Testing of sites for a new well will begin this spring.

 

Mayor Smith read the following proclamation

 

WHEREAS: Nebraska Public Transportation week has been declared for April 9-15, 2023

 

AND WHEREAS: The date was chosen to honor the public transportation systems across Nebraska, including the local system better known as the Plainview HandiVan.

 

AND WHEREAS: Public transportation systems across the state of Nebraska are celebrating public transportation during this time frame.

 

AND WHEREAS: Every year thousands of Nebraska citizens are able to participate in using public transportation to help them remain independent.

 

AND WHEREAS: Plainview has continued to support the use of public transportation throughout the year.

 

AND WHEREAS: Plainview recognizes the hard work and dedication that the city staff and especially the drivers do to help make the Plainview HandiVan service an integral part of the lives of many residents in the community.

 

NOW THEREFORE BE IT RESOLVED that by virtue of the authority invested in me as Mayor of the City of Plainview, Nebraska, I, Robert Smith, do herby issue this proclamation to celebrate public transportation and I do hereby declare April 9-15, 2023 to be "Public Transportation Week".

 

Janovec moved to approve 20-DTR-005 amended drawdown #13 for $2,790.00. Alder seconded the motion. Motion carried 4-0.

 

Sanne moved to approve 19-PP-011 final drawdown for $990.00. Alder seconded the motion. Motion carried 4-0.

 

Juleen Johnson gave the Manor report stating that the Assisted Living license is up for renewal. The facility is still waiting on final numbers for employee health insurance and Dish Network will be installed the end of March, replacing the contract with Great Plains Communications for cable.

 

Janovec moved to approve CDS Inspections Housing Administration PLV-HR-19 for $200.00. Alder seconded the motion. Motion carried 4-0.

 

Sealed bids for rent of haying of the lagoons were opened by Mayor Smith.

 

The first bid was received from Tim Johnston for $676.62. The second bid was from Trent Tarr for $100/acre totaling $900. The third bid was from Brandon Myers for $100/acre totaling $900. Born moved to have Tarr and Myers resubmit bids to be opened at the April council meeting. Sanne seconded the motion. Motion carried 4-0.

 

Sanne moved to approve advertising for bids to rent the old lagoons by the transfer station. Alder seconded the motion. Motion carried 4-0.

 

Discussion was held on updates to the resolution regarding closure of Woodland Avenue between the schools. Updated changes will be approved in a formal resolution in April.

 

Discussion on updates to the Keno grant application were held. Sanne move to approve the updates as presented. Born seconded the motion. Motion carried 4-0.

 

Sanne moved to approve the application received from the Nebraska Liquor Commission for Christopher Sieck as corporate manager for Casey’s Retail Company. Janovec seconded the motion. Motion carried 4-0.

 

Sanne moved to approve fireworks during Klown Festival on June 3, 2023. Alder seconded the motion. Motion carried 4-0.

 

Council member Janovec introduced the following resolution and moved for its adoption:

 

RESOLUTION #669

 

WHEREAS, the Mayor and City of Plainview deem it necessary that Lincoln Avenue is closed to thru traffic between the ballfields from Main Street to Pine Street for sporting events hosted by Plainview Public Schools;

 

NOW THEREFORE BE IT RESOLVED, BY THE MAYOR AND COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA, THAT:

 

  1. Lincoln Avenue will be closed to thru traffic on the following dates and times:

 

*March 24, 2023 3:30-7:00 PM (Track Meet)

*March 31, 2023 9:00 AM-7:00 PM (Track Meet)

*April 4, 2023 3:30 PM-7:00 PM (Track Meet)

*May 9, 2023 11:00 AM-7:00 PM (Track Meet)

*May 10, 2023 8:00 AM-7:00 PM (Track Meet)

*August 18, 2023 5:00-10:00 PM (Fall Sports Kickoff)

*September 5, 2023 3:00-10:00 PM (Football Game)

*September 8, 2023 5:00-10:00 PM (Football Game)

*September 15, 2023 5:00-10:00 PM (Football Game)

*September 18, 2023 3:00-10:00 PM (Football Game)

*October 2, 2023 3:00-10:00 PM (Football Game)

*October 6, 2023 5:00-10:00 PM (Football Game)

Council member Sanne seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Alder, Born, Janovec, Sanne. Nay: None. Whereupon the Mayor declared said motion carried and Resolution #669 is passed and adopted.  

 

Discussion on Resolution #670 regarding street closures for the car show on June 3, 2023 will be tabled until the April monthly meeting.

 

There were no public comments.

 

Born moved to adjourn the meeting. Alder seconded the motion. Motion carried 4-0
