REGULAR MEETING OF THE CITY COUNCIL
TUESDAY JULY 14, 2020
A meeting of the Mayor and Council of the City of Plainview, Nebraska, was held at the Council Chambers in said City on the 14th day of July at 6:30 o’clock P.M.
.
Roll call was held and present were: Mayor Schlote; Council Members: Brookhouser, Yosten and Sanne. Absent: Smith
The Pledge of Allegiance was then recited.
Mayor Schlote opened the meeting and announced to individuals in attendance that a full copy of the new Nebraska Open Meetings Act was posted on the east wall of the Council Chambers.
Notice of the meeting was given in advance thereof by Publication, a designated method for giving notice, as shown by the Affidavit of Publication attached to these minutes. Notice of this meeting was given to the Mayor and all Members of the Council and a copy of their acknowledgment of receipt of notice and the agenda is attached to the minutes. Availability of the agenda was communicated in the advance notice and in the notice to the Mayor and Council of this meeting. All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.
Courtney Retzlaff was present as City Clerk.
Bruce Curtiss was present as City Attorney
Brookhouser moved to approve the special meeting minutes from June 4th and June 8th and the regular meeting minutes on June 9th .Yosten seconded the motion. Motion carried 3-0.
Brookhouser moved to approve claims and payroll. Sanne seconded the motion. Motion carried 3-0.
No Manor report was given.
Police report was given by Officer Neumann. The deadline for unlicensed vehicles has been extended to August 31, 2020 per Governor Ricketts.
Susan Norris presented on updates on the workforce housing grant which is scheduled to be in the next week, the LENRD park grant was awarded to the City for $18,500 and meetings will be held for the DTR Grant project on July 16th. A CDBG Grant is available to help with FEMA matching funds and project COBRA has selected a site outside of NE.
Council member Smith arrived at 6:38 PM.
City Superintendent Curt Hart stated that the sand volleyball courts were completed, the city workers will be working to pour concrete around town and reported on nitrate levels.
Shawn Enger of Suez Utility Services presented on the maintenance contract for the water tower that the City of Plainview currently has and a basic overview of the schedule of services.
D&K Lanes submitted an application for 2 SDL licenses on August 7, 2020 from 3:00 PM to 2:00 AM and August 8, 2020 from 10:00 AM to 2:00 AM both for beer gardens outside their facility on Main Street. Brookhouser moved to approve the licenses in accordance with current Directed Health Measures at the time of the events. Smith seconded the motion. Motion carried 4-0.
Updates on previously deemed nuisance properties were given to the council.
The property at 406 N 4th Street owned by Steve Classen and rented by Stephen Wood did not meet the requirements set forth in the notice of nuisance issued on 5/19/2020. Sanne moved to set a public hearing for the property owner. Brookhouser seconded the motion.
The property at 212 N Plum owned by Walter Friedrich and occupied by Barb Friedrich did not meet the requirements set forth in the notice of nuisance issued on 5/19/2020. Brookhouser moved to set a public hearing. Smith seconded the motion. Motion carried 4-0.
A letter of nuisance was issued on 6/11/2020 for the property at 305 N 4th Street occupied by Steve Beaudette. The letter stated that miscellaneous debris behind the storage shed needed to be disposed or store properly. Council stated that these requirements had not been made. Brookhouser moved to set a public hearing. Smith seconded the motion. Motion carried 4-0.
Zeb Spaulding was issued a nuisance notice on 6/11/2020 for the property at 306 N 5th Street. The buildings have not been removed and there are several downed trees that need to be disposed of. Smith moved to set a public hearing. Brookhouser seconded the motion. Motion carried 4-0.
The property at 511 E Pilcher had meet all requirements set forth in the nuisance notice issued on 6/11/2020. Smith moved to remove the property from the nuisance list. Brookhouser seconded the motion. Motion carried 4-0.
The health board recommended 2 properties to the council to be deemed as a nuisance.
The first property is located at 306 N 6th Street and owned by Zeb Spaulding. The house located on the property is not secure as all entrances need to be replaced or boarded up. Brookhouser moved to send a notice of nuisance to Spaulding. Smith seconded the motion. Motion carried 4-0.
The second property is located at 207 N 1st Street and owned by Shawn Cernick. The property has a trailer of discarded furniture and household trash that needs to be discarded. Brookhouser moved to send a notice of nuisance to Cernick. Smith seconded the motion. Motion carried 4-0.
The zoning board had several recommendations for building permits as listed:
A permit for a fence at 507 N 3rd Street was submitted by Luke Miller. Brookhouser moved to approve the permit. Sanne seconded the motion. Motion carried 4-0.
A permit for a fence at 302 N 2nd Street was submitted by Rod Cook. Brookhouser moved to approve the permit. Smith seconded the motion. Motion carried 4-0.
A permit for a fence at 101 S Pine was submitted by Mary Ann Dean. Brookhouser moved to approve the permit. Sanne seconded the motion. Motion carried 4-0.
A permit for a storage building at 102 N 7th Street was submitted by Roland Frahm. Brookhouser moved to approve the permit. Smith seconded the motion. Motion carried 4-0.
A permit for a fence at 511 E Pilcher was submitted by Roger Stewart. Brookhouser moved to approve the permit. Sanne seconded the motion. Motion carried 4-0.
A permit for a house at 86471 538 Ave, which is within the 1 mile jurisdiction of the City of Plainview, was submitted by James Aschoff. Brookhouser moved to approve the permit. Sanne seconded the motion. Motion carried 4-0.
A permit for a fence and porch replacement at 308 N 3rd Street was submitted by Patty VanEvery. Brookhouser moved to approve the permit. Smith seconded the motion. Motion carried 4-0.
A permit for a fence at 107 S 1st Street was submitted by Toni Hart. Brookhouser moved to approve the permit. Sanne seconded the motion. Motion carried 4-0.
A permit for a garage at 710 West Park was submitted by Rosena Norris. Sanne moved to approve the permit. Brookhouser seconded the motion. Motion carried 4-0.
A permit for a garage and deck at 201 N Main Street was submitted by Cassy Wright. Brookhouser moved to approve the permit. Smith seconded the motion. Motion carried 4-0.
City Clerk Retzlaff updated that approximate cost to pave North 6th Street between Pilcher and Woodland Ave would be $175,000. Additional information will be gathered regarding costs for each property owner and payment options.
Kristine Wacker was present to ask for permission to close Woodland Ave between the schools and hold Post Prom activities outside the facilities on July 24, 2020 from 11:30 PM to 3:00 AM. Brookhouser moved to all the event. Sanne seconded the motion. Motion carried 4-0.
Brook Curtiss asked for permission to close Locust Ave from Main Street to Elm Street on July 18th from 9:00 AM to noon for the Sidewalk Chalk Contest. Sanne moved to approve the street closure. Brookhouser seconded the motion. Motion carried 4-0.
Council member Sanne introduced the following resolution and moved for its adoption:
RESOLUTION #604
WHEREAS, the City of Plainview, Nebraska has received requests for stop signs at the intersection of Ash Street and King Street
AND WHEREAS, the Mayor and City Council deem it to be in the best interest of the citizens of Plainview that the requested signs be posted;
NOW THEREFORE BE IT RESOLVED, THE MAYOR AND COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA, THAT:
1. That Stop Signs shall be placed at the intersection of Ash Street and King Street stopping the East bound and West bound traffic.
Council member Smith seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Sanne, Brookhouser, Smith and Yosten. Nay: None. Whereupon the Mayor declared said motion carried and Resolution #604 is passed
and adopted.
Discussion on possible future action by the City of Plainview in regards to the PCSI building in downtown Plainview was held. A title search indicated there are tax liens on the property and the building is beyond repair. Council agreed to have the health board begin the process of deeming the property a nuisance.
City Clerk Retzlaff presented on possible refinancing of the Library GO Bonds by changing the interest rate from 3.38% to 2%, which would save the City $47,000 over the life of the bond payments. Council agreed that it is in the best interest to refinance. A formal Ordinance to refinance will be presented at a future council meeting.
An invoice was submitted by CDS Inspections for lead paint inspection services for housing project PLVW-HR-16 in the amount of $1,000. Brookhouser moved to pay the invoice. Sanne seconded the motion. Motion carried 4-0.
A discussion was held on updating the current Ordinance on fireworks hours within City limits. Currently fireworks are permitted to be ignited from 12:00 PM (noon) to 10:00 PM June 24-July 3 and July 5. It was asked to extend the hour to 10:30 PM on those dates. Council agreed to update the Ordinance at the August meeting.
Two drawdowns were presented for the CDBG DTR grant. The first invoice was for $7,800 for project funds with the other invoice in the amount of $1,395 for general administration services. Brookhouser moved to approve paying the drawdowns. Yosten seconded the motion. Motion carried 4-0.
Concerns over a registered sex offender residing near the schools were addressed and City Attorney Curtiss agreed to contact law enforcement.
No committee report was given regarding breed specific bans on dogs in City limits. Further discussion will be tabled until additional information is gathered.
Following recent interviews, the Mayor recommended that the council hire Jeremy Tarr of Burwell as the new City Administrator. Smith moved to hire Tarr. Brookhouser seconded the motion. Motion carried 4-0.
Mayor Schlote recommended that the starting wage for Tarr be set at $66,000 annually with 40 hours of sick and vacation pay given at the time of hire. Tarr will also qualify for all benefits of full-time employees. Brookhouser moved to approve the wage for Tarr. Sanne seconded the motion. Motion carried 4-0.
A formal contract for Tarr will be approved at the August council meeting.
Council member Smith thanked all from the City involved in completing the sand volleyball courts and for cleaning up areas around town.
Torrey Gerdes and Susan Foster of Baylor Evnen, LLP joined the council meeting via Zoom regarding litigation.
Council member Brookhouser motioned to go into executive session to discuss litigation, strategy, possible negotiation and to protect the reputation of an employee in regards to a personnel issue. Smith seconded the motion. Motion carried 3-1 with Yosten voting no. The council entered executive session at 8:20 PM.
At 9:08 PM Brookhouser moved to come out of executive session. Smith seconded the motion. Motion carried 4-0.
Brookhouser moved to retain Rex Schultze to serve as a hearing officer in the event Police Chief Bruce Yosten requests a personnel hearing and to authorize Mr. Shultze to conduct the hearing on behalf of the City Council. Smith seconded the motion. Motion carried 3-0 with Yosten abstaining.
Brookhouser moved to engage a court reporter in the event Police Chief Bruce Yosten requests a personnel hearing to make preserve record of the hearing. Sanne seconded the motion. Motion carried 3-0 with Yosten abstaining.
It was moved by Brookhouser, seconded by Smith to adjourn the meeting. Motion carried 4-0.
