REGULAR MEETING OF THE CITY COUNCIL
TUESDAY, JULY 9, 2024
A meeting of the Mayor and Council of the City of Plainview, Nebraska, was held at the Council Chambers in said City on the 9th day of July at 6:30 o’clock P.M.
Roll call was held and present were: Mayor Smith; Council Members: Anderson, Born, Janovec and Sanne Absent: None
The Pledge of Allegiance was then recited.
Mayor Smith opened the meeting and announced to individuals in attendance that a full copy of the new Nebraska Open Meetings Act was posted on the east wall of the Council Chambers.
Notice of the meeting was given in advance thereof by Publication, a designated method for giving notice, as shown by the Affidavit of Publication attached to these minutes. Notice of this meeting was given to the Mayor and all Members of the Council and a copy of their acknowledgment of receipt of notice and the agenda is attached to the minutes. Availability of the agenda was communicated in the advance notice and in the notice to the Mayor and Council of this meeting. All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.
Courtney Retzlaff was present as City Clerk.
Jeremy Tarr was present as City Administrator
Kyle Petersen was present as City Attorney.
Janovec moved to approve the regular meeting minutes from June 11th. Anderson seconded the motion. Motion carried 4-0.
Sanne moved to approve claims and payroll. Anderson seconded the motion. Motion carried 4-0.
Manor report was given by Juleen Johnson. The walk-in cooler is nearing completion, the board voted to have the monthly meeting on the last Wednesday of each month at 4:00 PM and the facility is looking into replacing the current van.
Police Chief Hallock reported that the new equipment has been installed in both vehicles, numbers for the department have been consistently up over the last 3 years and there are several cases in court for the upcoming weeks.
No Economic Development report was given.
City Administrator Tarr reported that the downtown flower baskets will need to be looked at due to the flowers drying up.
City Attorney Petersen stated that the trustee’s sale for 107 S 1st Street has been postponed to August 9th. Petersen also asked to go into executive session at the end of the meeting for discussion of legal matters of the municipality.
Mayor Smith recommended the appointment of Tricia Scott to a four year term on the HandiVan board. Born moved to approve the appointment. Anderson seconded the motion. Motion carried 4-0.
City Administrator Tarr stated he had spoken with City’s auditor, Kyle Overturf about the allocation of City sales tax. Overturf advised to leave the sales tax as is and the City will revisit it again in 2026.
At 6:45 PM Mayor Smith opened the public hearing for the Blight Study, Proposed Redevelopment Area 2.
Bobbi Pettit of Five Rule Planning explained the purpose of the public hearing and why the Blight Study was being completed.
Sanne moved to come out of the public hearing at 6:49 PM. Janovec seconded the motion. Motion carried 4-0.
Sanne moved to approve the Blight Study, Proposed Redevelopment Area 2 as presented. Janovec seconded the motion. Motion carried 4-0.
At 6:51 PM Born moved to open the public hearing for the General Redevelopment Plan, Proposed Redevelopment Area 2. Janovec seconded the motion. Motion carried 4-0.

Sanne moved to close the public hearing at 6:53 PM. Anderson seconded the motion. Motion carried 4-0.

At 6:54 PM Sanne moved to open the public hearing for Blight Study, Proposed Redevelopment Area 3. Janovec seconded the motion. Motion carried 4-0.

At 6:56 PM Sanne moved to open the public hearing for the General Redevelopment Plan, Proposed Redevelopment Area 3. Born seconded the motion. Motion carried 4-0.

Sanne moved to approve the General Redevelopment Plan, Proposed Redevelopment Area 3 as presented. Janovec seconded the motion. Motion carried 4-0.
At 7:02 PM Born moved to open the public hearing for a Lot Split at 33 28 4 Plainview College Add Blk 36. Janovec seconded the motion. Motion carried 4-0.
City Administrator Tarr stated the lot split was requested for the property owned by Terrell Milburn that has a cell phone tower. The cell phone company had requested the lot split.
Sanne moved to close the public hearing at 7:03 PM. Born seconded the motion. Motion carried 4-0.
Sanne moved to approve the lot split at 33 28 4 Plainview College Add Blk 36. Janovec seconded the motion. Motion carried 4-0.
A contract was presented from Miller & Associates Consulting for preparation of a lagoon evaluation pertaining to the City of Plainview’s Consent Order. Born moved to approve the contract. Anderson seconded the motion. Motion carried 4-0.
Council member Sanne introduced the following resolution and moved for its adoption:
RESOLUTION #705
A RESOLUTION TO GRANT POSSESSION OF REAL ESTATE OWNED BY THE CITY OF PLAINVIEW LOCATED AT 304 E. WOODLAND AVENUE IN PLAINVIEW TO JOHN AND RACHEL TORREY
WHEREAS, the City of Plainview is the owner of real estate located at 304 E. Woodland Avenue in Plainview and legally described as follows (hereinafter the “City Real Estate”):
Lot 12, Block 6, Peed’s Second Addition to Plainview, Pierce County, Nebraska.
WHEREAS, the City Council previously adopted Resolution No. 704, which authorized the sale of the City Real Estate to John and Rachel Torrey;
WHEREAS, notice of the proposed sale of the property has been published, but the remonstrance period has not expired yet; and
WHEREAS, the City Council wishes to grant possession of the City Real Estate to John and Rachel Torrey prior to the closing of the transaction authorized by Resolution No. 704.
BE IT RESOLVED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA, AS FOLLOWS:
Section 1. The City of Plainview hereby grants possession of the City Real Estate to John and Rachel Torrey. Said right of possession shall terminate if a sufficient remonstrance petition objecting to the sale of the City Real Estate is timely filed or the prospective buyer fails to purchase the City Real Estate pursuant to the terms of Resolution No. 704.
Section 2. That all resolutions or parts of resolutions in conflict be and are hereby repealed.
Council member Janovec seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Anderson, Born, Janovec and Sanne. Nay: None. Whereupon the Mayor declared said motion carried and Resolution #705 is passed and adopted.
City Administrator Tarr will look at dates for a budget workshop in August.
There were no council comments.
Public comments were received in regards to the maximum percentage of town that is allowed to be blighted. August 17th will be the bicycle rodeo presented by the Plainview Police Department.
Sanne moved to go into executive session at 7:12 PM for the purpose of legal matters of the municipality. Anderson seconded the motion. Motion carried 4-0.
At 7:35 PM Born moved to close executive session. Born seconded the motion. Motion carried 4-0.
Anderson moved to adjourn the meeting. Born seconded. Motion carried 4-0
