REGULAR MEETING OF THE CITY COUNCIL
TUESDAY, JUNE 11, 2024
A meeting of the Mayor and Council of the City of Plainview, Nebraska, was held at the Council Chambers in said City on the 11th day of June at 6:30 o’clock P.M.
Roll call was held and present were: Mayor Smith; Council Members: Anderson, Born and Janovec Absent: Sanne
The Pledge of Allegiance was then recited.
Mayor Smith opened the meeting and announced to individuals in attendance that a full copy of the new Nebraska Open Meetings Act was posted on the east wall of the Council Chambers.
Notice of the meeting was given in advance thereof by Publication, a designated method for giving notice, as shown by the Affidavit of Publication attached to these minutes. Notice of this meeting was given to the Mayor and all Members of the Council and a copy of their acknowledgment of receipt of notice and the agenda is attached to the minutes. Availability of the agenda was communicated in the advance notice and in the notice to the Mayor and Council of this meeting. All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.
Courtney Retzlaff was present as City Clerk.
Jeremy Tarr was present as City Administrator
Kyle Petersen was present as City Attorney.
Janovec moved to approve the regular meeting minutes from May 13th. Anderson seconded the motion. Motion carried 3-0.
Anderson moved to approve claims and payroll. Born seconded the motion. Motion carried 3-0.
No Manor report was given.
Police Chief Hallock reported that a quote for approximately $1,800 for a wrap on the new police vehicle was received from Love Signs. Jones Automotive will be installing the new equipment in the police vehicles the end of June. State radios were installed in all department vehicles. The dog kennel license will cost $150 and the kennel will need to be set up prior to inspection.
No Economic Development report was given.
City Administrator Tarr reported on the projects of the maintenance and park workers.
City Attorney Petersen reported that his continuing to finish up Deeds of Trust and Promissory Notes for the DTR grant award recipients. The Ordinance to vacate the alley for Hunter and Sydney Ashburn has been recorded by Pierce County.
Council member Born introduced the following resolution and moved for its adoption:
RESOLUTION #705
A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF PLAINVIEW, NEBRASKA, APPROVING A CONTRACT EXTENSION REQUEST TO THE NEBRASKA DEPARTMENT OF ECONOMIC DEVELOPMENT TO EXTEND THE CONTRACT COMPLETION DATE TO AUGUST 20, 2024, FOR THE DOWNTOWN REVITALIZATION GRANT INVOLVING COMMERCIAL REHABILITATION (PROJECT NO. 20-DTR-005).
WHEREAS, the City of Plainview, Nebraska, received $435,00 for CDBG Downtown Revitalization Development activities which include $25,000 for general administration, $10,000 for construction management, $380,000 for commercial rehabilitation, and $20,000 for clearance/demolition; and
WHEREAS, the City of Plainview, Nebraska, had a contract completion date of May 20, 2024, but will need an additional three months to complete the clearance/demolition portion of the grant.
NOW, THEREFORE, BET IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA, the request to the Nebraska Department of Economic Development to extend the contract completion date for the commercial rehabilitation portion of Community Development Block Grant (Project No. 20-DTR-005) to August 20, 2024, is hereby approved.
Council member Janovec seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Anderson, Born and Janovec. Nay: None. Whereupon the Mayor declared said motion carried and Resolution #705 is passed and adopted.
Mayor Smith made several appointments to various City boards.
Melissa Hoffart and Traci Ober were recommended for 3 year terms on the Manor Board. Born moved to approve the Manor Board appointments. Anderson seconded the motion. Motion carried 3-0.
Shelley Selling was recommended for a 3 year term on the Zoning Board. Born moved to approve the Zoning Board appointment. Anderson seconded the motion. Motion carried 3-0.
Valerie Tarr, Bernice Yilk and Brandi Johansen were recommended for 4 year terms on the Library Board. Born moved to approve the Library Board appointments. Anderson seconded the motion. Motion carried 3-0.
Gayle Sellin and Lois Moser were recommended for 4 year terms on the HandiVan Board. Born moved to approve the HandiVan Board appointments. Anderson seconded the motion. Motion carried 3-0.
There is still one open position on the HandiVan Board that will be appointed in July.
Anderson moved to approve the Special Designated Liquor license application for Plainview Fire & Rescue on August 2nd for a Street Dance from 4:00 PM -2:00 AM. Janovec seconded the motion. Motion carried 3-0.
Discussion was held on the City sales tax allocations and any changes would require 70% approval by the City Council and a vote in November on the ballot. City Attorney Petersen recommended leaving the sales tax as is and more discussion will occur in July.
Motion was made by Janovec and seconded by Born to waive the second and third readings of Ordinance No. 994. Upon roll call vote, the following members voted AYE: Anderson, Born and Janovec. The following voted NAY: None. Motion carried 3-0. Whereupon the Mayor declared the second and third readings of said Ordinance No. 994 waived.

ORDINANCE NO. 994
AN ORDINANCE TO AMEND SECTION 6-117 OF THE PLAINVIEW MUNICIPAL CODE REGARDING THE DEFINITION OF DANGEROUS DOGS AND THE RESPONSIBILITIES OF OWNERS OF THE SAME.
Janovec moved to approve the contract from Five Rule Planning for the 2024 NAHTF Application. Anderson seconded the motion. Motion carried 3-0.
Motion was made by Janovec and seconded by Born to waive the second and third readings of Ordinance No. 998. Upon roll call vote, the following members voted AYE: Anderson, Born and Janovec. The following voted NAY: None. Motion carried 3-0. Whereupon the Mayor declared the second and third readings of said Ordinance No. 998 waived.

ORDINANCE NO. 998
AN ORDINANCE TO CONFIRM THE SALE OF REAL ESTATE OWNED BY THE CITY OF PLAINVIEW LOCATED AT 202 S. 1ST STREET IN PLAINVIEW TO MICHAEL AND NANCY NAPRSTEK FOR $625.00.
Discussion was held on an upcoming auction June 13th at the City of Norfolk for possible purchase of a 50’ walking trailer for the transfer station. Anderson moved to allow the possible purchase not to exceed $15,000. Born seconded the motion. Motion carried 3-0.
Discussion on the upcoming budget for FY 2024/2025 was held. City Administrator Tarr listed several items that will be discussed during upcoming meetings and workshops. A date in August will be set for a budget workshop.
There were no council comments.
Questions on paving of streets that are adjacent to City owned properties and how payments would be handled were answered.
Janovec moved to adjourn the meeting. Anderson seconded. Motion carried 3-0
