City Council Meeting October 10 2023

 

REGULAR MEETING OF THE CITY COUNCIL

TUESDAY, OCTOBER 10, 2023

 

A meeting of the Mayor and Council of the City of Plainview, Nebraska, was held at the Council Chambers in said City on the 10th day of October at 6:30 o’clock P.M. 

 

Roll call was held and present were: Mayor Smith; Council Members: Anderson, Born, Janovec and Sanne Absent: None

 

The Pledge of Allegiance was then recited.

 

Mayor Smith opened the meeting and announced to individuals in attendance that a full copy of the new Nebraska Open Meetings Act was posted on the east wall of the Council Chambers.

 

Notice of the meeting was given in advance thereof by Posting in three places for designated method for giving notice.  Availability of the agenda was communicated in the advance notice and in the notice to the Mayor and Council of this meeting.  All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.

 

Jeremy Tarr was present as City Administrator

Courtney Retzlaff was present as City Clerk.

Kyle Petersen was present as City Attorney

 

At 6:30 PM Mayor Smith opened the Public Hearing for the One and Six Year Street Improvement Plan

 

City Administrator Tarr gave an overview of the purpose of the One and Six plan. Several citizens spoke on why they would like to have specific streets removed from the plan.

 

At 6:41 PM Sanne moved to close the public hearing. Janovec seconded the motion. Motion carried 4-0.

 

The council will discuss the One and Six Plan again at the November meeting and adopt the plan at that time. Citizens will have an opportunity to address the council about the plan at the November meeting.

 

Janovec moved to approve the regular meeting minutes from September 12th, the budget hearing on September 14th and the special meeting on September 25th. Anderson seconded the motion. Motion carried 4-0.

 

Sanne moved to approve claims and payroll. Anderson seconded the motion. Motion carried 4-0.

 

Mayor Smith presented the Manor report, updating that the new doors had been ordered and bids are still being looked at for the walk-in cooler and concrete/asphalt for the parking lot.

 

Police Chief Hallock reported that September numbers were steady. A quote for 2 radars was presented and a grant from Region 11 Emergency Management will be applied for to assist with the total cost. Updates on nuisance properties and unsafe buildings around town were given.

 

No Economic Development report was given.

 

City Administrator Tarr reported that the quarterly nitrate levels were at 9.27 mg/L in September, which is below the maximum level of 10 mg/L. The City is no longer required to provide bottled water. The next quarterly test will be the end of December.

 

Brad Slaughter of First National Capital Markets of Omaha presented on the upcoming bond for the recent street paving projects. The call date on the BANS would be December 15th and current net interest is 5.7%. The City would have the option to refinance after 5 years.

 

Council member Sanne introduced the following resolution and moved for its adoption:

 

RESOLUTION #684

 

BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA, AS FOLLOWS:

 

            Section 1. That the following notes issued by the City of Plainview, Nebraska are hereby called for redemption at par plus accrued interest to the extent and on such date as set forth in the Designation of Call Date (as defined below):

 

Street Improvement Bond Anticipation Notes, Series 2023, dated July 6, 2023, in the outstanding principal amount of $600,000, numbered as they are shown on the books and records of the Paying Agent and Registrar, maturing in the principal amount and bearing CUSIP numbers as follows:

            Section 2. Said notes are payable at the offices of the City Treasurer, as Paying Agent and Registrar, in Plainview, Nebraska.

 

            Section 3. The Mayor or the City Clerk of the City (each, an “Authorized Officer”) are hereby authorized at any time on or after the date of this Resolution to determine the call date for said notes on behalf of the City and such determination, when made in writing (the “Designation of Call Date”), shall constitute the action of the City without further action of the Mayor and Council of the City. The Call Date shall be set for any time on or after December 15, 2023 (the earliest call date for the Notes), provided, however, that on and after June 30, 2024, the Authorized Officers shall have no authority to make any such determination hereunder without further action of the Mayor and Council of the City and this Resolution shall be of no further force and effect.

 

            Section 4. A copy of this Resolution shall be filed with the Paying Agent and Registrar and said Paying Agent and Registrar is hereby instructed to give notice of redemption in the manner provided for in the ordinance authorizing said notes and in accordance with the Designation of Call Date.

 

Council member Born seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Anderson, Born, Janovec, Sanne. Nay: None. Whereupon the Mayor declared said motion carried and Resolution #684 is passed and adopted.

 

Motion was made by Sanne and seconded by Born to approve Ordinance No. 992. Upon roll call vote, the following members voted AYE: Anderson, Born, Janovec and Sanne. The following voted NAY: None. Motion carried 4-0. Whereupon the Mayor declared said Ordinance No. 992 approved.

 

Motion was made by Sanne and seconded by Born to waive the second and third readings of Ordinance No. 992. Upon roll call vote, the following members voted AYE: Anderson, Born, Janovec and Sanne. The following voted NAY: None. Motion carried 4-0. Whereupon the Mayor declared the second and third readings of said Ordinance No. 992 waived.

 

ORDINANCE NO. 992

AN ORDINANCE AUTHORIZING THE ISSUANCE OF GENERAL OBLIGATION PAVING BONDS, SERIES 2023, OF THE CITY OF PLAINVIEW, NEBRASKA, IN THE PRINCIPAL AMOUNT OF NOT TO EXCEED SIX HUNDRED TWENTY THOUSAND DOLLARS ($620,000) TO PAY THE COST OF CONSTRUCTING PAVING AND RELATED IMPROVEMENTS IN CERTAIN STREET IMPROVEMENT PROJECTS OF THE CITY; PRESCRIBING THE FORM OF SAID BONDS; PROVIDING FOR A SINKING FUND AND FOR THE LEVY AND COLLECTION OF TAXES TO PAY SAID BONDS; PROVIDING FOR THE SALE OF THE BONDS; AUTHORIZING THE DELIVERY OF THE BONDS TO THE PURCHASER; PROVIDING FOR THE DISPOSITION OF THE BOND PROCEEDS AND ORDERING THE ORDINANCE PUBLISHED IN PAMPHLET FORM.

 

Corrine Janovec gave the annual Klown Doll Museum visitor report for 2023.

 

Keno grant applications for the quarter were discussed.

 

Plainview Ballbackers requested $5,000 for updates to the seating area at the Legion field. Janovec moved to approve the grant. Sanne seconded the motion. Motion carried 4-0.

 

The City of Plainview requested $40,986 for rubber mulch in Chilver’s Park around the playground equipment. City Administrator Tarr has applied for a grant to help offset the cost of the mulch and if received, the City would not utilize the entire Keno grant. Janovec moved to approve the grant for $40,986. Born seconded the motion. Motion carried 4-0.

 

Discussion was held on adding a second outlet for Keno in Plainview. Sherry Ristow had spoken with Nebraska Cooperative lottery personnel and is requesting to add Keno at Keystone Bar. Janovec moved to approve Keystone Bar as an outlet for the City of Plainview/Nebraska Cooperative Government lottery. Anderson seconded the motion. Motion carried 4-0.

 

Sanne moved to approve 20-TFRH-35023 Drawdown #10 in the amount of $52,149.28. Janovec seconded the motion. Motion carried 4-0.

 

Motion was made by Sanne and seconded by Janovec to approve Ordinance No. 990. Upon roll call vote, the following members voted AYE: Anderson, Born, Janovec and Sanne. The following voted NAY: None. Motion carried 4-0. Whereupon the Mayor declared said Ordinance No. 990 approved.

 

Motion was made by Sanne and seconded by Anderson to waive the second and third readings of Ordinance No. 990. Upon roll call vote, the following members voted AYE: Anderson, Born, Janovec and Sanne. The following voted NAY: None. Motion carried 4-0. Whereupon the Mayor declared the second and third readings of said Ordinance No. 990 waived.

 

ORDINANCE NO. 990

 

AN ORDINANCE TO SET THE SALARY AND EMPLOYMENT TERMS FOR THE CITY ADMINISTRATOR.

BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA:

 

Section 1. That the Ordinance setting the salary and employment terms for the City Administrator, should be amended as follows:

 

  1. That effective October 1, 2023 the salary for the City Administrator shall be set at the annual amount of $85,466.10 as base salary, paid on the normal City payroll schedule, plus benefits as normally provided to full time employees, with future cost of living and merit adjustments to be set by Resolution;

 

  1. That any other details, not in conflict with the City Code, shall be handled as separate agenda items, approved by motion and set forth in the minutes of the City Council.

 

Section 2. Any other ordinance or section passed and approved prior to passage, approval and publication of this ordinance and in conflict with its provisions is repealed.

 

Section 3. This ordinance shall take effect and be in full force from and after its passage, approval, and publication as required by law.

 

Sanne moved to approve City Administrator Tarr’s annual contract effect October 1, 2023. Anderson seconded the motion. Motion carried 4-0.

 

Mayor Smith recommended James Rau to fill the open maintenance position. Born moved to hire Rau. Sanne seconded the motion. Motion carried 4-0.

 

Born moved to set the starting wage for James Rau at $18 per hour. Janovec seconded the motion. Motion carried 4-0.

 

Discussion on use of Manor Sales Tax funds for facility improvements will be tabled to a future meeting.

 

Council member Born introduced the following resolution and moved for its adoption:

 

RESOLUTION NO. 685

 

A RESOLUTION TO PURCHASE REAL ESTATE OWNED BY JUDY BEAUDETTE LOCATED AT 205 N. PINE STREET

           

WHEREAS, Judy Beaudette is the owner of real estate located at 205 N. Pine Street, Plainview, Nebraska, and legally described as (hereinafter the “Real Estate”):

Tract “A” of Beaudette Lot Split, an Administrative Plat of Lot 8, Block 12, Chilver’s Sixth Addition to the City of Plainview, Pierce County, Nebraska, which is legally described as follows:

Lot 8, Block 12, Chilver’s 6th Addition to the City of Plainview, Pierce County, Nebraska:

                        EXCEPT the South 10.00 feet thereof, AND

EXCEPT the East 6.00 feet thereof, previously deeded to the City of Plainview for alley purposes, and recorded in Deed book 47, Page 395, Pierce County Register of Deeds, Pierce County, Nebraska

 

WHEREAS, Municipal Code § 18-110 provides that the City shall acquire an interest in real property by purchase or eminent domain only after the City Council has authorized the acquisition by action taken in a public meeting after notice and public hearing.  

 

BE IT RESOLVED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA, AS FOLLOWS:

 

            Section 1. The City Council shall hold a public hearing regarding the acquisition of the Real Estate for $25,000.00 on December 12, 2023.

 

            Section 2. Notice of the proposed acquisition and the public hearing set forth in the preceding Section shall be published in a newspaper of general circulation in the City. Publication of said notice shall be provided more than 30 days prior to the public hearing set forth in the preceding Section.

 

Section 3.  That all resolutions or parts of resolutions in conflict be and are hereby repealed.

 

Council member Sanne seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Anderson, Born, Janovec, Sanne. Nay: None. Whereupon the Mayor declared said motion carried and Resolution #685 is passed and adopted.

 

Sanne moved to approve the LB840 board recommendation for a sign grant of $1,000 to Altwine Hardware & Home LLC. Born seconded the motion. Motion carried 4-0.

 

Born moved to approve transfer of the proceeds from the sale of the Manor van in the amount of $600 to the Plainview Manor. Janovec seconded the motion. Motion carried 4-0.

 

Sanne moved to change the date of the November council meeting to Monday, November 13th at 6:30 PM at the Plainview Library. Born seconded the motion. Motion carried 4-0.

 

Sanne moved to adjourn the meeting. Born seconded. Motion carried 4-0
