City Council Meeting Minutes July 11 2023

 

 

REGULAR MEETING OF THE CITY COUNCIL

TUESDAY, JULY 11, 2023

 

A meeting of the Mayor and Council of the City of Plainview, Nebraska, was held at the Council Chambers in said City on the 11th day of July at 6:30 o’clock P.M. 

 

Roll call was held and present were: Mayor Smith; Council Members:  Born, Janovec and Sanne Absent: None

 

The Pledge of Allegiance was then recited.

 

Mayor Smith opened the meeting and announced to individuals in attendance that a full copy of the new Nebraska Open Meetings Act was posted on the east wall of the Council Chambers.

 

Notice of the meeting was given in advance thereof by Publication, a designated method for giving notice, as shown by the Affidavit of Publication attached to these minutes.  Notice of this meeting was given to the Mayor and all Members of the Council and a copy of their acknowledgment of receipt of notice and the agenda is attached to the minutes.  Availability of the agenda was communicated in the advance notice and in the notice to the Mayor and Council of this meeting.  All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.

 

Jeremy Tarr was present as City Administrator

Courtney Retzlaff was present as City Clerk.

 

Sanne moved to approve the meeting minutes from June 13th. Born seconded the motion. Motion carried 3-0.

 

Sanne moved to approve claims and payroll. Born seconded the motion. Motion carried 3-0.

 

Juleen Johnson reported that the Manor is still working with agents on health insurance updates, the annual State survey of the facility went well and they still have staff openings.

 

Police Chief Hallock reminded citizens to not leave valuables inside vehicles and to lock them due to increased break ins. Updates were given on weed abatement letters, storm damage from July 10th and concerns on protocols followed by the school district. Tentatively a bike rodeo will be held on August 9th at the library with possible bike raffles and helmet giveaways.

 

At 6:45 PM Mayor Smith opened the Public Hearing for Rezoning 112 S. Elm Street from R-3 to C-2.

 

City Administrator Tarr stated that the zoning board recommended to rezone the above mentioned property during a public hearing on July 10th.

 

Sanne moved to close the public hearing at 6:50 PM. Born seconded the motion. Motion carried 3-0.

 

Sanne moved to approve the zoning change for 112 S. Elm Street from R-3 to C-2. Janovec seconded the motion. Motion carried 3-0.

 

At 6:50 PM Mayor Smith opened the Public Hearing for the lot split at 205 N Pine Street.

 

City Administrator Tarr stated that after having the property surveyed, Judy Beaudette would like an additional 10 feet to move the property line away from her residence. The zoning board recommended the lot split during a public hearing on July 10th.

 

Born moved to close the public hearing at 6:52 PM. Janovec seconded the motion. Motion carried 3-0.

 

Born moved to approve the lot split at 205 N Pine. Janovec seconded the motion. Motion carried 3-0.

 

Susan Norris reported that the ribbon cutting for the housing project was well attended. Updates were given on the child care surveys, DTR round 3 applications will be open the end of July or early August and a committee will need to be formed to discuss the creation of a creative district in order to be eligible for CDBG grants in the future.

 

City Administrator Tarr reported that the staff was busy during June with various projects around town. Concerns on how patrons are utilizing the park bathrooms was discussed and the City will be installing cameras outside.

 

Mayor Smith appointed Meggie Anderson to fill the open council seat vacated by Bryon Alder in June. Janovec moved to appoint Anderson to fill the position through 2024. Born seconded the motion. Motion carried 3-0.

 

Council member Anderson read the Oath of Office and took her seat in the council chambers.

 

Motion was made by Sanne and seconded by Born to approve Ordinance No. 987. Upon roll call vote, the following members voted AYE: Anderson, Born, Janovec and Sanne. The following voted NAY: None. Motion carried 4-0. Whereupon the Mayor declared said Ordinance No. 987 approved.

 

Motion was made by Sanne and seconded by Janovec to waive the second and third readings of Ordinance No. 987. Upon roll call vote, the following members voted AYE: Anderson, Born, Janovec and Sanne. The following voted NAY: None. Motion carried 4-0. Whereupon the Mayor declared the second and third readings of said Ordinance No. 987 waived.

 

ORDINANCE NO. 987

 

AN ORDINANCE TO ADOPT THE INTENATIONAL PROPERTY MAINTENANCE CODE.

 

NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA:

 

Section 1.  A certain document, one (1) copy which is on file in the office of the city clerk of the City of Plainview, Nebraska, being marked and designated as the “International Property Maintenance Code 2021 Edition,” as published by The International Code Council, Inc., is hereby adopted as the property maintenance code of the City of Plainview, Nebraska, as if fully set out in this section, with the additions, insertions, deletions and changes, if any, prescribed in section 3 of this ordinance.

 

Section 2. In the event of a conflict between the provisions of the publication adopted by reference in this ordinance and any other provisions of the Municipal Code, such other provisions shall be controlling.

 

Section 3.  The following sections of the property maintenance code adopted in Section 1 are hereby revised as follows:

  • Section 101.1   Insert:  “the City of Plainview, Nebraska” in place of [NAME OF JURISDICTION]
  • Section 103.1. Creation of agency. Insert: “Building Inspector designee” in place of [NAME OF DEPARTMENT]
  • Section 302.4. Weeds. Insert: “12 inches” in place of [JURISDICTION TO INSERT HEIGHT IN INCHES]
  • Section 304.14. Insect screens. Insert: “April 1” and “November 1” in place of [DATE] and [DATE]
  • Section 602.3. Heat supply. Insert: “November 1” and “April 1” in place of [DATE] and [DATE]
  • Section 602.4. Occupiable work spaces. Insert: “November 1” and “April 1” in place of [DATE] and [DATE]

 

Section 4.  If any provision of this ordinance shall be held invalid, its invalidity shall not affect any other provisions of this ordinance that can be given effect without the invalid provisions, and for this purpose the provisions of this ordinance are hereby declared to be severable.

 

Section 5.  All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed.

 

Section 6.  At least one copy of this ordinance shall be on file in the office of the City Clerk and available for inspection by members of the public during the hours the office is open for the ordinary transaction of business.  The Clerk shall file a copy of this ordinance with the County Court.

 

Section 7. This ordinance shall take effect from and after its passage, approval, and publication or posting as required by law.

 

 

Sanne moved to approve the 20-TFRH-35023 Drawdown #9 in the amount of $2,821.11. Janovec seconded the motion. Motion carried 4-0.

 

 

Council member Sanne introduced the following resolution and moved for its adoption:

 

RESOLUTION #676     

 

A RESOLUTION TO AUTHORIZE THE SALE OF REAL ESTATE OWNED BY THE CITY OF PLAINVIEW LOCATED AT 112 S. ELM STREET TO JOHN STEINKRAUS

           

WHEREAS, the City of Plainview is the owner of real estate located at 112 S. Elm Street in Plainview and legally described as follows (hereinafter the “City Real Estate”):

The East 135 feet of Lot 6, Block 3, Original Town of Plainview, Pierce County, Nebraska; except the West 12 feet thereof.

           

WHEREAS, Neb. Rev. Stat. § 17-503.01 provides that the sale of real property owned by the Village for less than $5,000.00 shall be exercised by resolution directing the sale of such property.

 

 

BE IT RESOLVED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA, AS FOLLOWS:

 

            Section 1. The City of Plainview hereby directs the sale of the City Real Estate, specifically to sell the same to John Steinkraus for $ 3,000.00.

 

            Section 2. The buyer under Section 1 shall receive a quitclaim deed and shall pay all recording costs, documentary stamp taxes, and any other fee to record the deed. Furthermore, the buyer shall assume all liabilities and encumbrances against the real estate, including delinquent taxes. The only encumbrance against the real estate that will be satisfied by the City shall be the judgment entered in Case No. CI13-51 in the District Court of Pierce County, Nebraska. All other encumbrances, claims, liens, and title defects shall be assumed by the buyer. 

 

Section 3. Notice of the proposed sale of property described above and the terms thereof shall be posted in three prominent places within the City for a period of not less than seven days prior to the sale of the property and said notice gave a general description of the property offered for sale and stated the terms and conditions of the sale.

 

Section 4.  That all resolutions or parts of resolutions in conflict be and are hereby repealed.

 

 

Council member Born seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Anderson, Born, Janovec, Sanne. Nay: None. Whereupon the Mayor declared said motion carried and Resolution #676 is passed and adopted.  

 

Council member Born introduced the following resolution and moved for its adoption:

 

RESOLUTION #677

 

A RESOLUTION TO AUTHORIZE THE SALE OF REAL ESTATE OWNED BY THE CITY OF PLAINVIEW LOCATED AT 105 S. MAPLE STREET IN PLAINVIEW TO JONES CONSTRUCTION GROUP

 

WHEREAS, the City of Plainview is the owner of real estate located at 105 S. Maple Street in Plainview and legally described as follows (hereinafter the “City Real Estate”):

Lot 18 and the South 10 feet of Lot 19, Block 9, Kimball and Blair’s Addition to Plainview, Pierce County, Nebraska.

 

WHEREAS, Neb. Rev. Stat. § 17-503.01 provides that the sale of real property owned by the Village for less than $5,000.00 shall be exercised by resolution directing the sale of such property.

Section 4.  Construction shall begin within one (1) year of the purchase of the property. Completion of project shall be within two (2) years after start of construction or deed for the property shall revert back to the City of Plainview.

 

Section 5.  That all resolutions or parts of resolutions in conflict be and are hereby repealed.

 

 

Council member Sanne seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Anderson, Born, Janovec, Sanne. Nay: None. Whereupon the Mayor declared said motion carried and Resolution #677 is passed and adopted.

 

Discussion was held on Special Designated Liquor license for Plainview Fire and Rescue for the Fireman’s Dance on August 4th from 6:00 PM-2:00 AM. The department would like to have the dance outside adjacent to Mary’s. Sanne moved to approve the SDL. Janovec seconded the motion. Motion carried 4-0.

 

Keno grant applications were received from 3 organizations.

 

The first was from the Klown Doll Museum for an HVAC system in the new addition. Born moved to approve the Keno grant for $3,660.00. Sanne seconded the motion. Motion carried 4-0.

 

The Social Center submitted an application for $2,500 for the construction of new handicap accessible ramp at the facility. Council would like the facility to make sure the ramp is ADA compliant once constructed. Janovec moved to approve the grant. Sanne seconded the motion. Motion carried 4-0.

 

The City of Plainview submitted an application for $14,000 for a hotel feasibility study from HVS. Sanne moved to approve the grant. Janovec seconded the motion. Motion carried 4-0.

 

Discussion was held on the approval of a hotel feasibility market study from HVS in the amount of $14,000. City Administrator Tarr and Economic Development director Susan Norris stated the study would be necessary for developers to move forward with a hotel in the community. Sanne moved to approve the hotel study. Born seconded the motion. Motion carried 4-0.

 

Janovec moved to approve Application and Certificate for Payment No. 1 Street Improvement Districts 2021-5, 2021-7 and 2021-9 in the amount of $436,923.13. Born seconded the motion. Motion carried 4-0.

 

Discussion was held on Ordinance #988 for an interlocal with the City of Norfolk for a Building Inspector. City Attorney Petersen had asked to table the Ordinance as he is waiting on information from Norfolk’s City Attorney. This will be on the August agenda.

 

Sanne moved to approve the payment to of $1,272.78 for the Vandelay judgment Case CI 13-51 for 112 S Elm Street. Born seconded the motion. Motion carried 4-0.

 

Sanne moved to approve the contract extension for 20-TFRH-35023 until November of 2023. Born seconded the motion. Motion carried 4-0.

 

Discussion was held on the next step in correcting the City’s nitrate levels in the drinking water system. Miller & Associates presented a plan for the installation of a new well south of Plainview. Janovec moved to approve the Water Implementation Plan Project 351-C1-002. Sanne seconded the motion. Motion carried 4-0.

 

Discussion on the FY 2023-2024 budget will be tabled until August. Budget workshops will also be held.

 

The swimming pool was drained and refilled in order to remove the insulation that had blown in from the elementary school roof during Monday’s storm. Council members thanked everyone who had helped with cleanup around the town.

 

Sanne moved to adjourn the meeting. Born seconded the motion. Motion carried 4-0
