REGULAR MEETING OF THE CITY COUNCIL
TUESDAY, SEPTEMBER 13, 2022
A meeting of the Mayor and Council of the City of Plainview, Nebraska, was held at the Council Chambers in said City on the 13th day of September at 6:30 o’clock P.M.
Roll call was held and present were: Mayor Schlote; Council Members: Alder, Yosten and Sanne Absent: Smith
The Pledge of Allegiance was then recited.
Mayor Schlote opened the meeting and announced to individuals in attendance that a full copy of the new Nebraska Open Meetings Act was posted on the east wall of the Council Chambers.
Notice of the meeting was given in advance thereof by Publication, a designated method for giving notice, as shown by the Affidavit of Publication attached to these minutes. Notice of this meeting was given to the Mayor and all Members of the Council and a copy of their acknowledgment of receipt of notice and the agenda is attached to the minutes. Availability of the agenda was communicated in the advance notice and in the notice to the Mayor and Council of this meeting. All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.
Jeremy Tarr was present as City Administrator
Courtney Retzlaff was present as City Clerk.
Bruce Curtiss was present as City Attorney.
Yosten moved to approve the regular meeting minutes from August 9th. Alder seconded the motion. Motion carried 3-0.
Sanne moved to approved claims and payroll. Alder seconded the motion. Motion carried 3-0.
No Manor report was given.
Police Chief Hallock presented the council with call dispatch logs that will be used going forward to keep the council updated on the activity of the department and reminded the council to keep any names listed confidential.
No Economic Development report was given.
City Administrator Tarr gave an update for the City Superintendent which included concrete work around town and that the pool leaks had been detected in the seams of the structure. Estimates to repair are around $40,000 for the seams with additional costs for pumps and filters. Tarr will publish request for bids for the repairs.
No City Attorney report was given.
Updated Ordinances on rules and regulations for nuisances were presented to the council for review. The notice procedure for nuisance abatements would now proceed through legal counsel and eliminate the use of the health board.
Motion was made by Sanne and seconded by Alder to approve Ordinance No. 981 on its first reading. Upon roll call vote, the following members voted AYE: Alder, Yosten and Sanne. The following voted NAY: None. Motion carried 3-0. Whereupon the Mayor declared said Ordinance No. 981 approved on its first reading.

AN ORDINANCE OF THE CITY OF PLAINVIEW, PIERCE COUNTY, NEBRASKA, TO AMEND CERTAIN ORDINANCES OF THE MUNICIPAL CODE TO REVISE AND PROVIDE FOR RULES AND REGULATIONS REGARDING NUISANCES; PROVIDING PENALTIES FOR VIOLATION OF THE REGULATIONS; REPEALING ALL ORDINANCES IN CONFLICT; TO ESTABLISH WHEN THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT; AND TO PROVIDE FOR PUBLICATION OF THIS ORDINANCE IN ACCORDANCE WITH STATE LAW.
- Section 1. The following Ordinance in Chapter 6, Article 3, of the Plainview Municipal Code is hereby amended, adopted and shall be incorporated to read and provide as follows:

ORDINANCE #983
AN ORDINANCE OF THE CITY OF PLAINVIEW, PIERCE COUNTY, NEBRASKA, TO AMEND CERTAIN ORDINANCES OF THE MUNICIPAL CODE TO REVISE AND PROVIDE FOR RULES AND REGULATIONS REGARDING NUISANCES; PROVIDING PENALTIES FOR VIOLATION OF THE REGULATIONS; REPEALING ALL ORDINANCES IN CONFLICT; TO ESTABLISH WHEN THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT; AND TO PROVIDE FOR PUBLICATION OF THIS ORDINANCE IN ACCORDANCE WITH STATE LAW.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA:
- Section 1. Ordinance §4-402 in Chapter 4, Article 4, of the Plainview Municipal Code is hereby repealed.
- Section 2. Any other ordinances in conflict with the terms hereof are hereby repealed.
- Section 3. This ordinance shall be in full force and effect on and after its passage, approval, and publication as provided by State Law.
Council member Sanne introduced the following resolution and moved for its adoption:
RESOLUTION #654
WHEREAS, the City of Plainview has reviewed and taken public and official comment on the replacement of stop signs and other traffic control requirements within the city; and
WHEREAS, the City has determined that adjustments in the placement of stop signs and other traffic control requirements will serve the best interests of the citizens of Plainview;
NOW THEREFORE BE IT RESOLVED, BY THE MAYOR AND COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA, THAT:
- That stop signs shall be Removed from their existing location, as follows:
West bound stop sign at Woodland and King
East bound stop sign at Woodland and King
West bound stop sign at King and Pilcher
North bound stop sign at West and Euclid
North bound stop sign at West and Lincoln
South bound stop sign at West and Lincoln
East bound stop sign at Woodland and Maple
West bound stop sign at Woodland and Pine
East bound stop sign at Woodland and Pine
South bound stop sign at West and Locust and Front
North bound stop sign at West and Locust and Front
- That traffic control signs shall be Placed in new locations as follows:
West bounds yield sign on Locust at West and Front
- That other traffic control requirements shall be created and posted as follows:
Parking only on West side of street on North Elm Street from Woodland to Lincoln
Parking only on South side of street on Harper from West to Main
Council member Yosten seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Alder, Yosten, Sanne. Nay: None. Whereupon the Mayor declared said motion carried and Resolution #654 is passed
and adopted.
City Clerk Retzlaff requested to open a new checking account at Midwest Bank for the NAHTF Grant funds. The account will be non-interest bearing and a formal Resolution will be passed at the October meeting. Sanne moved to open the account. Alder seconded the motion. Motion carried 2-0 with Yosten abstaining.
Police Chief Hallock introduced Andrew Funston who had applied for the full-time police officer position. Funston gave a brief overview about himself. Hallock stated that if hired Funston would begin employment on October 3. Sanne moved to approve the hire of Funston. Yosten seconded the motion. Motion carried 3-0.
Hallock recommended starting Funston at $18.50 per hour with an increase to $19.50 following completion of training. The next training will be held in January with Funston set to be certified by April of 2023. Sanne moved to approve the wage. Yosten seconded the motion. Motion carried 3-0.
City Administrator Tarr presented the proposed budgeted employee wages for fiscal year 2022-2023. Budgeted wages for full time employees are as follows: Deputy Clerk $39,250, Police Chief $54,080, City Superintendent $59,720, City Street Superintendent $56,263, City Clerk/Treasurer $52,422, City Maintenance $46,830, City Solid Waste $49,060, City Administrator $80,628, Library Director $37,502, Police Officer $38,480. Part time hourly wages are Children’s Librarian $15.50, Part-time Librarian $10.50, Economic Development Director $18.00, Handivan Driver $10.50. Sanne moved to approve the budgeted wages. Alder seconded the motion. Motion carried 2-1 with Yosten voting no.
The regular city council meeting in November is scheduled for the November 8th, which is also the date of the general election. Sanne moved to change the November meeting to November 7th at 6:30 PM. Yosten seconded the motion. Motion carried 3-0.
City Administrator Tarr gave an overview of the proposed budget for FY 2022-2023. A budget hearing will be held on September 20th at 7:30 PM at the library. A few key expenses budgeted for this coming year are flooring and HVAC at the City Office, GO Bonds for the library and street, paving projects, repairs to the pool and park sidewalks and updates to the ballfield bathrooms. The total budget for the City of Plainview is $8.2 million which also includes the Plainview Manor budget of $3.1 million. The levy for the City of Plainview will decrease from .66 in FY 2021-2022 to .61 in 2022-2023.
Police Chief Hallock reminded citizens that due to increased break-ins to remove keys and valuables from vehicles. The new dispatch system is working well.
