City Council Meeting April 12 2022

 

REGULAR MEETING OF THE CITY COUNCIL

TUESDAY, APRIL 12, 2022

 

A meeting of the Mayor and Council of the City of Plainview, Nebraska, was held at the Council Chambers in said City on the 12th day of April at 6:30 o’clock P.M. 

 

Roll call was held and present were: Mayor Schlote; Council Members: Smith, Yosten and Sanne Absent: Alder

 

The Pledge of Allegiance was then recited.

 

Mayor Schlote opened the meeting and announced to individuals in attendance that a full copy of the new Nebraska Open Meetings Act was posted on the east wall of the Council Chambers.

 

Notice of the meeting was given in advance thereof by Publication, a designated method for giving notice, as shown by the Affidavit of Publication attached to these minutes.  Notice of this meeting was given to the Mayor and all Members of the Council and a copy of their acknowledgment of receipt of notice and the agenda is attached to the minutes.  Availability of the agenda was communicated in the advance notice and in the notice to the Mayor and Council of this meeting.  All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.

 

Jeremy Tarr was present as City Administrator

Courtney Retzlaff was present as City Clerk.

Bruce Curtiss was present as City Attorney.

 

Sanne moved to approve the regular meeting minutes from March 8th and the special meeting minutes from March 17th. Yosten seconded the motion. Motion carried 3-0.

 

Sanne moved to approve claims and payroll. Smith seconded the motion. Motion carried 3-0.

 

No Manor report was given.

 

Police Officer Hallock presented on the monthly activities of the department.

 

Economic Development director Susan Norris gave updates on the requested additional funding for the NAHTF housing project, DTR projects are being completed and there is a developer that has expressed interest in building housing units in town. Norris also announced that the City of Plainview was selected as the 2022 Governor’s Showcase Community. Lt. Governor Foley will be in Plainview April 14th to present the award.

 

No City Superintendent report was given.

 

City Attorney Curtiss gave a brief update on the motion to dismiss filed by Mark Fitzgerald and stated that the court has taken no action.

 

Keystone Bar requested a Special Designated Liquor license on June 25, 2022 from 11:00 AM to 2:00 AM for a street dance and beer garden. Yosten moved to approve the license. Smith seconded the motion. Motion carried 3-0.

 

Mayor Schlote read the following proclamations for Public Transporation Week and Arbor Day.

 

Public Transportation Week Proclamation

 

WHEREAS: Nebraska Public Transportation week has been declared for April 17-23, 2022

 

AND WHEREAS: The date was chosen to honor the public transportation systems across Nebraska,

including the local system better known as the Plainview Handivan.

 

AND WHEREAS: Public transportation systems across the state of Nebraska are celebrating public transportation during this time frame.

 

AND WHEREAS: Every year thousands of Nebraska citizens are able to participate in using public transportation to help them remain independent.

 

AND WHEREAS: Plainview has continued to support the use of public transportation throughout the year.

 

AND WHEREAS: Plainview recognizes the hard work and dedication that the city staff and especially the drivers do to help make the Plainview Handivan service an integral part of the lives of many residents in the community.

 

NOW THEREFORE BE IT RESOLVED that by virtue of the authority invested in me as Mayor of the City of Plainview, Nebraska, I, Brian Schlote, do herby issue this proclamation to celebrate public transportation and I do hereby declare April 17-23, 2022 to be "Public Transportation Week".

 

 

Arbor Day Proclamation

 

WHEREAS in 1872, the Nebraska Board of Agriculture established a special day to be set aside for the planting of trees, and

 

WHEREAS this holiday, called Arbor Day, was first observed with the planting of more than a million trees in Nebraska, and

 

WHEREAS Arbor Day is now observed throughout the nation and the world, and

 

WHEREAS trees can be a solution to combating climate change by reducing the erosion of our precious topsoil by wind and water, cutting heating and cooling costs, moderating the temperature, cleaning the air, producing life-giving oxygen, and providing habitat for wildlife, and

 

WHEREAS trees are a renewable resource giving us paper, wood for our homes, fuel for our fires, and countless other wood products, and

 

WHEREAS trees in our city increase property values, enhance the economic vitality of business areas, and beautify our community, and

 

WHEREAS trees — wherever they are planted — are a source of joy and spiritual renewal.

 

NOW, THEREFORE, I, Brian Schlote ,Mayor of the City of Plainview, do hereby proclaim April 29, 2022 as ARBOR DAY in the City of Plainview, and I urge all citizens to celebrate Arbor Day and to support efforts to protect our trees and woodlands, and FURTHER, I urge all citizens to plant trees to gladden the heart and promote the well-being of this and future generations.

 

Recommendations for pool employees, wages and pool pass prices for 2022 were presented by the pool board.

 

The following were recommended for hire for the 2022 pool season: Allison Hardisty, manager; returning guards: Emma King, Teya Boyer and Roni Prewitt; new guards: Hannah Darnall, Ethan Rix, Brooke Rafert, Crobin Pfeil and Baili Prewitt. Smith moved to approve all hires as recommended. Sanne seconded the motion. Motion carried 3-0.

 

Recommended wages for pool employees were manager, $11.75 per hour, returning guards $10 per hour and new guards $9.50 per hour. Smith moved to approve the wages as recommended. Sanne seconded the motion. Motion carried.

 

Recommended pool pass prices for 2022 were the same as 2021. Family pass with over 4 members $125, family pass with up to 4 members $100, single pass $60. Daily pass prices are Jr. High through adult $3, K-6 $2, 5 and under free. Pool party price will be $75 per hour. Smith moved to approve the pool prices for 2022. Sanne seconded the motion. Motion carried 3-0.

 

Andrew Hallock was recommended as a seasonal park employee for 2022. Sanne moved to approve the hire. Yosten seconded the motion. Motion carried 3-0.

 

Recommended wage for Hallock was $9.50. Sanne moved to approve the wage. Yosten seconded the motion. Motion carried 3-0.

 

A request was presented to close Woodland Avenue from Main Street to King Street June 3-5, 2022 for the carnival to be held during Klown Days. Smith moved to approve the street closure. Sanne seconded the motion. Motion carried 3-0.

 

Two Keno grant requests were presented to the council.

 

The first was from the Plainview Historical Society for costs associated with installing electrical service to the Red Barn on the property. The group requested $1,000 to assist with the cost of this project. Sanne moved to approve the Keno Grant as presented. Smith seconded the motion. Motion carried 3-0.

 

The second request was from the Jr. Pirate Posse for funding of new playground equipment. The group asked for $5,000. It was stated that the school would be matching all funds that the Jr. Pirate Posse raised for the purchase and installation of the equipment. The project would be completed in May of 2023. Smith moved to approve the Keno Grant for $5,000. Yosten seconded the motion. Motion carried 3-0.

 

Motion was made by Sanne and seconded by Smith to approve Ordinance No. 978 on its first reading. Upon roll call vote, the following members voted AYE: Smith, Yosten and Sanne. The following voted NAY: None. Motion carried 3-0. Whereupon the Mayor declared said Ordinance No. 978 approved on its first reading.

 

Motion was made by Sanne and seconded by Smith to approve Ordinance No. 978 on its second and third readings. Upon roll call vote, the following members voted AYE:  Smith, Yosten and Sanne. The following voted NAY: None. Motion carried 3-0. Whereupon the Mayor declared said Ordinance No. 978 approved on its second and third reading.

 

ORDINANCE NO. 978

 

AN ORDINANCE TO VACATE PACIFIC AVENUE IN THE CITY OF PLAINVIEW

 

BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA:

 

Section 1. That:

 

  1. Vacating all of Pacific Avenue located between Pine Street and First Street, will contribute to economic development, is expedient for the public good, and in the best interests of the City;
  2. The city of Plainview will retain an easement for all utilities currently existing in said right-of-way, unless and until further agreements are made relative to the voluntary re-location of said utilities;
  3. That therefore Pacific Avenue, located between Pine Street and First Street in the City of Plainview, Pierce County, Nebraska, should be and hereby is vacated, retaining however the utility easement noted in this ordinance.

Section 2. Any other ordinance or section passed and approved prior to passage, approval and publication of this ordinance and in conflict with its provisions is repealed.

 

Section 3. This ordinance shall take effect and be in full force from and after its passage, approval, and publication as required by law.

 

Motion was made by Sanne and seconded by Smith to approve Ordinance No. 979 on its first reading. Upon roll call vote, the following members voted AYE: Smith, Yosten and Sanne. The following voted NAY: None. Motion carried 3-0. Whereupon the Mayor declared said Ordinance No. 979 approved on its first reading.

 

Motion was made by Sanne and seconded by Smith to approve Ordinance No. 979 on its second and third readings. Upon roll call vote, the following members voted AYE:  Smith, Yosten and Sanne. The following voted NAY: None. Motion carried 3-0. Whereupon the Mayor declared said Ordinance No. 979 approved on its second and third reading.

 

 

ORDINANCE NO. 979

 

AN ORDINANCE TO VACATE ALLEY IN THE CITY OF PLAINVIEW

 

BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA:

 

Section 1. That:

 

  1. Vacating the alley located between Lots 5-7 and Lots 8-13, in Block 13, Pacific Townsite Co. 1st Addition to the City of Plainview, Pierce County, Nebraska, will contribute to economic development, is expedient for the public good, and in the best interests of the City;

Discussion was held on possible increases to commercial and residential garbage rates. The recent rate increase by Bud’s Sanitary Service of $1.25 was suggested by City Administrator Tarr as a minimum to increase. Smith would like to wait and see how fuel prices change in the next few months and readdress at a later date. Smith motioned to table a rate increase. Yosten seconded the motion. Motion carried 2-1 with Sanne voting no.

 

At 7:00 PM Mayor Schlote opened the public hearing for the Community Comprehensive Plan.

 

Lowell Schroeder with Five Rule Planning gave an overview of all the information that is used to complete a comprehensive plan and why it is important for the City to have an updated plan. The plan is important in the enforcement of zoning regulations. Schroeder stated that the Planning Commission had recommended the plan for approval during a public hearing held on April 4th.

 

Yosten moved to close the public hearing at 7:03 PM. Smith seconded the motion. Motion carried 3-0.

 

Council member Smith introduced the following resolution and moved for its adoption:

 

RESOLUTION #650

 

WHEREAS, the duly appointed planning commission of the City of Plainview, Nebraska, with the assistance of its consultant, Five Rule Rural Planning of Kearney, Nebraska, has prepared a comprehensive plan for the City of Plainview, Nebraska; and

 

WHEREAS, the planning commission has given public notice as required by the Nebraska State Statutes, of a hearing to be held on the 4th day of April, 2022 at 7:00 PM in the Plainview Public Library on the proposed comprehensive plan; and

 

WHEREAS, the public hearing has been held pursuant to said notice and all statements received at the hearing have been duly considered by the planning commission;

 

BE IT NOW AND THE SAME IS HEREBY RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF PLAINVIEW, NEBRASKA, THAT

 

  1. The comprehensive plan a prepared by the planning commission and Five Rule Planning of Kearney, Nebraska be adopted by the commission as the official comprehensive plan for the City of Plainview, Nebraska.
  2. The comprehensive plan be recommended to the city council for their approval and adoption as the official comprehensive plan for the City of Plainview, Nebraska.

BE IT NOW AND THE SAME IS HEREBY RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA, THAT

 

  1. The comprehensive plan recommended by the planning commission is adopted as the official comprehensive plan for the City of Plainview, Nebraska.

Council member Yosten seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Smith, Yosten and Sanne. Nay: None. Whereupon the Mayor declared said motion carried and Resolution #650 is passed

and adopted

 

Discussion was held on creating an interlocal agreement with Pierce County that would transfer all non-emergency calls for the City to Pierce County dispatch. If an agreement was made, the new protocols would go into effect July 1, 2022. Council agreed to move forward with the process.

 

Discussion was held on requests from Plainview Public Schools to close Lincoln Avenue for school activities on the following dates and times:

5/12 - 8:00 a.m. - 7:00 p.m. (District Track)

8/29 - 5:00 p.m. - 8:00 p.m. (JV Football)

9/2 - 5:00 p.m. - 10:00 p.m. (Varsity Football)

9/12 - 3:00 p.m. - 8:00 p.m. (JH/JV Football)

9/23 - 5:00 p.m. - 10:00 p.m. (Varsity Football)

9/26 - 3:00 p.m. - 8:00 p.m. (JH/JV Football)

9/30 - 5:00 p.m. - 10:00 p.m. (Varsity Football)

Sanne moved to approve the street closures as presented. Yosten seconded the motion. Motion carried 3-0.

 

Discussion was held on properties recommended by the health board to be deemed as nuisance properties.

 

The first property is at 107 W Locust Avenue, Plainview Pacific Townsite Co 1st Add Blk 1 Lots 16-17-18. The property has been on the nuisance list previously and was cleaned up, however it is in need of additional cleanup. Sanne moved to deem the property as a nuisance. Smith seconded the motion. Motion carried 3-0.

 

The second property is at 212 N Plum Street, 32 28 4 Plainview Weber’s add E1-2 N1-2 Lot 6 & E1-2 Lot 7. The property has been on the nuisance list previously. The board noted that the property has not been cleaned up properly. Sanne moved to deem the property as a nuisance. Smith seconded the motion. Motion carried 3-0.

 

Discussion was held on the possible purchase of street sweeper for the City as the current sweeper no longer operates as it should. The current sweeper is a 1994 Johnston and has been operated by the City for over 15 years. Johnston and Curt Hart traveled to Sioux City to look at a 2016 Global M3 that could be purchased for $50,000. They were able to test drive the machine while there and said that it works as it should. City Administrator Tarr stated that while this was not budgeted, it is rare to find a machine in this good of condition for that price. The equipment would be financed through a loan. Smith moved to approve the purchase of the street sweeper as presented. Yosten seconded the motion. Motion carried 3-0.

 

Smith moved to adjourn the meeting. Yosten seconded the motion. Motion carried 3-0.
