City Council Meeting March 8 2022

 

REGULAR MEETING OF THE CITY COUNCIL

TUESDAY, MARCH 8, 2022

 

A meeting of the Mayor and Council of the City of Plainview, Nebraska, was held at the Council Chambers in said City on the 8th day of March at 6:30 o’clock P.M. 

 

Roll call was held and present were: Mayor Schlote; Council Members: Alder, Smith, Yosten and Sanne Absent: None.

 

The Pledge of Allegiance was then recited.

 

Mayor Schlote opened the meeting and announced to individuals in attendance that a full copy of the new Nebraska Open Meetings Act was posted on the east wall of the Council Chambers.

 

Notice of the meeting was given in advance thereof by Publication, a designated method for giving notice, as shown by the Affidavit of Publication attached to these minutes.  Notice of this meeting was given to the Mayor and all Members of the Council and a copy of their acknowledgment of receipt of notice and the agenda is attached to the minutes.  Availability of the agenda was communicated in the advance notice and in the notice to the Mayor and Council of this meeting.  All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.

 

Jeremy Tarr was present as City Administrator

Courtney Retzlaff was present as City Clerk.

Bruce Curtiss was present as City Attorney.

 

Sanne moved to approve the minutes from the regular meeting on February 8th and the special meeting on February 24th. Alder seconded the motion. Motion carried 4-0.

 

Alder moved to approve claims and payroll. Smith seconded the motion. Motion carried 4-0.

 

Mayor Schlote reported that there are no COVID cases at the Manor.

 

Police Chief Neumann reported that cases of thefts are increasing and the department will be taking Taser training in April.

 

City Administrator Tarr reported that the muffin monster at the liftstation had been replaced and the guys are repairing curb stops and water leaks around town.

 

Dennis Johnson of Bush & Roe gave the insurance updates for 2022 premiums. The overall blanket policy for the City increased $846,000 since last year and deductible amounts are up which lowers the overall premium. In total the City carries $5 million in liability coverage.

 

Kyle Overturf of AMGL in Grand Island presented the FY 2021 Audit. Overturf stated that an unmodified opinion, the highest level available, was given by AMGL. A few key items that were discussed were that the City had no new long term debt during the year, a positive net position in governmental activities and an increase in valuation. Overturf went over benchmarking figures and overall the City of Plainview shows a $20,000 deficit per person on valuation. Going forward, Overturf suggested reallocation of expenses to help alleviate the general budget and to aim for $600,000 in reserves.

 

At 7:15 PM Mayor Schlote opened the public hearing for the Application for a Class B Liquor License for Family Dollar, Inc.

 

Sanne moved to close the public hearing at 7:16 PM. Smith seconded the motion. Motion carried 4-0.

 

Sanne moved to approve the Class B Liquor License Application for Family Dollar, Inc. Smith seconded the motion. Roll call vote Aye: Smith, Sanne, Schlote; Nay: Yosten, Alder. Motion carried 3-2.

 

Susan Norris presented Economic Development updates on the housing project, DTR Grant and nomination for the Governor’s Showcase Award for the City of Plainview.

 

Sealed bids were submitted for haying of the 9 acres more or less by the new lagoons. The first bid opened was from Tim Johnston for $595. The second bid was from Trent Tarr for $720. Smith moved to approve the bid from Tarr for $720. Alder seconded the motion. Motion carried 4-0.

 

Council member Sanne introduced the following resolution and moved for its adoption:

 

 

RESOLUTION #649        

 

 

WHEREAS, the City of Plainview, Nebraska, has determined that they are in need of a new semi-trailer and backhoe;

 

NOW THEREFORE BE IT RESOLVED, BY THE MAYOR AND COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA, THAT:

 

  1. The City of Plainview hereby authorizes the borrowing of $140,000.00, from Madison County Bank, at municipal rates, to be used for the purchase of a 2009 Semi, and a 2022 Backhoe, as such purchases were previously authorized by the City;
  2. Loan of $140,000.00 shall be amortized over 20 quarterly payments, with an interest rate of 2.5% per annum;
  3. A copy of this resolution shall be taken and accepted as evidence of the authority of City personnel to obtain such financing and complete the purchases.

 

Council member Smith seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Alder, Smith, Yosten and Sanne. Nay: None. Whereupon the Mayor declared said motion carried and Resolution #649 is passed

and adopted

 

City Attorney Curtiss stated he had spoken with Luke Henderson and that the process for nuisance properties will be simplified and is currently in the City code book.

           

Motion was made by Smith and seconded by Alder to approve Ordinance No. 976 on its first reading. Upon roll call vote, the following members voted AYE: Alder, Smith, Yosten and Sanne. The following voted NAY: None. Motion carried 4-0. Whereupon the Mayor declared said Ordinance No. 976 approved on its first reading.

 

Motion was made by Smith and seconded by Alder to approve Ordinance No. 976 on its second and third readings. Upon roll call vote, the following members voted AYE:  Alder, Smith, Yosten and Sanne. The following voted NAY: None. Motion carried 4-0. Whereupon the Mayor declared said Ordinance No. 976 approved on its second and third reading.

 

ORDINANCE NO. 976

 

AN ORDINANCE ADOPTING A SUPPLEMENT TO THE CODE OF ORDINANCES FOR THE CITY OF PLAINVIEW, NEBRASKA ADOPTING THE STATE LAW CHANGES MADE BY THE LEGISLATURE WHICH ARE SPECIFIC AND MANDATORY AND NECESSARY TO BRING THE CITY ORDINANCES AND CODE SECTIONS INTO CONFORMITY WITH STATE LAW AND AMENDING RESTATING, REVISING, UPDATING, CODIFYING AND COMPILING CERTAIN ORDINANCES OF THE CITY DEALING WITH THE SUBJECTS EMBRACED IN THE CODE OF ORDINANCES, AND PROVIDING PENALTIES FOR THE VIOLATION OF THE CODE OF ORDINANCES.

 

Discussion was held on Special Designated Liquor License requests for various organizations during the Klown Festival and Car Show.

 

Plainview Fire and Rescue submitted an application for June 1, 2022 from 4:00 PM-12:00 AM for a Horseshoe Tournament in Chilver’s Park. Sanne moved to approve the license. Smith seconded the motion. Motion carried 3-1 with Yosten voting no.

 

Plainview Chamber of Commerce submitted an application for June 3, 2022 from 5:00 PM to 2:00 AM for a Cornhole Tournament and DJ at the Bandshell. Sanne moved to approve the license. Alder seconded the motion. Motion carried 4-0.

 

Plainview Chamber of Commerce submitted an application for June 4, 2022 from 8:00 AM to 5:00 PM for a Sand Volleyball Tournament to be held at the Bandshell Park. Sanne moved to approve the license. Alder seconded the motion. Motion carried 4-0.

 

Keystone and 13/20 both submitted applications for June 4, 2022 from 8:00 PM to 2:00 AM for the Plainview Chamber of Commerce Street Dance. The dance will be held on Locust Avenue between Main and Maple Streets. Sanne moved to approve both licenses. Smith seconded the motion. Motion carried 4-0.

 

13/20 submitted an application for June 11, 2022 from 6:00 AM to 9:00 AM for a beer garden on Main Street. Sanne moved to approve the application. Alder seconded the motion. Motion carried 4-0.

 

Keystone submitted an application for June 11, 2022 from 9:00 AM to 5:00 PM for the Highway20 Car Show. The license will cover all areas that the car show had previously requested for closure. Sanne moved to approve the license. Alder seconded the motion. Motion carried 4-0.

 

Motion was made by Sanne to allow fireworks on June 4, 2022 for Klown Days. Alder seconded the motion. Motion carried 4-0.

 

A request from Plainview Public Schools to close Lincoln Avenue between the ballfields was submitted for the following dates and times: March 22, 2022 2:30 PM to 7:00 PM; April 1, 2022 8:30 AM to 7:00 PM and April 7, 2022 2:30 to 7:00 PM for track meets. Sanne moved to approve the street closures. Yosten seconded the motion. Motion carried 4-0.

 

A request from Hansen Auction Service for closure of Locust Avenue between Main and Maple Streets on March 26, 2022 from 7:00 AM to 5:00 PM for Bob and Carolyn Smith’s Auction was submitted. Sanne moved to approve the closure. Alder seconded the motion. Motion carried 4-0.

 

City Administrator Tarr presented the 2021 ACE Member Distribution funds in the amount of $4,369.00 and asked that the money be earmarked for the purchase of a new HandiVan.

 

City Clerk Retzlaff stated that the May 10, 2022 meeting will be the same day as the primary elections and the library will not be available. Smith moved to change the May regular meeting to May 12, 2022 at 6:30 PM at the library. Sanne seconded the motion. Motion carried 4-0.

 

It was moved by Smith, seconded by Alder to adjourn the meeting. Motion carried 4-0.
