REGULAR MEETING OF THE CITY COUNCIL
TUESDAY, FEBRUARY 8, 2022
A meeting of the Mayor and Council of the City of Plainview, Nebraska, was held at the Council Chambers in said City on the 8th day of February at 6:30 o’clock P.M.
Roll call was held and present were: Mayor Schlote; Council Members: Alder, Smith, Yosten and Sanne Absent: None.
The Pledge of Allegiance was then recited.
Mayor Schlote opened the meeting and announced to individuals in attendance that a full copy of the new Nebraska Open Meetings Act was posted on the east wall of the Council Chambers.
Notice of the meeting was given in advance thereof by Publication, a designated method for giving notice, as shown by the Affidavit of Publication attached to these minutes. Notice of this meeting was given to the Mayor and all Members of the Council and a copy of their acknowledgment of receipt of notice and the agenda is attached to the minutes. Availability of the agenda was communicated in the advance notice and in the notice to the Mayor and Council of this meeting. All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.
Jeremy Tarr was present as City Administrator
Courtney Retzlaff was present as City Clerk.
Bruce Curtiss was present as City Attorney.
Smith moved to approve the minutes from the regular meeting on January 11th. Yosten seconded the motion. Motion carried 4-0.
Alder moved to approve claims and payroll. Smith seconded the motion. Motion carried 4-0.
No Manor report was given.
Police Chief Neumann reported on the activity of the department in January. Neumann discussed raising fines for parking violations. City Attorney Curtiss presented an Ordinance that would increase the fine to $25 from $8.
Motion was made by Smith and seconded by Alder to approve Ordinance No. 977 on its first reading. Upon roll call vote, the following members voted AYE: Alder, Smith, Yosten and Sanne. The following voted NAY: None. Motion carried 4-0. Whereupon the Mayor declared said Ordinance No. 977 approved on its first reading.
Motion was made by Smith and seconded by Alder to approve Ordinance No. 977 on its second and third readings. Upon roll call vote, the following members voted AYE: Alder, Smith, Yosten and Sanne. The following voted NAY: None. Motion carried 4-0. Whereupon the Mayor declared said Ordinance No. 977 approved on its second and third reading.
ORDINANCE NO. 977
AN ORDINANCE TO THE CITY OF PLAINVIEW, NEBRASKA
NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA:
Section 1. That Chapter 5, Section 617 of the Municipal Code of Plainview, Nebraska, be amended/added to read as follows:
- 5-617 PARKING; BUREAU OF VIOLATIONS.
In the event that a traffic citation is issued for any parking violation, in lieu of filing of charges in the County Court, the City Police shall designate on the citation the fine and cutoff date for settlement, and turn the citation over to the office of the City Clerk. If the fine is paid, according to the requirements set out in the citation, no further action shall be taken. If the fine is not paid within the time set out in the citation, then the citation shall be forwarded to the City Attorney for filing in the Pierce County Court. For purposes of this section, the fines shall be as follows:
$25.00 for the offense.
For purposes of this section, the cutoff date for the payment of said fine, and the avoidance of formal proceedings, shall be seven (7) days from the date the citation was issued. If the driver of the vehicle cannot be determined, the citation shall be issued to the registered owner of the vehicle, who shall be held responsible for the parking violation. (Ref. 18-1729 RS Neb.) Section 2. That any ordinance passed and approved prior to the passage, approval, and publication or posting of this ordinance and in conflict with its provisions, is hereby repealed.
Section 3. This ordinance shall take effect and be in full force from and after its passage, approval, and publication or posting as required by law.
Officer Hallock reported that she had written a grant last fall to receive funding from Region 11 for Tasers for the department. Hallock received funding for one Taser and the City had budgeted for another. The equipment was ordered and was received this week.
Susan Norris presented the Economic Development report which included updates on fund raising for the Plainview Brunswick Community Foundation, DTR Grant updates and grant opportunities for park improvements through the LENRD.
City Administrator Tarr gave the City Superintendent update reporting that maintenance had been cleaning sewers and the grinder at the lift station will need to be replaced at a cost of approximately $18,000.
City Attorney Curtiss reported on updates to nuisance prosecutions and he will contact the County Attorney on tax foreclosures for properties in town.
Phyllis Cleveland was recommended to replace Lois Patras on the HandiVan Board with term ending June 2024. Sanne moved to approve the appointment. Alder seconded the motion. Motion carried 4-0.
Motion was made by Smith and seconded by Alder to approve Ordinance No. 975 on its first reading. Upon roll call vote, the following members voted AYE: Alder, Smith, Yosten and Sanne. The following voted NAY: None. Motion carried 4-0. Whereupon the Mayor declared said Ordinance No. 975 approved on its first reading.

ORDINANCE NO. 975
AN ORDINANCE CREATING STREET IMPROVEMENT PROJECT NO. 2022-1; DEFINING THE BOUNDARIES AND LIMITS THEREOF; PROVIDING FOR PAVING, GRADING, CURBING, GUTTERING, AND OTHER NECESSARY AND INCIDENTAL WORK; PROVIDING FOR ASSESSMENT OF THE COSTS OF SUCH IMPROVEMENTS AGAINST THE PROPERTY SPECIALLY BENEFITED THEREBY AND THE LEVY OF GENERAL TAXES; PROVIDING FOR THE PUBLICATION OF THIS ORDINANCE IN PAMPHLET FORM
Sanne moved to request bids for Lincoln Avenue Paving Project No. 2022-1. Alder seconded the motion. Motion carried 4-0.
Sanne moved to advertise to accept bids for haying of the lagoons. Alder seconded the motion. Motion carried 4-0.
Sanne moved to approve payment of 19-PP-011 Drawdown #6 for $525.00. Yosten seconded the motion. Motion carried 4-0.
Sanne moved to approve payment of CDS Inspections & Beyond invoice Reuse 51 in the amount of $175.00. Alder seconded the motion. Motion carried 4-0.
City Administrator Tarr presented 2 bids for a new backhoe for the transfer station. The first bid was from Titan Machinery for a Case 580N EP Loader Backhoe in the amount of $89,702. The second bid was from Murphy Tractor & Equipment for a John Deere 310L EP Backhoe Loader in the amount of $98,700. Sanne moved to approve the purchase of the Case Backhoe. Smith seconded the motion. Motion carried 4-0.
Special Designated Liquor License applications were presented for Fish Frys at St. Paul’s Catholic Church for the following dates and times: March 11, 2022 alternate date of March 18th, March 25th alternate date of April 1st, and April 8th alternate date of April 15th all with times of 4:00 PM to midnight. Sanne moved to approve the SDL’s. Smith seconded the motion. Motion carried 4-0.
Dr. Jim Thor was present to request street closures for the upcoming Highway20HotRod Show in downtown Plainview on June 11, 2022. The event will require the streets to be closed from 6:30 AM until 5:00 PM and a map was presented for the council to review. Sanne moved to approve the street closures. Alder seconded the motion. Motion carried 4-0.
Randy Dee was present to request an SDL for 13/20 for an outside movie event on Main Street June 10, 2022 from 3:00 PM to 2:00 AM. Alder moved to approve the SDL. Smith seconded the motion. Motion carried 4-0.
13/20 also requested an SDL for June 11, 2022 during the Car Show. Concerns were made on the location being the same as the FFA Vendor Show. Council asked to table the request until the March meeting.
Sherry Ristow was present to request an SDL for Keystone Bar for a Beer Garden on Maple Street June 10, 2022 from 5:00 PM to 2:00 AM. Sanne moved to approve the SDL. Yosten seconded the motion. Motion carried 4-0.
Keystone also requested an SDL for June 11, 2022 for the Car Show 9:00 AM to 5:00 PM. Concerns on having 2 SDL’s for the same event and the locations requested were addressed. Council asked to table the request until the March meeting.
City Attorney Curtiss reviewed the Model League Ordinances. A final draft of Ordinance No. 976 will be reviewed at the March council meeting.
It was moved by Smith, seconded by Sanne to adjourn the meeting. Motion carried 4-0.
