REGULAR MEETING OF THE CITY COUNCIL
TUESDAY, OCTOBER 12, 2021
A meeting of the Mayor and Council of the City of Plainview, Nebraska, was held at the Council Chambers in said City on the 12th day of October at 6:30 o’clock P.M.
Roll call was held and present were: Mayor Schlote; Council Members: Alder, Smith and Sanne Absent: Yosten
The Pledge of Allegiance was then recited.
Mayor Schlote opened the meeting and announced to individuals in attendance that a full copy of the new Nebraska Open Meetings Act was posted on the east wall of the Council Chambers.
Notice of the meeting was given in advance thereof by Publication, a designated method for giving notice, as shown by the Affidavit of Publication attached to these minutes. Notice of this meeting was given to the Mayor and all Members of the Council and a copy of their acknowledgment of receipt of notice and the agenda is attached to the minutes. Availability of the agenda was communicated in the advance notice and in the notice to the Mayor and Council of this meeting. All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.
Jeremy Tarr was present as City Administrator
Courtney Retzlaff was present as City Clerk.
Bruce Curtiss was present as City Attorney.
Sanne moved to approve the special meeting minutes from September 13th and the regular meeting minutes from September 14th. Smith seconded the motion. Motion carried 3-0.
Sanne moved to approve claims and payroll. Alder seconded the motion. Motion carried 3-0.
No Manor report was given
Police Chief Neumann reported on September calls and that the E-Citation equipment had been installed in all 3 vehicles.
Economic Development Director Susan Norris provided updates on the 4-plex housing project and the DTR Grant funding.
No City Superintendent report was given.
City Attorney Curtiss provided updates on nuisance properties that had received citations.
Mayor Schlote appointed Shelly Sellin to the Zoning Board to replace Ryan Ober through the remainder of the term June 30, 2024. Smith moved to approve the appointment. Alder seconded the motion. Motion carried 2-1 with Sanne voting nay.
One Keno Grant was submitted from the Klown Doll Museum for costs associated with their upcoming expansion project. Corrine Janovec was present to answer questions about the project. Sanne moved to approve a Keno Grant in the amount of $2,500 to the Klown Doll Museum. Smith seconded the motion. Motion carried 3-0.
Part-time police officer Kristy Hallock was offered a full-time position with the City to replace Jordan Dietz who did not complete basic training. Alder moved to approve the hire of Hallock. Smith seconded the motion. Motion carried 3-0.
Discussion was held on wages for Hallock and City Administrator Tarr proposed a rate of $21 per hour or $43,680 annually plus full benefits. Sanne moved to approve the wage for Hallock. Alder seconded the motion. Motion carried 3-0.
Sanne moved to approve 20-DTR-005 Drawdown #5 in the amount of $5085 for administrative services with NENEDD. Alder seconded the motion. Motion carried 3-0.
Zoning board recommendations for building permits were discussed.
Discussion was held on a permit submitted for a garage at 53555 865 Ave which is within the one mile jurisdiction of the City of Plainview. Sanne moved to approve the permit as presented. Smith seconded the motion. Motion carried 3-0.
The permit submitted for a fence at 406 N Elm, 33 28 4 Plainview Phillips 1st Add Blk 1 E1-2 Lot 4 was tabled until the lot lines can be found by the property owner.
Discussion was held on a permit submitted for the relocation of a shed at 301 W Woodland Ave, Plainview Chilvers 6th Add All Blk 10. The property is zoned R-2 and the structure meets all zoning requirements. Sanne moved to approve the permit. Alder seconded the motion. Motion carried 3-0.
Discussion was held on a permit submitted for a house addition at 302 N Plum, Plainview Linwood Add Blk 5 Lots 3-10. The property is zoned R-2 and the structure meets all property requirements. Smith moved to approve the building permit. Alder seconded the motion. Motion carried 3-0.
Discussion was held on zoning regulations at 205 N 7th Street relating to use of an RV for a permanent residence. City Attorney Curtiss will send a letter to the owners.
At 7:00 PM Mayor Schlote opened the public hearing for the One and Six Year Street Plan.
Gary Steele of Miller and Associates was present to discuss the purpose of the One and Six Year Street Plan which is required by State Statute in order for the City of Plainview to receive Highway Allocation funding each year. The City is projected to receive $184,549 in Highway Allocation in the coming fiscal year.
At 7:27 PM Sanne moved to close the public hearing. Alder seconded the motion. Motion carried 3-0.
Discussion was held on Ordinance No. 969 to create Street Improvement Projects 2021-1 through 2021-9. Passing of the ordinance is necessary to start the process of obtaining bids, notification to all property owners that are adjacent to the projects and discussion on possible assessment amounts.
Motion was made by Smith and seconded by Alder to approve Ordinance No. 969 on its first reading. Upon roll call vote, the following members voted AYE: Alder and Smith. The following voted NAY: Sanne. Motion carried 2-1. Whereupon the Mayor declared said Ordinance No. 969 approved on its first reading.
A second reading of Ordinance No. 969 will be held at the next meeting of the council.
Council member Sanne introduced the following resolution and moved for its adoption:
RESOLUTION #642
WHEREAS, the City of Plainview, Nebraska wishes to consider the sale of certain real estate, to-wit:
Parcel 1: Lots Thirty-one (31) and Thirty-two (32), of Block Twelve (12), Pacific Townsite Company’s Addition to the City of Plainview, Pierce County, Nebraska
Parcel 2: Lot Twelve (12), Block Six (6), Peed’s 2nd Addition, to the City of Plainview, Pierce County, Nebraska
AND WHEREAS, Public Auction has been determined to be the best format for such sale
NOW THEREFORE BE IT RESOLVED, BY THE MAYOR AND COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA, THAT:
- The above properties shall be offered for sale at public auction, with a minimum price of $500.00 as a starting bid on each Parcel;
- That notice of such sale, and the date of the sale, shall be published for three consecutive weeks, such notice giving all necessary details;
- That at least 30 days after the third publication, the property shall then be sold at public auction, subject only to the minimum price noted;
- That following the auction, if the minimum is met or exceeded, the sale shall be confirmed by Ordinance of the City Council.
Council member Alder seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Alder, Smith, and Sanne. Nay: None. Whereupon the Mayor declared said motion carried and Resolution #642 is passed
and adopted.
Council member Sanne introduced the following resolution and moved for its adoption:

WHEREAS, the City of Plainview, Nebraska owns and is in possession of certain property that is not needed for City purposes, List of property, to-wit:
- 1990 Chevrolet ¾ ton pickup VIN# 1GCFC24Z4LZ153308
- 2005 Chevrolet Cavalier VIN# 1G1JC52F357192502
- 2005 Ford F550 XLT Boom Truck VIN# 1FDAF57F91ED79767
- 1996 Chevrolet ½ ton pickup VIN# 1GCEK14M8TZ190214
- 4,000 Gallon Fuel Tank
- Model 8 Serial No. 00126084051 snow plow
WHEREAS the City of Plainview, Nebraska has determined that sale of said property is in the City's best interest;
NOW THEREFORE BE IT RESOLVED, BY THE MAYOR AND COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA, THAT:
- The property listed above shall be offered to the public for sale, with no minimums;
- Sale format shall be by public auction, by internet site listing if possible;
- Notice of this sale, the sale format, and above details, shall be published at least one time, seven (7) days before commencement of the sale;
- Date of sale, or commencement and duration of sale, as well as sale to the high bidder, may be confirmed by the City Administrator, with no further action by the City Council being necessary.
Council member Smith seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Alder, Smith and Sanne. Nay: None. Whereupon the Mayor declared said motion carried and Resolution #643 is passed
and adopted.
At 7:54 PM, Sanne moved to go into executive session to discuss Small Box Store Ordinance and Litigation issues. Alder seconded the motion. Motion carried 3-0.
At 8:32 PM Smith moved to come out of executive session. Alder seconded the motion. Motion carried 3-0.
It was moved by Smith, seconded by Alder to adjourn the meeting. Motion carried 3-0.
