REGULAR MEETING OF THE CITY COUNCIL
TUESDAY JULY 13, 2021
A meeting of the Mayor and Council of the City of Plainview, Nebraska, was held at the Council Chambers in said City on the 13th day of July at 6:30 o’clock P.M.
Roll call was held and present were: Mayor Schlote; Council Members: Alder, Smith, Yosten and Sanne Absent: None
The Pledge of Allegiance was then recited.
Mayor Schlote opened the meeting and announced to individuals in attendance that a full copy of the new Nebraska Open Meetings Act was posted on the east wall of the Council Chambers.
Notice of the meeting was given in advance thereof by Publication, a designated method for giving notice, as shown by the Affidavit of Publication attached to these minutes. Notice of this meeting was given to the Mayor and all Members of the Council and a copy of their acknowledgment of receipt of notice and the agenda is attached to the minutes. Availability of the agenda was communicated in the advance notice and in the notice to the Mayor and Council of this meeting. All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.
Jeremy Tarr was present as City Administrator
Courtney Retzlaff was present as City Clerk.
Bruce Curtiss was present as City Attorney.
Sanne moved to approve the regular meeting minutes from June 8th and special meeting on June 14th. Smith seconded the motion. Motion carried 4-0.
Smith moved to approve claims and payroll. Alder seconded the motion. Motion carried 4-0.
Manor Administrator Juleen Johnson was present and updated on staffing shortages, COVID protocols and the July 5th Celebration.
No police department report was given.
Economic Development Director Susan Norris updated on the 4-plex housing project, DTR applications have passed Tier 1 Environmental Review and now are moving on to Tier II and projects that PCED interns are working on this summer in Plainview. Upgrades to the tennis courts will be made with funding coming from the Plainview Brunswick Community Fund.
City Superintendent Curt Hart reported on the valve repair in the Bandshell and upcoming projects for the maintenance department including fire hydrant replacements and installation of underground sprinklers at the football fields.
City Attorney Curtiss handed out a summary of nuisance properties that have gone through the citation process. Curtiss will be working on the release of a lien from the City to allow a lot split on West Street.
At 6:45 PM Mayor Schlote opened the public hearing for nuisance properties.
The property owned by Roger & Lucy Christiansen is at 205 N 7th Street, Plainview Peed’s 2nd Add Blk 10 Lots 9&10. There are appliances, garbage and miscellaneous junk around the property that need to be disposed of properly. Council stated that the backyard was still in need of cleanup. Concerns were raised by a neighbor, Paula Hoffman, on the living conditions in place on the property. Further discussion will be tabled until next month with possible passage of a Resolution.
The property at 103 N Pine Street, Plainview Chilvers 6th Add Blk 9 Lot 11 has trash bags on the front porch and miscellaneous junk in the rear of the property. Mary Ann Dean, owner, was present and stated the renters will be evicted if cleanup is not completed. Further discussion will be tabled until next month.
The property at 107 N Pine Street, Plainview Chilvers 6th Add Blk 9 Lot 9 contains miscellaneous junk in the backyard that needs to be disposed of properly. Cleanup has been completed and it is no longer considered a nuisance.
The property at 104 N Main Street, Plainview Chilvers 1st Add Blk 2 Lot 2 & 8’ Lot 3 has an inoperable vehicle in the front of the property and miscellaneous junk in the front and rear of the property. The vehicle had been moved to the back but more cleanup was needed. Sanne moved to create a Resolution for next month. Smith seconded the motion. Motion carried 4-0.
Sanne made a motion to close the public hearing at 7:01 PM. Alder seconded the motion. Motion carried 4-0.
Council member Sanne introduced the following resolution and moved for its adoption:

WHEREAS the City of Plainview has communicated with certain property owners within the City regarding potential Nuisances on their property, as determined by the Board of Health; and
WHEREAS various Owners, having been notified according to law, have requested a hearing before the City Council to protest or review those determinations; and
WHEREAS the City Council has set and conducted such hearing on the property owned

NOW THEREFOR BE IT RESOLVED, BY THE MAYOR AND COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA, as follows:
- That the property described above does contain, and is hereby Determined to constitute a Public Nuisance according to City Code;
- That the Owner of said property is hereby Ordered to remedy said public nuisance by taking the following actions: All door entrances need to be replaced and/or boarded up. All windows need to be replaced and/or boarded up. Miscellaneous debris and overgrown vegetation needs to be removed.
- That said actions shall be completed within the following time frame: Before July 14, 2021.
That if said actions are not completed as required above, further action shall be taken as follows: Prosecution will be undertaken.
Council member Alder seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Alder, Smith, Yosten and Sanne. Nay: None. Whereupon the Mayor declared said motion carried and Resolution #632 is passed
and adopted.
Council member Smith introduced the following resolution and moved for its adoption:

Several properties that were discussed in June and sent notice of nuisance were discussed.
The first property at 105 S King Street, Plainview Pioneer Townsite Co Add Blk 10 Lot 10. The property contains miscellaneous junk and debris that has not been cleaned up. A Resolution will be presented at the August meeting for the property.
The property at the corner of Pond Street and Pilcher Avenue, Plainview Gould’s Add Blk 2 Lots 13-14-15 contains a building that has broken windows making it unsecure. All windows have been boarded up. Smith moved to remove the property off the nuisance list. Alder seconded the motion. Motion carried 4-0.
The property at 101 W Congress, Plainview Pacific Townsite Co 1st Add Blk 12 Lots 20-21-22 had an unlicensed vehicle and needed general cleanup. Adequate cleanup had not occurred. Alder moved to set a public hearing. Smith seconded the motion. Motion carried 4-0.
The property at 106 W Locust, Plainview Pacific Townsite Co 1st Add Blk 12 Lots 4-7 for unlicensed vehicles and general cleanup. Adequate cleanup had not occurred. Alder moved to set a public hearing. Smith seconded the motion. Motion carried 4-0
Discussion on the property at 104 S Elm Street, Plainview O.T. Blk 3 E1-2 Lot 2 was held. The property is overgrown with vegetation, the yard needs mowed and there is a mattress sitting outside the house. The cleanup has not been completed as requested. Sanne moved to set a public hearing. Alder seconded the motion. Motion carried 4-0.
Discussion on 807 E Park Avenue, Plainview Peed’s Add Blk 1 E 120’ Lots 4-5-6 was held. There are several unlicensed and inoperable vehicles around the property. Mike Kuhl was present to speak to the council and said he was waiting on titles for the unlicensed vehicles. Questions were raised on zoning regulations and the storage of vehicles. Sanne moved to revisit next month. Smith seconded the motion. Motion carried 4-0.
Discussion on the property at 302 S Main, 4-27-4 T.L. 10 4-27-4 .87 Acres was held as the property contains several inoperable and unlicensed vehicles. Questions were raised on zoning regulations for industrial properties. Smith moved to revisit next month. Alder seconded the motion. Motion carried 4-0.
Zoning board recommendations for building permits were presented.
A building permit was submitted by Brandon and Jennifer Forbes for a storage shed at 218 S King Street, Plainview Kim & Blr Add Blk 8. The structure meets all R-3 zoning regulations. Sanne moved to approve the permit. Sanne moved to approve the permit. Yosten seconded the motion. Motion carried 4-0.
A building permit was submitted by Sandra Bryant for construction of a fence at 202 N 6th Street, Plainview Peed’s 2nd Ad Blk 8 Lots 3&4. The structure meets all requirements for R-2 residential. Sanne moved to approve the building permit. Yosten seconded the motion. Motion carried 4-0.
Two building permits were submitted by Todd & Tami Moody for a garage and storage shed for the property located at 603 N 4th Street, Plainview College Add Blk 20 Lot 4 & N 26’ Lot 5. The property is zoned R-2 residential and both structures meet all regulations. Sanne moved to approve both permits. Yosten seconded the motion. Motion carried 4-0.
An updated permit was submitted by Matt Meuret for construction of a multi-family housing unit on Plainview College Add, Lots 1-12 Block 23. The property is zoned R-3 residential and the structure meets all requirements. Sanne moved to approve the permit. Alder seconded the motion. Motion carried 4-0.
One Keno Grant application was submitted by the Carnegie Library Preservation Center for funding of their Archive Preservation Project. The group is moving items from the Historical Museum located in the old depot to the Carnegie Library. The funds would be used for materials needed in archiving the items. Sanne moved to approve the Keno Grant in the amount of $800.00. Smith seconded the motion. Motion carried 4-0.
City Clerk Retzlaff presented a proposal from American Legal Publishing for an online version of the City of Plainview Code of Ordinances. The service would allow the City to have the entire code book available online as one file as well as providing timely updates. Sanne moved to allow the purchase of the online code book. Alder seconded the motion. Motion carried 4-0.
Discussion was held on Ordinance #966, Regulations for Keeping and Maintaining Chickens in Corporate Limits. Concerns were raised on items listed in the proposed Ordinance that need additional clarification. The committee formed last month will meet with the City Clerk to create the application and address other concerns. Updates will be brought back to the council for further discussion in August.
Council agreed to update the existing Ordinance on nuisance properties to include regulations on keeping indoor furniture on porches and lawns. Proposed changes will be discussed at the next council meeting.
Discussion was held on the previously passed Ordinance #964 which regulated Small Box Discount Stores in corporate limits. Concerns were held from the public on the addition of another Small Box Discount Store in Plainview and the impact it could have on existing small town businesses. The Ordinance as currently written is intended to protect the public welfare of the community based on the products that would be sold.
Mark Fitzgerald of EMC Insurance was present to speak to the council about the Ordinance.
At 8:09 PM Sanne moved to go into Executive Session for discussion with EMC representatives regarding Small Box Discount Stores, zoning issues and possible litigation. Smith seconded the motion. Motion carried 4-0.
At 9:10 PM Smith moved to come out of Executive Session. Sanne seconded the motion. Motion carried 4-0.
Alder moved to repeal Ordinance #964 regarding regulations for Small Box Discount Stores in corporate limits. Yosten seconded the motion. Motion failed 3-2 with Sanne, Smith and Schlote voting no. Ordinance #964 will remain in place as passed in March of 2021.
City Administrator Tarr presented a brief overview of items that will need to be discussed during upcoming budget workshops. Tarr presented on equipment needs for the City, future of the power plant, staffing and wages.
A question was raised on personnel committee evaluating City employees and the impact on wage increases. Employee evaluations will be conducting by the department supervisors and then reviewed by the personnel committee.
It was moved by Yosten, seconded by Alder to adjourn the meeting. Motion carried 4-0.
