September 2020 Meeting

 

REGULAR MEETING OF THE CITY COUNCIL

TUESDAY SEPTEMBER 8, 2020

 

A meeting of the Mayor and Council of the City of Plainview, Nebraska, was held at the Council Chambers in said City on the 8th day of September at 6:30 o’clock P.M. 

.

Roll call was held and present were: Mayor Schlote; Council Members: Smith, Brookhouser, Yosten and Sanne. Absent: None

 

The Pledge of Allegiance was then recited.

 

Mayor Schlote opened the meeting and announced to individuals in attendance that a full copy of the new Nebraska Open Meetings Act was posted on the east wall of the Council Chambers.

 

Notice of the meeting was given in advance thereof by Publication, a designated method for giving notice, as shown by the Affidavit of Publication attached to these minutes.  Notice of this meeting was given to the Mayor and all Members of the Council and a copy of their acknowledgment of receipt of notice and the agenda is attached to the minutes.  Availability of the agenda was communicated in the advance notice and in the notice to the Mayor and Council of this meeting.  All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.

 

Jeremy Tarr was present as City Administrator

Courtney Retzlaff was present as City Clerk.

 

Brookhouser moved to approve the special council meeting minutes from August 6th, August 10th, August 24th, August 26th and August 28th and the regular meeting minutes from August 11th. Smith seconded the motion. Motion carried 4-0.

 

Sanne moved to approve claims and payroll. Brookhouser seconded the motion. Motion carried 4-0.

 

No Manor report was given.

 

Officer Jerry Neumann presented the monthly police report.

 

Economic Development Director Susan Norris gave updates on the 4-plex grant, FEMA grant reimbursement for the 2019 flood, DTR Grant funding and the need for a new comprehensive plan for the City of Plainview.

 

City Superintendent Curt Hart reported that a leak at the swimming pool was being repaired and the facility will be winterized, the fence at the transfer station was being fixed to meet NDEE requirements and demolition for the Hanks property is to be completed this month.

 

Council member Brookhouser introduced the following resolution and moved for its adoption:

                                   

RESOLUTION #611

 

WHEREAS: State of Nebraska Statutes, sections 39-2115, 39-2119, 39-2120, 39-2121, and 39-2520(2), requires an annual certification of program compliance to the Nebraska Board of Public Roads Classifications and Standards; and

 

WHEREAS: State of Nebraska Statute, section 39-2120 also requires that the annual certification of program compliance by each municipality shall be signed by the Mayor or Village Board Chairperson and shall include a copy of a resolution of the governing body of the municipality authorizing the signing of the certification form.

 

BE IT RESOLVED that the Mayor of Plainview is hereby authorized to sign the attached Municipal Annual Certification of Program Compliance form.

 

Council member Smith seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Smith, Brookhouser, Yosten and Sanne. Nay: None. Whereupon the Mayor declared said motion carried and Resolution #611 is passed

and adopted.

 

Council member Brookhouser introduced the following resolution and moved for its adoption:

 

RESOLUTION #612

 

WHEREAS, the City of Plainview, Nebraska has received requests for signs in the 200 Block of Maple Street designating a deaf child living in the area

 

AND WHEREAS, the Mayor and City Council deem it to be in the best interest of the citizens of Plainview that signs be posted;

                                                                                                            

NOW THEREFORE BE IT RESOLVED, BY THE MAYOR AND COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA, THAT:

 

1. In the 200 block of South Maple Street, shall be posted with signs indicating Caution for a Deaf Child; city officials shall obtain and post such signs as soon as possible.

                       

Council member Sanne seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Smith, Brookhouser, Yosten and Sanne. Nay: None. Whereupon the Mayor declared said motion carried and Resolution #612 is passed

and adopted.

 

Discussion was held on approval of the NENEDD Service and Consultant Agreement for General Administration of the NAHTF Grant. The contract would authorize NENEDD to handle all administration of the grant with total cost to the City of Plainview to not exceed $10,000. City Attorney Curtiss had previously reviewed the contract and had no concerns over the terms. Brookhouser moved to approve the contract. Sanne seconded the motion. Motion carried 4-0.

 

A Keno grant application was received from the Plainview Sports Boosters for purchase of new weight racks for the school facility. Brookhouser moved to approve the grant in the amount of $3,000. Yosten seconded the motion. Motion carried 4-0.

 

Two building permits were recommended by the zoning board for council approval.

 

An application for a garage at 307 N 4th Street by Dalton Goetzinger met all requirements for R-2 residential structures. Sanne moved to approve the permit. Brookhouser seconded the motion. Motion carried 4-0.

 

An application for a lean-to at 202 N Main Street by Tim Gustman met all requirements for R-2 residential structures. Brookhouser moved to approve the permit. Sanne seconded the motion. Motion carried 4-0.

 

The library board had requested permission for Volkman Heating and Plumbing to install a ventilation pipe through the roof of the building to accommodate an Epilog Laserprinter that is being purchased by the Library Foundation. Brookhouser moved to approve the installation. Sanne seconded the motion. Motion carried 4-0.

 

Discussion on previously deemed nuisance properties at 207 S King, 209 S King and 107 W Locust was held. Continued cleanup is necessary at all three properties and public hearings will need to be set. Brookhouser moved to hold public hearings for the previously mentioned nuisance properties. Smith seconded the motion. Motion carried 4-0.

 

Motion was made by Brookhouser and seconded by Smith to approve Ordinance No. 959 on its first reading.  Upon roll call vote, the following members voted AYE:  Smith, Brookhouser, Yosten and Sanne. The following voted NAY: none.  Motion carried 4-0.  Whereupon the Mayor declared said Ordinance No. 959 approved on its first reading.

 

It was moved by Brookhouser and seconded by Smith to waive the second and third readings and approve Ordinance No. 959. Upon roll call vote, the following members voted AYE: Smith, Brookhouser, Yosten, and Sanne. The following voted NAY: none.  Motion carried 4-0.  Whereupon the Mayor declared Ordinance No. 959 approved on its second and third readings.

 

 

ORDINANCE #959

 

AN ORDINANCE TO SET THE SALARY AND EMPLOYMENT TERMS FOR THE CITY ADMINISTRATOR.

 

BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA:

 

Section 1. That the Ordinance setting the salary and employment terms for the City Administrator, should be amended as follows:

 

1.      That effective July 14, 2020 the salary for the City Administrator shall be set at the annual amount of $66,000 as base salary, paid on the normal City payroll schedule, plus benefits as normally provided to full time employees, with future cost of living and merit adjustments to be set by Resolution;

 

2.      That any other details, not in conflict with the City Code, shall be handled as separate agenda items, approved by motion and set forth in the minutes of the City Council.

 

Section 2. Any other ordinance or section passed and approved prior to passage, approval and publication of this ordinance and in conflict with its provisions is repealed.

 

Section 3. This ordinance shall take effect and be in full force from and after its passage, approval, and publication as required by law.

 

Discussion of the settlement of the claim of a former employee was held. Mayor Schlote stated that Nebraska law requires the City to maintain a public record of all settled claims and this agenda item is intended to satisfy that requirement. The former Police Chief filed a workers’ compensation petition and a tort claim against the City. The City agreed to settle the claims in exchange for the former Police Chief’s agreement to release the City from all liability related to his claims.

 

A brief discussion on hiring for additional police force was held. The advertisement will be for a Police Chief or Officer. The proposed budget for FY 2020-2021 allows for two full time officers. Officer Neumann is serving as interim Police Chief and would need to apply for the position of Chief if he so desired. Officer Neumann stated that Pierce County is covering calls as they are available. Brookhouser moved to approve advertising for the positions. Smith seconded the motion. Motion carried 4-0.

 

At 7:00 P.M. Mayor Schlote opened the Public Hearing for the CDBG DTR Grant.

 

Susan Norris explained the CDBG DTR Grant process and the public hearing is the final step in applying for the $435,000 grant from the State. The remaining $100,000 to bring the grant total to $535,000 would come from the match provided by those businesses who participate in the DTR project. The total amount of funding supplied to each business would depend on the number who apply and the scope of the projects. The DTR committee, which is comprised of the current LB840 Board, will decide on the amount of funding and percentage of match each applicant receives. In total, the DTR project could last 1-2 years before all upgrades are completed. The City of Plainview would also be eligible to apply for grant funding and those funds could be used to demolish vacant commercial buildings. Norris stated that after the 2 years are finished, an assessment would be completed by the County Assessor. The upgrades completed would help to increase the overall valuation of the City of Plainview.

 

At 7:06 P.M. Mayor Schlote closed the public hearing.

 

Council member Brookhouser introduced the following resolution and moved for its adoption:

 

RESOLUTION #613

 

 

WHEREAS, the City of Plainview Nebraska, is an eligible unit of a general local government authorized to file an application under the Housing and Community Development Act of 1974 as amended for Small Cities Community Development Block Grant Program, and,

 

WHEREAS, the City of Plainview, Nebraska, has obtained its citizens’ comments on community development and housing needs; and has conducted public hearing(s) upon the proposed application and received favorable public comment respecting the application which for an amount of $435,000 for Downtown Revitalization project activities; and,

 

NOW, THEREFORE, BE IT RESOLVED BY

 

City Council of City of Plainview, that the Mayor be authorized and directed to proceed with the formulation of any and all contracts, documents or other memoranda between City of Plainview  and the Nebraska Department of Economic Development so as to effect acceptance of the grant application.

 

Council member Yosten seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Smith, Brookhouser, Yosten and Sanne. Nay: None. Whereupon the Mayor declared said motion carried and Resolution #613 is passed

 

City Administrator Tarr reminded the council that the Budget Hearing is set for Monday, September 14, 2020 at 6:30 P.M. for approval of the FY 2020-2021 budget as well as property tax request.

           

It was moved by Brookhouser, seconded by Smith to adjourn the meeting. Motion carried 3-0.
