SPECIAL MEETING OF THE CITY COUNCIL
TUESDAY MARCH 24, 2020
A meeting of the Mayor and Council of the City of Plainview, Nebraska, was held at the Council Chambers in said City on the 24th day of March at 6:30 o’clock P.M.

Roll call was held and present were: Mayor Schlote; Council Members: Brookhouser, Yosten and Sanne. Absent: Smith
The Pledge of Allegiance was then recited.
Mayor Schlote opened the meeting and announced to individuals in attendance that a full copy of the new Nebraska Open Meetings Act was posted on the east wall of the Council Chambers.
Notice of the meeting was given in advance thereof by Publication, a designated method for giving notice, as shown by the Affidavit of Publication attached to these minutes. Notice of this meeting was given to the Mayor and all Members of the Council and a copy of their acknowledgment of receipt of notice and the agenda is attached to the minutes. Availability of the agenda was communicated in the advance notice and in the notice to the Mayor and Council of this meeting. All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.
Courtney Retzlaff was present as City Clerk.
Curt Hart was present as City Superintendent.
Bruce Curtiss was present as City Attorney.
Discussion was held on proposed rate increases at the transfer station. The last rate increase was in 2015 and the City’s landfill, L.P. Gill recently raised their rates from $32.65 per ton to $42.00. City Attorney Curtiss provided copies of 3 different rate increases. After discussion the council decided to raise all rates associated with the transfer station to go into effect as of the passage and publication of the ordinance.
Motion was made by Brookhouser and seconded by Yosten to approve Ordinance No. 955 on its first reading. Upon roll call vote, the following members voted AYE: Brookhouser, Yosten and Sanne. The following voted NAY: none. Motion carried 3-0. Whereupon the Mayor declared said Ordinance No. 955 approved on its first reading.
It was moved by Brookhouser, and seconded by Sanne to waive the second and third readings and approve Ordinance No. 955. Upon roll call vote, the following members voted AYE: Brookhouser, Yosten and Sanne. The following voted NAY: none. Motion carried, 3-0. Whereupon the Mayor declared Ordinance No. 955 approved on its second and third readings.
ORDINANCE #955
AN ORDINANCE TO AMEND CHAPTER 4 SECTION 211 TO THE MUNICIPAL CODE OF THE CITY OF PLAINVIEW, NEBRASKA.
Whereas, the City Code requires updates relative to the rates of the Transfer Station;
NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA:
Section 1. That Chapter 4, Section 211 of the Municipal Code of Plainview, Nebraska, be amended to read as follows:
§ 4-211 TRANSFER STATION SITE; RATES
All material not priced below “per item” must be weighed on certified scales and scale tickets provided to City. The rates for the Transfer station site shall be set as follows:
Transfer Station Site:
(A) Trash other than roofing:
(1) All material collected by City contract hauler (hauler paid by City of Plainview): Sixty-two ($62.00) dollars per ton to the nearest ½ ton, or $0.031 per pound if below 1 ton;
(2) All material collected and dumped by haulers other than City contracted hauler: Sixty-five ($65.00) dollars per ton to the nearest ½ ton, or $0.0325 per pound if below 1 ton;
(3) In all cases, Six ($6.00) dollars minimum if charge per weight is less than that amount; and
(4) In all cases, material bagged and totally inside trash bags: Three ($3.00) dollars per bag and need not be weighed.
(B) Roofing:
(1) From inside Plainview City Limits, Seventy ($70.00) per ton or part of a ton;
(2) From outside Plainview City Limits, Seventy-three ($73.00) per ton to part of a ton.
Section 2. That any ordinance passed and approved prior to the passage, approval, and publication or posting of this ordinance and in conflict with its provisions, is hereby repealed.
Section 3. This ordinance shall take effect and be in full force from and after its passage, approval, and publication or posting as required by law.
Recommendations for 2 building permits were received from the zoning board.
The first was for a fence at 216 S King Street at the property owned by Wesley Eisenmann. The fence met all standards for R-3 residential with the understanding that concerns in the past of the property being used as a business be monitored. Brookhouser moved to approve the permit. Sanne seconded the motion. Motion carried 3-0.
The second building permit was for a building addition by Chad Goetzinger for his business at 208 ½ S Line Street. The recommendations from the zoning board included use of a curb along the property line to control water runoff. Council member Sanne motioned to approve the building permit without the curb, utilizing gutters and a ditch between the properties for water control. Brookhouser seconded the motion. Motion carried 3-0.
A disaster declaration for the City of Plainview in regards to the on-going COVID-19 pandemic outbreak was presented to the council. The declaration once signed would allow the City to receive State funding if available as necessary. Brookhouser moved to approve the declaration. Yosten seconded the motion. Motion carried 3-0.
City Attorney Curtiss gave an update on a letter requested by Plainview Manor for Medicare Enrollment and stated that after discussion with Manor Administrator Juleen Johnson, he will submit a letter to City Clerk Retzlaff to have signed.
Council expressed some concern on how recent recommendations for building permits had been handled by the zoning board and would like to ensure that the zoning regulations for the City are being properly followed.
City Clerk Retzlaff reported that the City Offices are still open normal business hours and staff is following proper CDC guidelines to ensure the building remains safe. The need to close the office to the public will continue to be monitored. The use of electronic communication for upcoming council meetings and limiting those in attendance was also discussed. Retzlaff will look at creating a Zoom account for the City to use for future council meetings.
It was moved by Brookhouser, seconded by Yosten to adjourn the meeting. Motion carried 3

I, the undersigned, City Clerk for the City of Plainview, Nebraska, hereby certify that the foregoing is a true and correct copy of proceedings had and done by the Mayor and Council on 3/24/2020; that all of the subjects included in the foregoing proceedings were contained in the agenda for the meeting, kept continually current and readily available for public inspection at the office of the City Clerk; that such subjects were contained in said agenda for at least twenty-four hours prior to said meeting; that at least one copy of all reproducible material discussed at the meeting was available at the meeting for examination and copying by members of the public; that the said minutes from which the foregoing proceedings have been extracted were in written form and available for public inspection within ten working days and prior to the next convened meeting of said body; that all news media requesting notification concerning meetings of said body were provided advance notification of the time and place of said meeting and the subjects to be discussed at said meeting.
