August 2020 Meeting

 

REGULAR MEETING OF THE CITY COUNCIL

TUESDAY AUGUST 11, 2020

 

A meeting of the Mayor and Council of the City of Plainview, Nebraska, was held at the Council Chambers in said City on the 11th day of August at 6:30 o’clock P.M. 

.

Roll call was held and present were: Mayor Schlote; Council Members: Smith, Yosten and Sanne. Absent: Brookhouser

 

The Pledge of Allegiance was then recited.

 

Mayor Schlote opened the meeting and announced to individuals in attendance that a full copy of the new Nebraska Open Meetings Act was posted on the east wall of the Council Chambers.

 

Notice of the meeting was given in advance thereof by Publication, a designated method for giving notice, as shown by the Affidavit of Publication attached to these minutes.  Notice of this meeting was given to the Mayor and all Members of the Council and a copy of their acknowledgment of receipt of notice and the agenda is attached to the minutes.  Availability of the agenda was communicated in the advance notice and in the notice to the Mayor and Council of this meeting.  All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.

 

Jeremy Tarr was present as City Administrator

Courtney Retzlaff was present as City Clerk.

Bruce Curtiss was present as City Attorney

 

Smith moved to approve the special meeting minutes from July 13th and the regular meeting minutes on July 14th .Yosten seconded the motion. Motion carried 3-0.

 

Smith moved to approve claims and payroll. Yosten seconded the motion. Motion carried 3-0.

 

No Manor report was given.

 

Officer Jerry Neumann presented the monthly police report.

 

Susan Norris presented the monthly Economic Development report. An update on the housing grant had not yet been received, FEMA grant reimbursement is available for the municipalities match for the 2019 flood, and the Pierce County Disaster Housing Fund has been expanded to rural areas for flood repairs. Confluence will submit a proposal of the DTR plan on August 13th for review by the LB840 board.

City Administrator Tarr presented the report for City Superintendent Curt Hart.

 

The LB840 board had recommendations for 2 sign grants at local businesses. Dance Bright submitted for $1,000 reimbursement and Priority Family Medicine for $389.48. Smith moved to approve both grants. Sanne seconded the motion. Motion carried 3-0.

 

Council member Sanne introduced the following resolution and moved for its adoption:

                                   

RESOLUTION #605

 

 

Appointment to MEAN Management Committee

 

WHEREAS, the City of Plainview, State of Nebraska, is a party to the Electrical Resources Pooling Agreement and, pursuant to the terms of such Agreement, it is the responsibility of the City of Plainview to designate a representative and alternate representative to the Municipal Energy Agency of Nebraska Management Committee provided for under the terms of said Agreement.

 

NOW THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of Plainview, State of Nebraska, that:

 

1. The City Clerk is hereby directed to give written notice to the Municipal Energy Agency of Nebraska of the appointment of Jeremy Tarr as representative to said MEAN Management Committee.

 

2. The City Clerk is hereby directed to give written notice to the Municipal Energy Agency of Nebraska of the appointment of Curt Hart as alternate representative to said MEAN Management Committee.

  

Appointment to NMPP Members’ Council

 

 NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of Plainview, State of Nebraska, that:

 

1. Such City be and hereby is a member of the Nebraska Municipal Power Pool.

 

2. The Mayor and City Council of the City of Plainview, State of Nebraska, does hereby appoint City Administrator as the representative* of the City of Plainview, State of Nebraska, to the Members’ Council of the Nebraska Municipal Power Pool.

 

3. The Mayor and City Council of the City of Plainview, State of Nebraska, does hereby appoint City Superintendent as the alternate representative* of the City of Plainview, State of Nebraska, to the Members’ Council of the Nebraska Municipal Power Pool.

 

*Pursuant to Article V of the Amended and Restated Bylaws of the Nebraska Municipal Power Pool, “Any person appointed as Representative or Alternate Representative shall be a resident of the area receiving services from the appointing Member.”

    

Appointment to ACE Board of Directors

 

 WHEREAS, the City of Plainview, State of Nebraska, is a party to the Interlocal Agreement creating the Public Alliance for Community Energy and, pursuant to the terms of said Agreement, it is the responsibility of the Mayor and City Council to designate a representative of the City of Plainview to the Public Alliance for Community Energy Board of Directors provided for under the terms of said Agreement.

 

 NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of Plainview, that:

 

1. The City Clerk is hereby directed to give written notice to the Public Alliance for Community Energy of the appointment of City Administrator as the City’s representative to said Board of Directors.

 

2. The City Clerk is hereby directed to give written notice to the Public Alliance for Community Energy of the appointment of City Superintendent as the City’s alternate representative to said Board of Directors.

 

 

Council member Yosten seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Sanne, Smith and Yosten. Nay: None. Whereupon the Mayor declared said motion carried and Resolution #605 is passed

and adopted.

 

Council member Sanne introduced the following resolution and moved for its adoption:

 

RESOLUTION #606

 

 

            BE IT RESOLVED AND ENACTED BY THE MAYOR AND COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA, as follows:

 

Section 1.        That the following bonds of the City of Plainview, Nebraska (the “City”), which are callable at any time on or after October 20, 2020, are hereby authorized to be called for redemption at par plus accrued interest on such date as set forth in the Direction for Call (as defined below) after which date said bonds shall cease to bear interest:

            General Obligation Library Bonds, Series 2015, of the City of Plainview, in the State of Nebraska, dated October 20, 2015, numbered as they are shown on the books and records of the Paying Agent and Registrar, in the principal amount of $400,000, maturing and bearing CUSIP numbers in the amounts as follows:

                                    *Term Bonds

 

                        Said bonds are hereinafter referred to as the “Called Outstanding Bonds.”

 

            Section 2.        The Called Outstanding Bonds are to be paid at the office of the City Treasurer in Plainview, Nebraska, being the office of the Paying Agent and Registrar for said bonds.

 

            Section 3.        The Mayor or City Clerk of the City (each, an “Authorized Officer”) each are individually hereby authorized at any time on or after the date of this resolution to direct the irrevocable call of the Called Outstanding Bonds on behalf of the City and such direction, when made in writing (the “Direction for Call”), shall constitute the action of the City without further action of the City.  The Direction for Call shall include a description of the Called Outstanding Bonds called for redemption as determined appropriate by the Authorized Officer.  The Call Date shall be determined in the Direction for Call, and such direction shall be made by an Authorized Officer not later than June 30, 2021, after which date the Authorized Officers shall have no authority to make any such determination hereunder without further action of the City and this resolution shall be of no further force and effect.

 

            Section 4.  The Paying Agent and Registrar, upon receipt of a copy of this Resolution and an executed Direction for Call, is hereby instructed to mail notice to each registered owner of the Called Outstanding Bonds not less than thirty (30) days prior to the date fixed for redemption, all in accordance with the ordinance authorizing the issuance of the Called Outstanding Bonds. 

 

Council member Smith seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Sanne, Smith and Yosten. Nay: None. Whereupon the Mayor declared said motion carried and Resolution #606 is passed

and adopted.

 

Motion was made by Sanne and seconded by Yosten to approve Ordinance No. 957 on its first reading.  Upon roll call vote, the following members voted AYE:  Smith, Yosten and Sanne. The following voted NAY: none.  Motion carried 3-0.  Whereupon the Mayor declared said Ordinance No. 957 approved on its first reading.

 

It was moved by Smith and seconded by Yosten to waive the second and third readings and approve Ordinance No. 957. Upon roll call vote, the following members voted AYE: Smith, Yosten, Sanne The following voted NAY: none.  Motion carried 3-0.  Whereupon the Mayor declared Ordinance No. 957 approved on its second and third readings.

 

ORDINANCE #957

 

            AN ORDINANCE AUTHORIZING THE ISSUANCE OF GENERAL OBLIGATION LIBRARY REFUNDING BONDS, SERIES 2020 OF THE CITY OF PLAINVIEW, NEBRASKA, IN THE PRINCIPAL AMOUNT OF NOT TO EXCEED FOUR HUNDRED TWENTY-FIVE THOUSAND DOLLARS ($425,000) FOR THE PURPOSE OF REFUNDING THE CITY’S OUTSTANDING GENERAL OBLIGATION LIBRARY BONDS, SERIES 2015; PRESCRIBING THE FORM OF SAID BONDS; AUTHORIZING OFFICERS OF THE CITY TO DESIGNATE FINAL TERMS FOR SAID BONDS WITHIN STATED PARAMETERS; PROVIDING FOR THE LEVY AND COLLECTION OF TAXES TO PAY THE SAME; PROVIDING FOR THE SALE OF THE BONDS; AUTHORIZING THE DELIVERY OF THE BONDS TO THE PURCHASER; APPROVING POST-ISSUANCE TAX COMPLIANCE POLICIES; PROVIDING FOR THE DISPOSITION OF THE BOND PROCEEDS AND ORDERING THE ORDINANCE PUBLISHED IN PAMPHLET FORM

 

Motion was made by Smith and seconded by Sanne to approve Ordinance No. 958 on its first reading.  Upon roll call vote, the following members voted AYE:  Smith, Yosten and Sanne. The following voted NAY: none.  Motion carried 3-0.  Whereupon the Mayor declared said Ordinance No. 958 approved on its first reading.

 

It was moved by Smith and seconded by Sanne to waive the second and third readings and approve Ordinance No. 958. ORDINANCE #958

 

AN ORDINANCE TO AMEND CHAPTER 6 SECTION 322.01 TO THE MUNICIPAL CODE OF THE CITY OF PLAINVIEW, NEBRASKA.

 

Whereas, the City Code requires update relative to discharge of fireworks;

 

NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA:

 

Section 1. That Chapter 6, Section 322.01 of the Municipal Code of Plainview, Nebraska, be amended to read as follows:

 

 

§6-322.01 MISDEMEANORS; FIREWORKS; PERMITTED FIREWORKS. 

            (1)  It shall be unlawful for any person to ignite or cause to be exploded fireworks or firecrackers of any description whatsoever, except those that comply with current Nebraska Law, and State Fire Marshall Regulations, and then only on and between June 24th and July 5th of each year.

 

            On the 4th of July fireworks may be discharged between the hours of 8:00 A.M. and 12:00 midnight; on all other days discharge of fireworks shall be limited to 12:00 noon to 10:30 P.M.

 

            (2)  The provisions of this section shall not apply to any fireworks to be used for purposes of public exhibitions or display under authorization of the City Council or to fireworks furnished for agricultural purposes pursuant to written authorization from the State Fire Marshal.

 

Section 2. Any other ordinance or section passed and approved prior to passage, approval and publication of this ordinance and in conflict with its provisions is repealed.

 

Section 3. This ordinance shall take effect and be in full force from and after its passage, approval, and publication as required by law.

 

Council member Smith introduced the following resolution and moved for its adoption:

 

RESOLUTION #607

 

 

WHEREAS the City of Plainview has communicated with certain property owners within the City regarding potential Nuisances on their property, as determined by the Board of Health; and

WHEREAS various Owners, having been notified according to law, have requested a hearing before the City Council to protest or review those determinations; and

WHEREAS the City Council has set and conducted such hearing on the property owned

NOW THEREFOR BE IT RESOLVED, BY THE MAYOR AND COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA, as follows:

1.       That the property described above does contain, and is hereby Determined to constitute a Public Nuisance according to City Code;

 

2.      That the Owner of said property is hereby Ordered to remedy said public nuisance by taking the following actions:  All household garbage, construction debris and old appliances, as well as miscellaneous debris needs to be properly removed from around property. All materials need to be disposed of properly.

 

3.       That said actions shall be completed within the following time frame:  Before September 30, 2020.

 

4.      That if said actions are not completed as required above, further action shall be taken as follows:  City will assume responsibility for cleaning up the property, bill all charges to the associated owner, Steve Classen, and assess unpaid costs to the property.

 

Council member Sanne seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Sanne, Smith and Yosten. Nay: None. Whereupon the Mayor declared said motion carried and Resolution #607 is passed

and adopted.

 

Council member Sanne introduced the following resolution and moved for its adoption:

 

RESOLUTION #608

 

WHEREAS the City of Plainview has communicated with certain property owners within the City regarding potential Nuisances on their property, as determined by the Board of Health; and

WHEREAS various Owners, having been notified according to law, have requested a hearing before the City Council to protest or review those determinations; and

WHEREAS the City Council has set and conducted such hearing on the property owned

1.       That the property described above does contain, and is hereby Determined to constitute a Public Nuisance according to City Code;

 

2.      That the Owner of said property is hereby Ordered to remedy said public nuisance by taking the following actions:  General cleanup of property. Proper storage of items or disposal of items contained under tarps around property.

 

3.       That said actions shall be completed within the following time frame:  Before September 30, 2020.

4.      That if said actions are not completed as required above, further action shall be taken as follows:  City will assume responsibility for cleaning up the property, bill all charges to the associated owner, Walter Friedrich, and assess unpaid costs to the property.

 

Council member Smith seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Sanne, Smith and Yosten. Nay: None. Whereupon the Mayor declared said motion carried and Resolution #608 is passed

and adopted.

 

Council member Sanne introduced the following resolution and moved for its adoption:

WHEREAS the City of Plainview has communicated with certain property owners within the City regarding potential Nuisances on their property, as determined by the Board of Health; and

WHEREAS various Owners, having been notified according to law, have requested a hearing before the City Council to protest or review those determinations; and

WHEREAS the City Council has set and conducted such hearing on the property owned

(legal description) Lots Three (3), Four (4), and Five (5) and the South Thirty-six (36’) feet of Lot Two (2), Block Seventeen (17), College Addition to the City of Plainview, Pierce County, Nebraska

NOW THEREFOR BE IT RESOLVED, BY THE MAYOR AND COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA, as follows:

1.       That the property described above does contain, and is hereby Determined to constitute a Public Nuisance according to City Code;

 

2.      That the Owner of said property is hereby Ordered to remedy said public nuisance by taking the following actions:  All miscellaneous junk and debris located behind large storage shed needs to be properly disposed of and or stored to include pallets and miscellaneous scrap metal

3.       That said actions shall be completed within the following time frame:  Before September 30, 2020.

4.      That if said actions are not completed as required above, further action shall be taken as follows:  City will assume responsibility for cleaning up the property, bill all charges to the associated owner, Patty Beaudette, and assess unpaid costs to the property.

 

Council member Smith seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Sanne, Smith and Yosten. Nay: None. Whereupon the Mayor declared said motion carried and Resolution #609 is passed

and adopted.

 

Council member Sanne introduced the following resolution and moved for its adoption:

NOW THEREFOR BE IT RESOLVED, BY THE MAYOR AND COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA, as follows:

1.       That the property described above does contain, and is hereby Determined to constitute a Public Nuisance according to City Code;

 

2.      That the Owner of said property is hereby Ordered to remedy said public nuisance by taking the following actions:  Buildings on the property are not secured and must be removed. Miscellaneous junk and debris inside structures as well as outside around property. Several downed trees on property need to be removed.

3.       That said actions shall be completed within the following time frame:  Before September 30, 2020.

4.      That if said actions are not completed as required above, further action shall be taken as follows:  City will assume responsibility for cleaning up the property, bill all charges to the associated owner, Zeb Spaulding, and assess unpaid costs to the property.

 

Council member Smith seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Sanne, Smith and Yosten. Nay: None. Whereupon the Mayor declared said motion carried and Resolution #610 is passed

and adopted.

 

 

Health board recommendations for nuisance properties were discussed.

 

The property at 207 S King owned by Rob Jenkins has construction debris, iron piles and appliances that need to disposed of properly. Smith moved to send a nuisance letter to Jenkins. Yosten seconded the motion. Motion carried 3-0.

 

The property at 209 S King owned by Tim Jenkins has construction debris that needs to be disposed of properly. Smith moved to send a nuisance letter to Jenkins. Yosten seconded the motion. Motion carried 3-0.

 

The property at 107 W Locust owned by Jeff Ratliff has construction debris and iron piles that need to be disposed of properly. Smith moved to send a nuisance letter to Ratliff. Yosten seconded the motion. Motion carried 3-0.

 

Zoning board recommendations for building permits were discussed by the council.

 

An application for a car port at 202 N 9th Street was submitted by Stan Evans. Smith moved to approve the permit. Yosten seconded the motion. Motion carried 3-0.

 

An application for a storage building at 202 N 6th Street was submitted by Sandra Bryant. Sanne moved to approve the permit. Yosten seconded the motion. Motion carried 3-0.

 

An application for a storage building and garage addition at 610 West Street was submitted by Duane Pittet. Smith moved to approve the permit. Yosten seconded the motion. Motion carried 3-0.

An application for a garage at 701 W Woodland was submitted by Justin Bruha. Sanne moved to approve the permit. Yosten seconded the motion. Motion carried 3-0.

 

Discussion was held an employment contract for City Administrator Tarr. The contract stated employment terms, salary, benefits, provisions for termination, severance, resignation and suspension. Smith moved to approve the contract. Yosten seconded the motion. Motion carried 3-0.

 

Sanne moved to approve CDBG Grant 19-PP-011 Drawdown #3 for $21,620.00 for the DTR Grant. Smith seconded the motion. Motion carried 3-0.

 

A brief discussion on the 2020-2021 budget was held and possible dates for budget workshops were discussed. City Administrator Tarr mentioned that there are possible rate changes that will be necessary to fund the necessary expenses of the City.

 

City Attorney Curtiss stated that he had contacted the State Patrol in regards to concerns with sex offenders in City limits.

 

An update on the demolition of the Hanks property was given and City Administrator Tarr stated that the City is waiting for a waiver from the State of Nebraska before demolition can begin.

 

Council member Smith motioned to go into executive session to discuss COVID-19 protocols at the Plainview Manor, to avoid litigation to the City and protect employees. Sanne seconded the motion. Motion carried 3-0 with Yosten voting no. The council entered executive session at 7:46 PM.

 

At 8:21 PM Sanne moved to come out of executive session. Yosten seconded the motion. Motion carried 3-0.

 

Council member Yosten moved to authorize Manor Administrator Juleen Johnson to release necessary information to the public regarding COVID-19 protocols at the Plainview. Manor. Sanne seconded the motion. Motion carried 3-0.

 

It was moved by Sanne, seconded by Yosten to adjourn the meeting. Motion carried 3-0.
