MEETING OF THE CITY COUNCIL
TUESDAY, APRIL 14, 2026
A meeting of the Mayor and Council of the City of Plainview, Nebraska, was held at the Council Chambers in said City on the 14th day of April at 6:30 o’clock P.M.
Roll call was held and present were: Mayor Smith; Council Members: Born, Janovec, Sanne and Doty Absent: None
The Pledge of Allegiance was then recited.
Mayor Smith opened the meeting and announced to individuals in attendance that a full copy of the new Nebraska Open Meetings Act was posted on the east wall of the Council Chambers.
Notice of the meeting was given in advance thereof by Publication, a designated method for giving notice, as shown by the Affidavit of Publication attached to these minutes. Notice of this meeting was given to the Mayor and all Members of the Council and a copy of their acknowledgment of receipt of notice and the agenda is attached to the minutes. Availability of the agenda was communicated in the advance notice and in the notice to the Mayor and Council of this meeting. All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.
Courtney Retzlaff was present as City Clerk.
Jeremy Tarr was present as City Administrator.
Kyle Petersen was present as City Attorney.
Janovec moved to approve the regular meeting minutes from March 10th. Doty seconded the motion. Motion carried 4-0.
Janovec moved to approve claims and payroll. Doty seconded the motion. Motion carried 4-0.
Juleen Johnson reported on the census at the Manor and Assisted Living and asked for council members to serve on a committee to discuss financial options for the expansion and renovation project. Mayor Smith, City Administrator Tarr and council members Sanne and Janovec will be on committee.
Police Chief Hallock reported on nuisance properties with abatement date set for May 4th, LiDar training for the department and activity of the department for the month of March. Officer Funston presented on the upcoming Bike Rodeo to be held on June 7th following the Klown Days Parade at the Bandshell. Pre-registration will be required by June 1st and forms are available at the City Office.
City Clerk Retzlaff reported that there were 184 Community Surveys completed and a town hall will be scheduled in the coming weeks to discuss the results. Food trucks are scheduled for the summer and will begin the end of April and the Chamber of Commerce is hosting a ribbon cutting for Cool Beanz and Brick Oven & Bakery, April 16th at 4:00 PM. Everyone is invited to attend.
City Administrator Tarr introduced Judith Stanton who is the new Executive Director for PCED.
City Administrator Tarr reported that maintenance crews have been repairing streets around town, parks have been fertilized and City will be moving the tree pile due to being unable to burn at this time. Notice of the new area to dispose of yard waste and trees will be communicated when it is open.
Mayor Smith read proclamations for National Library Week and Arbor Day
National Library Week 2026 Proclamation
WHEREAS, libraries spark creativity, fuel imagination, and inspire lifelong learning, offering a space where individuals of all ages can explore new ideas and be drawn to new possibilities;
WHEREAS, libraries serve as vibrant community hubs, connecting people with knowledge, technology, and resources while fostering civic engagement, critical thinking, and lifelong learning;
WHEREAS, libraries provide free and equitable access to books, digital tools, and innovative programming, ensuring that all individuals- regardless of background-have the support they need to learn, connect, and thrive;
WHEREAS, libraries partner with schools, businesses and organizations, connecting the dots to maximize resources, increase efficiency, and expand access to essential services, strengthening the entire community;
WHEREAS, libraries empower job seekers, entrepreneurs, and lifelong learners by providing access to resources, training, and opportunities that support career growth and economic success;
WHEREAS, libraries nurture young minds through story times, STEAM programs, and literacy initiatives, fostering curiosity and a love of learning that lasts a lifetime;
WHEREAS, libraries protect the right to read, think, and explore without censorship, standing as champions of intellectual freedom and free expression;
WHEREAS, dedicated librarians and library workers provide welcoming spaces that inspire discovery, collaboration, and creativity for all;
WHEREAS, libraries, librarians, and library workers across the country are joining together to celebrate National Library Week under the theme “Find Your Joy”;
NOW, THEREFORE, be it resolved that I, Bob Smith, Mayor, proclaim National Library Week, April 19-25, 2026. During this week, I encourage all residents to visit their library, explore its resources, and celebrate all the ways that the library draws us together as a community.
Official Proclamation Arbor Day 2026
WHEREAS in 1872, the Nebraska Board of Agriculture established a special day to be set aside for the planting of trees, and
WHEREAS this holiday, called Arbor Day, was first observed with the planting of more than a million trees in Nebraska, and
WHEREAS Arbor Day is now observed throughout the nation and the world, and
WHEREAS trees can be a solution to combating climate change by reducing the erosion of our precious topsoil by wind and water, cutting heating and cooling costs, moderating the temperature, cleaning the air, producing life-giving oxygen, and providing habitat for wildlife, and
WHEREAS trees are a renewable resource giving us paper, wood for our homes, fuel for our fires, and countless other wood products, and
WHEREAS trees in our city increase property values, enhance the economic vitality of business areas, and beautify our community, and
WHEREAS trees — wherever they are planted — are a source of joy and spiritual renewal.
NOW, THEREFORE, I, Robert Smith, Mayor of the City of Plainview, do hereby proclaim April 24, 2026 as ARBOR DAY in the City of Plainview, and I urge all citizens to celebrate Arbor Day and to support efforts to protect our trees and woodlands, and FURTHER, I urge all citizens to plant trees to gladden the heart and promote the well-being of this and future generations.
Sanne moved to approve NENEDD Membership Dues for 2026-2027 in the amount of $1,730.70. Janovec seconded the motion. Motion carried 4-0.
Advisory Board for Parks and Pools recommendations for pool employees for the summer are Allison Hardisty, Manager; Baili Prewitt, Assistant Manager; Jacson King, Assistant Manager 2; Returning guards Morgan Nincehelser, Addison Hodson, Hannah Darnall, Rece Frahm, Avery Hardisty, Kiley Richter and Mallory Mauer; new guards Kobe Maertins, Tiegan Stewart, Kenadee Doerr and Macie Darnall. Sanne moved to approve the Advisory Boards recommendations for pool employees as presented. Born seconded the motion. Motion carried 4-0.
Advisory Board for Parks and Pools recommendations for pool employee hourly wages are Manager $18.00; Assistant Manager $16.50; Assistant Manager 2 $15.50; returning guards $15.50 and new guards $15.00. Born moved to approve the wages as presented. Sanne seconded the motion. Motion carried 4-0.
Advisory Board for Parks and Pools recommendations for seasonal park employees are returning employees Dylan Ward, Josie Choat and Danielle Doerr; new employees Jacson Ward, Aiden Hamilton and Jaeger Frahm. Sanne moved to approve the seasonal park employees as presented. Born seconded the motion. Motion carried 4-0.
Advisory Board for Parks and Pools recommendations for seasonal park employee hourly wages are returning employees $15.50 and new employees $15.00. Born moved to approve the wages as presented. Doty seconded the motion. Motion carried 4-0.
Advisory Board for Parks and Pools recommended that pool admission prices remain the same as 2025. Born moved to keep pool admission prices the same as 2025. Janovec seconded the motion. Motion carried 4-0.
Sanne moved to approve fireworks for Klown Days on June 6th with a rain date of June 7th. Born seconded the motion. Motion carried 4-0.
Council member Sanne introduced the following resolution and moved for its adoption:
RESOLUTION #745
WHEREAS, the Mayor and City of Plainview deem it necessary that a portion of Woodland Avenue be closed for the Klown Festival hosted by the Plainview Chamber of Commerce on June 6, 2026;
NOW THEREFORE BE IT RESOLVED, BY THE MAYOR AND COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA, THAT:
- The following streets are closed to thru traffic from 7:00 AM to 10:00 PM
*Woodland Avenue between Main Street and Maple Street
Council member Born seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Born, Janovec, Sanne and Doty Nay: None. Whereupon the Mayor declared said motion carried and Resolution #745 is passed and adopted.
Council member Born introduced the following resolution and moved for its adoption:
RESOLUTION #746
WHEREAS, the Mayor and City of Plainview deem it necessary that downtown streets be closed for the car show hosted by Highway20 HotRod Association on June 13, 2026;
NOW THEREFORE BE IT RESOLVED, BY THE MAYOR AND COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA, THAT:
- The following streets are closed to thru traffic from 7:00 AM to 5:00 PM
*Locust Avenue between West and King Streets
*Main Street south of Highway 20 to Front Street
*Maple Street south of Highway 20 to approximately 100 feet south of Locust Avenue
*Elm Street from Front Street to approximately 95 feet north of Locust Avenue
*Front Street from Elm Street to Maple Street
Council member Doty seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Born, Janovec, Sanne and Doty Nay: None. Whereupon the Mayor declared said motion carried and Resolution #746 is passed and adopted.
Special Designated Liquor licenses for June events were discussed.
Born moved to approved the SDL for the Plainview Chamber of Commerce for sand volleyball and cornhole tournaments on June 6th from 9:00 AM-midnight at the Bandshell Park. Sanne seconded the motion. Motion carried 4-0.
Sanne moved to approve the following SDL’s for Keystone Bar: June 5th 3:00 PM-2:00 AM, Plainview Fireman’s Dance; June 12th 3:00 PM-2:00 AM Street Dance; June 13th 9:00 AM-5:00 PM Highway 20 HotRod Car Show. Born seconded the motion. Motion carried 4-0.
Keno grants for the quarter were discussed.
Sanne moved to approve the Keno grant application for Plainview Ballbackers in the amount of $5,000 for improvements to the Legion field crow’s nest and batting cages. Born seconded the motion. Motion carried 4-0.
Born moved to approve the Keno grant application for Jr. Pirate Running Club for Girl’s On the Run registration fees in the amount of $1,725. Sanne seconded the motion. Motion carried 3-1 with Doty voting no.
Sanne moved to approve the Keno grant application for Plainview Public Library in the amount of $1,000 for a summer intern. Born seconded the motion. Motion carried 4-0.
Discussion on Resolution #742 was held and council will pass formal resolution in May placing a handicap parking stall on Locust Avenue to the east of the alley by Highstreet Insurance.
Discussion on options for the culvert on 5th Street and Euclid Avenue was held with property owners Randy and Kim Wolken present. Costs for extending the culvert and covering with soil will be presented at the May council meeting for the council’s approval.
Sanne moved to approve initiating the amendment process for subdivisions and presenting to the Planning Commission for their approval. Janovec seconded the motion. Motion carried 4-0.
Sanne moved to amend Section 1 of Resolution #747 to set annual rent at $85 per acre with the maximum term of the lease at 5 years. Doty seconded the motion. Motion carried 4-0.
Council member Sanne introduced the following resolution as amended and moved for its adoption:
RESOLUTION #747
A RESOLUTION TO AUTHORIZE THE MULTI-YEAR LEASE OF OLD LAGON SITE TO LYLE LINGENFELTER
WHEREAS, the City of Plainview owns a certain tract of land situated in the County of Pierce, State of Nebraska, more particularly described as follows (the “City Real Estate”):
Part of W ½ of W ½ of SW ¼ of Section Three (3), Township Twenty-seven (T27N) North, Range Three (3) West of 6th P.M. , Pierce County, Nebraska (old Lagoon site, 17A more or less)
WHEREAS, the City of Plainview desires to enter into a long-term farm lease with Lyle Lingenfelter, herein referred to as Tenant, to allow the Tenant to use the City Real Estate for growing and harvesting crops;
WHEREAS, the City requires the ability to safely and effectively manage and spread effluent; and
WHEREAS, it is in the best interest of the City of Plainview to make this lease authorization contingent upon the City gaining access to the Tenant's pivot irrigation system on a separate parcel of land for said effluent spreading.
BE IT RESOLVED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA, AS FOLLOWS:
Section 1. The City Council hereby approves the framework for a long-term farm lease of the City's property described as Part of W ½ of W ½ of SW ¼ of Section Three (3), Township Twenty-seven (T27N) North, Range Three (3) West of 6th P.M. , Pierce County, Nebraska (old Lagoon site, 17A more or less) , to Lyle Lingenfelter. Specifically, annual rent shall be $85 per acre and the maximum term of the lease shall be five (5) years.
Section 2. The approval and execution of this long-term lease are strictly contingent upon the City of Plainview successfully securing an agreement to use Lyle Lingenfelter's pivot for the purpose of spreading effluent on the following described real estate:
The Northwest Quarter of the Southwest Quarter (NW1/4SW1/4) and the East Half of the Southwest Quarter (E1/2SW1/4) of Section 3, Township 27 North, Range 4 West of the 6th P.M., Pierce County, Nebraska.
Section 3. That notice of the proposed lease of property described above and the terms thereof shall be published once each week for three consecutive weeks in The Plainview News.
Section 4. That if within thirty days after the third publication of the notice a remonstrance petition against the lease of the City Real Estate is signed by registered voters of the City of Plainview equal in number to thirty percent of the registered voters of the City voting at the last regular municipal election held in the City and is filed with the City Clerk, the City Real Estate shall not then, nor within one year thereafter, be leased.
Section 5. That all resolutions or parts of resolutions in conflict be and are hereby repealed.
Council member Born seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Born, Janovec, Sanne and Doty Nay: None. Whereupon the Mayor declared said motion carried and Resolution #747 is passed and adopted.
The North Dry Creek Truck Show will be held in conjunction with the car show on June 13th and will utilize the same street closures as previously approved.
Sanne moved to adjourn the meeting. Born seconded. Motion carried 4-0
