City Council Meeting Minutes January 13 2026

 

 

MEETING OF THE CITY COUNCIL

TUESDAY, JANUARY 13, 2026

 

A meeting of the Mayor and Council of the City of Plainview, Nebraska, was held at the Council Chambers in said City on the 13th day of January at 6:30 o’clock P.M. 

 

Roll call was held and present were: Mayor Smith; Council Members: Born, Janovec, Sanne and Doty Absent: None

 

The Pledge of Allegiance was then recited.

 

Mayor Smith opened the meeting and announced to individuals in attendance that a full copy of the new Nebraska Open Meetings Act was posted on the east wall of the Council Chambers.

 

Notice of the meeting was given in advance thereof by Publication, a designated method for giving notice, as shown by the Affidavit of Publication attached to these minutes.  Notice of this meeting was given to the Mayor and all Members of the Council and a copy of their acknowledgment of receipt of notice and the agenda is attached to the minutes.  Availability of the agenda was communicated in the advance notice and in the notice to the Mayor and Council of this meeting.  All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.

 

Courtney Retzlaff was present as City Clerk.

Jeremy Tarr was present as City Administrator

 

Janovec moved to approve the council meeting minutes from December 9th. Doty seconded the motion. Motion carried 4-0.

 

Janovec moved to approve claims and payroll. Doty seconded the motion. Motion carried 4-0.

 

Manor Administrator report was given by Juleen Johnson which included updates on the proposed building expansion and renovation. Clark and Enersen is proposing approximately $4 million for the entire project cost which would include relocating the laundry facility upstairs and expansion of the assisted living facility. Staffing updates were given and a 3% cost of living raise will be given to all employees. Regular meetings of the Manor board will be on the last Tuesday of the month at 8:30 AM.

 

Police Chief Hallock reported on December activity of the department which included 4 warrant arrests and 10 other agency assists. Hallock has applied for a grant through Region 11 to help with the costs of the handgun optics.

 

City Clerk Retzlaff stated that she will be meeting with NENEDD representatives and Manor Administrator Johnson next week to discuss possible grant options for the Manor expansion and renovation project.

 

City Administrator Tarr stated that the City workers had removed trees on south 9th Street by the railroad tracks. Mayor Smith and Tarr met with the Ballbackers to discuss plans for the upcoming seasons.

 

Mayor Smith recommended Brian Richter to serve on the Advisory Board for Parks and Pools through December 2026. Sanne moved to approve the appointment. Doty seconded the motion. Motion carried 4-0.

 

Mayor Smith recommended Candi Johnson to serve on the Housing Board through December 2029. Sanne moved to approve the appointment. Doty seconded the motion. Motion carried 4-0.

 

Discussion on employee health insurance renewal effective February 1, 2026 was held with agent Josh Sirek joining via phone. The current plan of the City with Allstate, now Nationwide, is a monthly premium of $14,622.45 with renewal increase of 6.91% totaling $15,632.48 monthly. Sanne moved to approve the renewal of the current City of Plainview group health insurance plan with Nationwide. Janovec seconded the motion. Motion carried 4-0.

 

Sanne moved to approve the contract with Bud’s Sanitary Service, LLC for waste collection and disposal with an annual service charge of $73,596 effective February 1, 2026. Janovec seconded the motion. Motion carried 4-0.

 

Council member Sanne introduced the following resolution and moved for its adoption:

 

RESOLUTION #740

 

WHEREAS, the City Street Superintendent has prepared and presented a One Year and Six Year Plan for Street Improvement Program for the City of Plainview, and

 

WHEREAS, a public meeting was held on the 11th day of November 2025 and the 9th day of December 2025 to present this plan and there were no objections to said plan;

 

THEREFORE, BE IT RESOLVED BY THE Mayor and City Council of Plainview, Nebraska, that the plans and data as furnished are hereby in all things accepted and adopted.

 

  1. M493 (65) 2025-2026 – Concrete surfacing of Pilcher Avenue from Fifth Street to Sixth Street - $200,000
  2. M493 (38) 2025-2026 – Concrete surfacing of Lincoln Avenue from Second Street to Third Street - $100,000

Council member Born seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Born, Janovec, Sanne and Doty Nay: None. Whereupon the Mayor declared said motion carried and Resolution #740 is passed and adopted.

 

Council member Born introduced the following resolution and moved for its adoption:

 

RESOLUTION #741

 

A RESOLUTION TO AUTHORIZE THE SALE OF REAL ESTATE OWNED BY THE CITY OF PLAINVIEW LOCATED AT 105 S. MAPLE STREET VIA PUBLIC SALES SUBJECT TO A CONDITION SUBSEQUENT

 

WHEREAS, the City of Plainview is the owner of real estate located at 105 S. Maple Street in Plainview and legally described as follows (hereinafter the “City Real Estate”):

 

Lot 18 and the South 10 feet of Lot 19, Block 9, Kimball and Blair’s Addition to Plainview, Pierce County, Nebraska.

 

WHEREAS, Neb. Rev. Stat. §17-503.01 provides that the sale of real property owned by the Village for less than $5,000.00 shall be exercised by resolution directing the sale of such property.

 

BE IT RESOLVED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA, AS FOLLOWS:

 

Section 1. The City of Plainview hereby directs the sale of the City Real Estate, specifically to sell the same for $4,999.00 to the first individual or entity providing the same to the City Clerk and agreeing to the terms of Section 2.

 

Section 2. The buyer under Section 1 shall receive a quitclaim deed and shall pay all recording costs, documentary stamp taxes, and any other fee to record the deed. Furthermore, the conveyance shall be subject to a condition subsequent regarding the improvement of the property. The buyer shall covenant to:

 

  1. Commence Construction: Obtain a valid building permit and commence physical construction of a permanent commercial improvement to the real estate within twelve (12) months of the date of closing. “Commence construction” shall be defined as the completion of the foundation or pouring of the slab.
  2. Complete Construction: Substantially complete said improvement, evidenced by a Certificate of Occupancy or equivalent inspection approval by the City, within twenty-four (24) months of the date of closing.
  3. Reversionary Clause: In the event the buyer fails to strictly comply with the covenants set forth above, title to the real estate shall, at the option of the City of Plainview, revert to the City. This right of reverter shall be clearly stated in the quitclaim deed and shall run with the land for a period of twenty-six (26) months from the date of closing.

 

Section 3. Notice of the proposed sale of property described above and the terms thereof shall be posted in three prominent places within the City for a period of not less than seven days prior to the sale of the property and said notice gave a general description of the property offered for sale and stated the terms and conditions of the sale.

 

Section 4.  That all resolutions or parts of resolutions in conflict be and are hereby repealed.

 

Council member Doty seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Born, Janovec, Sanne and Doty Nay: None. Whereupon the Mayor declared said motion carried and Resolution #741 is passed and adopted

 

Motion was made by Sanne and seconded by Janovec to waive the second and third readings of Ordinance No. 1017. Upon roll call vote, the following members voted AYE: Born, Janovec, Sanne and Doty. The following voted NAY: None. Motion carried 4-0. Whereupon the Mayor declared the second and third readings of said Ordinance No. 1017 waived.

 

Motion was made by Sanne and seconded by Born to approve Ordinance No. 1017. Upon roll call vote, the following members voted AYE: Born, Janovec, Sanne and Doty. The following voted NAY: None. Motion carried 4-0. Whereupon the Mayor declared said Ordinance No. 1017 approved.

 

ORDINANCE #1017

 

AN ORDINANCE TO CONFIRM THE SALE OF REAL ESTATE OWNED BY THE CITY OF PLAINVIEW LOCATED AT 517 W LOCUST AVENUE IN PLAINVIEW TO JAMES ASCHOFF.

 

Sanne moved to approve the Agreement for Conveyance of Real Estate and Release of Claims between the City of Plainview and James Aschoff for the property at 517 W. Locust Avenue. Born seconded the motion. Motion carried 4-0.

 

City Administrator Tarr presented 3 bids that had been received for the demolition of the property at 414 W. Locust Avenue; DirtWorks $16,000; Hoffman Construction $15,000; Evan Aschoff $19,275. Sanne moved to accept the bid from Hoffman Construction for $15,000. Born seconded the motion. Motion carried 4-0.

 

A bid from Altwine Electric for a generator for the City shop and new police station was received for $12,500 plus installation costs. City Administrator Tarr stated that a grant of $10,000 has been awarded that will be applied to the cost of the generator. Sanne moved to approve the installation of the generator as presented. Janovec seconded the motion. Motion carried 4-0.

 

Sanne moved to approve the Application for Payment No. 4 Final from NLC, LLC for Project 351-A1-004 for Lincoln and Pine Street paving in the amount of $158,149.24. Janovec seconded the motion. Motion carried 4-0.

 

Sanne moved to approve the Keno grant for Plainview Post Prom in the amount of $1,875 for activities at the YMCA and gifts for students. Born seconded the motion. Motion carried 4-0.

 

Born moved to approve the Special Designated Liquor Licenses for St. Paul’s Catholic Church Fish Frys for the following dates: February 20, 2026 (alternate date February 27,2026) 4:00-11:00 PM; March 6, 2026 (alternate date March 13,2026) 4:00-11:00 PM; March 20,2026 (alternate date March 27,2026) 4:00-11:00 PM.   Janovec seconded the motion. Motion carried 4-0.

 

Sanne moved to approve the Manor Administrator Contract effective February 1, 2026 for Juleen Johnson with an annual salary of $147,366.90. Born seconded the motion. Motion carried 3-2 with Born, Sanne and Mayor Smith voting yes, Janovec and Doty voting no.

 

City Administrator Tarr discussed a proposed Lagoon Land Apply project for discharge of the City of Plainview lagoon. More information will be presented at future council meetings.

 

Mayor Smith will bring back information on procedures for the removal and storage of abandoned/nuisance vehicles to the February council meeting.

 

The City personnel committee will meet with the Manor Board personnel committee to go over the Manor Administrator contract prior to the approval in 2027.

 

Sanne moved to adjourn the meeting. Janovec seconded. Motion carried 4-0
