City Council Meeting Minutes July 8 2025

 

 

 

 

REGULAR MEETING OF THE CITY COUNCIL

TUESDAY, JULY 8, 2025

 

A meeting of the Mayor and Council of the City of Plainview, Nebraska, was held at the Council Chambers in said City on the 8th day of July at 6:30 o’clock P.M. 

 

Roll call was held and present were: Mayor Smith; Council Members: Born, Janovec, Sanne and Doty Absent: None.

 

The Pledge of Allegiance was then recited.

 

Mayor Smith opened the meeting and announced to individuals in attendance that a full copy of the new Nebraska Open Meetings Act was posted on the east wall of the Council Chambers.

 

Notice of the meeting was given in advance thereof by Publication, a designated method for giving notice, as shown by the Affidavit of Publication attached to these minutes.  Notice of this meeting was given to the Mayor and all Members of the Council and a copy of their acknowledgment of receipt of notice and the agenda is attached to the minutes.  Availability of the agenda was communicated in the advance notice and in the notice to the Mayor and Council of this meeting.  All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.

 

Courtney Retzlaff was present as City Clerk.

Jeremy Tarr was present as City Administrator

Kyle Petersen was present as City Attorney.

 

Janovec moved to approve the minutes from the regular meeting on June 10th and special meeting on June 17th. Doty seconded the motion. Motion carried 4-0.

 

Sanne moved to approve claims and payroll. Doty seconded the motion. Motion carried 4-0.

 

Juleen Johnson reported on staffing needs for the Manor, updates on the bylaws and time changes for the monthly board meetings. Johnson stated that there were issues with the online charting software over the weekend but that it is now up and going again.

 

Police Chief Hallock reported that Officer Funston is now fully certified for firearms training for other law enforcement agencies in the State. Reports on recent nuisance properties were given and abatement dates will be set by the City Administrator. Hallock reported that BNSF does not allow for stop signs to be placed on their property. Hallock will continue to work on changes to the crossing on 9th Street. National Night Out will be held on August 20th in conjunction with the Plainview Chamber of Commerce’s Back to School BBQ.

 

City Clerk Retzlaff reported that loan paperwork for Cool Beanz Coffee will be presented at the August meeting for council approval and that our NENEDD Community Planner, Tracy Sporleder will be present at the meeting to give an overview of their services.

 

City Administrator Tarr reported that Klown Days went well and a walk through with the contractor for the paving on Lincoln and Pine will be on Friday. Questions about having the transfer station and C&D open on weekends were addressed.

 

Born moved to approve the Mayor’s recommendation for Wayne Rasmussen for a 3 year term on the Manor Board. Janovec seconded the motion. Motion carried 4-0.

 

 

Council member Janovec introduced the following resolution and moved for its adoption:

 

RESOLUTION #728

 

WHEREAS: City of Plainview in compliance with Nebraska law, Sub recipient has established and is operating, or is interested in establishing and operating, a local transit system of a type that may be eligible for certain State and Federal Transit Funding, and;

 

WHEREAS: FTA Section 5311 funding is available to reimburse local transit expenses or costs generally related to capital, planning and operating costs of a local transit system, including but not limited to more specifically: acquisition of rolling stock (vehicles), facility and vehicle maintenance, payroll, insurance, training and other eligible expenses, and

 

WHEREAS: City of Plainview as a sub-recipient of Federal and State Aid funding is charged with the responsibility of expending said funds in accordance with Federal and State laws, rules, regulations, policies, and guidelines applicable to the funding of the Federal-aid project; and

 

WHEREAS: City of Plainview and Nebraska Department of Transportation wish to enter into a Program Agreement to provide Federal and State funding for Fiscal Year 2026 and 2027 to support rural public transportation services.

 

BE IT RESOLVED: by City of Plainview that:

 

Following thorough inspection of the NDOT 5311 Program Agreement, Robert Smith, Mayor is hereby authorized to sign the attached FY2026/2027 5311 Program Agreement between City of Plainview and Nebraska Department of Transportation. NDOT Project Number: RPT-M701 (227); NDOT Control Number: 32171L; NDOT Project Description: 5311 FTA Program Funding.

 

Council member Doty seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Born, Janovec, Sanne and Doty Nay: None. Whereupon the Mayor declared said motion carried and Resolution #728 is passed and adopted.

 

The City has been working with Miller & Associates and the State of Nebraska to address ammonia levels in the City lagoon. Sanne moved to approve the Agreement for Provision of Limited Professional Services for Effluent Discharge Improvements Project No. 351-DI from Miller & Associates Consulting Engineers. Janovec seconded the motion. Motion carried 4-0.

 

An interlocal agreement for the paving of Lincoln Avenue and Pine Street was presented. The City of Plainview will pay for the paving and will invoice Plainview Public Schools for all costs associated with the project. The school will remit payment for 50% of the approved invoices within 30 days of receipt. Janovec moved to approve the Interlocal Cooperation Agreement with Plainview Public Schools for the Paving of Lincoln Avenue in Plainview. Doty seconded the motion. Motion carried 4-0.

 

Discussion on procedures for unlicensed and inoperable vehicles in town was held. Further discussion will be held at the August council meeting.

 

Sanne moved to open the public hearing for the Creation of Street Improvement District 2025-1 Lincoln Avenue and Pine Street at 7:01 PM. Doty seconded the motion. Motion carried 4-0.

 

An overview of the project was given, which would include Lincoln Avenue between the ballfields and Pine Street between Lincoln Avenue and Harper Avenue.

 

Sanne moved to close the public hearing at 7:04 PM. Doty seconded the motion. Motion carried 4-0.

 

Council member Sanne introduced the following resolution and moved for its adoption:

 

RESOLUTION #727

 

BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA AS FOLLOWS:

 

The Mayor and City Council hereby find and determine:

 

That an Ordinance creating Street Improvement District No. 2025-1 was previously adopted by the Mayor and City Council; that published notice has been given in accordance with law to the owners of record title of the property directly abutting the streets to be improved in said District, advising said owners of their right to provide comment and objection regarding the creation of the District, and that after such notice and a hearing, it is appropriate for the City to confirm the ordinance creating said District.  

 

Accordingly, the City will commence construction of improvements in Street Improvement District No. 2025-1 and will complete such improvements at public cost without a levy of special assessments on the lots and parcels of land abutting on or adjacent to the streets in the District.

 

Council member Doty seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Born, Janovec, Sanne and Doty Nay: None. Whereupon the Mayor declared said motion carried and Resolution #727 is passed and adopted.

 

 

Motion was made by Sanne and seconded by Doty to waive the second and third readings of Ordinance No. 1011. Upon roll call vote, the following members voted AYE: Born, Janovec, Sanne and Doty. The following voted NAY: None. Motion carried 4-0. Whereupon the Mayor declared the second and third readings of said Ordinance No. 1011 waived.

 

 

Motion was made by Sanne and seconded by Doty to approve Ordinance No. 1011. Upon roll call vote, the following members voted AYE: Born, Janovec, Sanne and Doty. The following voted NAY: None. Motion carried 4-0. Whereupon the Mayor declared said Ordinance No. 1011 approved.

 

 

ORDINANCE NO. 1011

 

AN ORDINANCE PROVIDING FOR THE ISSUANCE OF STREET IMPROVEMENT BOND ANTICIPATION NOTES, SERIES 2025, IN THE AMOUNT OF NOT TO EXCEED FIVE HUNDRED THOUSAND DOLLARS ($500,000) FOR THE PURPOSE OF PAYING THE COSTS OF CONSTRUCTING PAVING AND RELATED IMPROVEMENTS WITHIN THE CITY OF PLAINVIEW, NEBRASKA AND NECESSARY APPURTENANCES THERETO; PROVIDING FOR A PAYING AGENT AND REGISTRAR OF THE NOTES; AGREEING TO ISSUE BONDS TO PAY THE NOTES AND ACCRUED INTEREST AT MATURITY; PRESCRIBING THE FORM OF THE NOTES; AUTHORIZING THE SALE AND DELIVERY OF THE NOTES TO THE PURCHASER AND ORDERING THE PUBLICATION OF THE ORDINANCE IN PAMPHLET FORM

 

City Administrator Tarr gave an overview of items that will be consider for the 2025-2026 budget: costs associated with the construction of the new well, construction of parking lot at the Plainview Library, maintenance of sewer mains through cameras, crack sealing on paved streets and generator for the new police station. Dates for budget workshops will be set at a later time.

No council comments.

Public comments included questions on updates to the bathrooms at the ballfields and updating Ordinances.

Janovec moved to adjourn the meeting. Sanne seconded. Motion carried 4-0
