City Council Meeting August 9, 2022

 

REGULAR MEETING OF THE CITY COUNCIL

TUESDAY, AUGUST 9, 2022

 

A meeting of the Mayor and Council of the City of Plainview, Nebraska, was held at the Council Chambers in said City on the 9th day of August at 6:30 o’clock P.M. 

 

Roll call was held and present were: Mayor Schlote; Council Members: Alder, Smith and Yosten Absent: Sanne

 

The Pledge of Allegiance was then recited.

 

Mayor Schlote opened the meeting and announced to individuals in attendance that a full copy of the new Nebraska Open Meetings Act was posted on the east wall of the Council Chambers.

 

Notice of the meeting was given in advance thereof by Publication, a designated method for giving notice, as shown by the Affidavit of Publication attached to these minutes.  Notice of this meeting was given to the Mayor and all Members of the Council and a copy of their acknowledgment of receipt of notice and the agenda is attached to the minutes.  Availability of the agenda was communicated in the advance notice and in the notice to the Mayor and Council of this meeting.  All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.

 

Jeremy Tarr was present as City Administrator

Courtney Retzlaff was present as City Clerk.

Bruce Curtiss was present as City Attorney.

 

Yosten moved to approve the regular meeting minutes from July 9th. Alder seconded the motion. Motion carried 3-0.

 

Alder moved to approved claims and payroll. Smith seconded the motion. Motion carried 3-0.

 

No Manor report was given.

 

No police report was given. Discussion will be held at future meetings regarding potential removal of stop signs around town.

 

Susan Norris gave updates on the additional funding for the housing project, DTR grant applications for round 2 are being accepted until September 15th, the updates at the tennis courts were completed and a ribbon cutting was held on August 4th. The NCF will have regional training in Plainview in September, a committee has been set for C4K to address child care shortages in the county and the co-share network space is projected to be started in 3 months. The former Watson’s building has been sold to a company in Oregon that provides warranty work on parts for recreational vehicles. Acacia will be open in late fall and will serve Just Love Coffee franchise products.

 

City Superintendent report was given by City Administrator Tarr who stated that they are working on installing new valves at the corner of 1st Street and Woodland Avenue and that there will be work done at the pool after closing for the season to address a water leak.

 

City Attorney Curtiss stated that there has been no further contact from Colby Capital, LLC in regards to the potential small box discount store. There was also discussion held on the tax sales for abandoned properties in town and Curtiss will work with City Office personnel to address liens on the properties. The council will also talk to the commissioners about tax sales not being held.

 

Mayor Schlote recommended current Interim Police Chief Kristy Hallock to be appointed as Police Chief. Smith moved to accept the appointment. Yosten second the motion. Motion carried 3-0.

 

Mayor Schlote recommended a $25 per hour base rate for Hallock with quarterly raises of $.25 given for a year. Smith moved to approve the wage for Hallock. Alder seconded the motion. Motion carried 3-0.

 

Smith moved to no longer list 701 W Pilcher as a nuisance as the property has been sold. Alder seconded the motion. Motion carried 3-0.

 

An Agreement for Provision of Limited Professional Services from Miller & Associates was presented to the council for approval. This will be necessary to allow Miller & Associates to obtain RFP’s for the improvements to Well 62-1, submit required documents to NDEE and accept bids during the design phase. During construction phase, Miller & Associates will prepare contracts necessary, perform on-site observation services and prepare documents needed to be submitted to NDEE. Smith moved to approve the agreement. Alder seconded the motion. Motion carried 3-0.

 

Council member Smith introduced the following resolution and moved for its adoption:

 

 

 RESOLUTION #651

 

WHEREAS, the City of Plainview, Nebraska operates a transit system known as the City of Plainview Handivan and;

 

WHEREAS federal regulations require agencies to update their drug and alcohol policies

 

NOW THEREFORE BE IT RESOLVED, BY THE MAYOR AND COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA, THAT:

 

  1. The City of Plainview HandiVan adopts a Zero Tolerance Drug and Alcohol Testing Policy as provided by the Nebraska Department of Transportation Transit Program and updated to meet the needs of the City of Plainview HandiVan.

 

Council member Yosten seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Alder, Smith and Yosten. Nay: None. Whereupon the Mayor declared said motion carried and Resolution #651 is passed

and adopted

 

Council member Smith introduced the following resolution and moved for its adoption:

 

RESOLUTION #652

 

WHEREAS, the City of Plainview finds that the best interests of the City would be served by the construction and ownership of a Community Building pursuant to plans developed for and received by the City; and

 

WHEREAS, the City of Plainview further finds that the financial goals and thresholds developed for the fund raising and ownership of such a building are reasonable and proper;

 

NOW THEREFORE BE IT RESOLVED, BY THE MAYOR AND COUNCIL OF THE CITY OF PLAINVIEW, PIERCE COUNTY, NEBRASKA, THAT:

 

  1. Upon citizens and the Plainview Brunswick Community Foundation fund raising, combined with grants, reaching the threshold of Five Million Dollars ($5,000,000.00) and availability of a suitable portion of such funds for a real estate purchase, the City of Plainview will actively seek and purchase sufficient real estate for the construction of a community building as planned; and
  2. Upon fund raising reaching the total needed to construct and furnish said Community Building, and to provide necessary reserves as projected and agreed, the City of Plainview will proceed to construct, own, maintain, and operate the Community Building, all according to plans and specifications as approved and agreed in final form.

 

 

Council member Alder seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Alder, Smith and Yosten. Nay: None. Whereupon the Mayor declared said motion carried and Resolution #652 is passed

and adopted.

 

Council member Smith introduced the following resolution and moved for its adoption:

 

                                                            RESOLUTION #653

 

WHEREAS: State of Nebraska Statues, sections 39-2115, 39-2119, 39-2120, 39-2121, and 39-2520(2), requires an annual certification of program compliance to the Nebraska Board of Public Roads Classifications and Standards; and

 

WHEREAS: State of Nebraska Statute, section 39-2120 also requires that the annual certification of program compliance by each municipality shall be signed by the Mayor or Village Board Chairperson and shall include the resolution of the governing body of the municipality authorizing the signing of the certification.

 

BE IT RESOLVED that the Mayor of Plainview is hereby authorized to sign the Municipal Annual Certification of Program Compliance.

 

Council member Yosten seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Alder, Smith and Yosten. Nay: None. Whereupon the Mayor declared said motion carried and Resolution #653 is passed

and adopted.

 

Discussion was held on a bid submitted by the Village of Stuart for purchase of the CAT generator and other equipment necessary for the operation of the generator. As another municipality has submitted the bid, the City of Plainview does not need to advertise for bids on the equipment. The Village of Stuart offered $130,000 and would be responsible for the removal of the equipment from the City’s power plant. Payment would be received October 1st at the beginning of the new fiscal year if the bid was accepted. Alder moved to accept the bid from the Village of Stuart. Smith seconded the motion. Motion carried 3-0.

 

The current HVAC system in the City Office is from 1986 and has been serviced this summer as the circuit board was no longer operating and it was leaking water causing damage to the unit. Alby’s Electric submitted a bid for a new unit at a cost of $12,344.54. Alder moved to approve the HVAC unit from Alby’s. Yosten seconded the motion. Motion carried 3-0.

 

Discussion on the upcoming FY 2022-2023 budget was held with City Administrator Tarr presenting the council with proposed wage increases for the City staff. Valuation amounts from Pierce County will be received after August 20th which will be necessary to complete the proposed budget for the new fiscal year.

 

Smith moved to adjourn the meeting. Alder seconded the motion. Motion carried 3-0
