City Council Meeting July 12 2022

 

REGULAR MEETING OF THE CITY COUNCIL

TUESDAY, JULY 12, 2022

 

A meeting of the Mayor and Council of the City of Plainview, Nebraska, was held at the Council Chambers in said City on the 12th day of July at 6:30 o’clock P.M. 

 

Roll call was held and present were: Mayor Schlote; Council Members: Alder, Smith, Yosten and Sanne Absent: None

 

The Pledge of Allegiance was then recited.

 

Mayor Schlote opened the meeting and announced to individuals in attendance that a full copy of the new Nebraska Open Meetings Act was posted on the east wall of the Council Chambers.

 

Notice of the meeting was given in advance thereof by Publication, a designated method for giving notice, as shown by the Affidavit of Publication attached to these minutes.  Notice of this meeting was given to the Mayor and all Members of the Council and a copy of their acknowledgment of receipt of notice and the agenda is attached to the minutes.  Availability of the agenda was communicated in the advance notice and in the notice to the Mayor and Council of this meeting.  All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.

 

Jeremy Tarr was present as City Administrator

Courtney Retzlaff was present as City Clerk.

Bruce Curtiss was present as City Attorney.

 

Yosten moved to approve the regular meeting minutes from June 14th. Alder seconded the motion. Motion carried 4-0.

 

Sanne moved to approved claims and payroll. Smith seconded the motion. Motion carried 4-0.

 

Manor report was given by Juleen Johnson who gave an update on census numbers for the facility and that the fire panel had been updated. Johnson asked for an additional $3,030 from the Manor sales tax account for the fire hood that was approved in June as the cost had gone up. Sanne moved to approve the additional funding. Alder seconded the motion. Motion carried 4-0.

 

Police department report was given by Officer Hallock who reminded all that drivers of ATV/UTV vehicles need to have a valid operator’s license and be at least 16 years of age.

 

Susan Norris gave the Economic Development report which included updates on the DED housing project, DTR grant with round 2 applications being accepted until September 15th, and the new flooring at the tennis courts was being installed.

 

No City Superintendent report was given.

 

At 6:45 PM Mayor Schlote opened the Public Hearing for a Special Use Permit for construction of accessory building prior to principal building.

 

City Administrator Tarr explained that a SUP was necessary as the land owners wish to construct the accessory building prior to the construction of the primary living structure. The Planning Commission had previously approved the SUP for Mike and Julie Sauser for their property at 33 28 4 Plainview College Add Blk 10 Lots 7,8,9 &10,11,12.

 

Sanne moved to close the public hearing at 6:49 PM. Smith seconded the motion. Motion carried 4-0.

 

Sanne moved to approve the SUP for Mike and Julie Sauser for construction of an accessory building prior to the principal building. Alder seconded the motion. Motion carried 4-0.

 

Mayor Schlote recommended to appoint Officer Kristy Hallock at the interim Police Chief. Smith moved to approve the appointment. Yosten seconded the motion. Motion carried 4-0.

 

Smith moved to approve a wage of $25 per hour for Hallock as interim Police Chief. Alder seconded the motion. Motion carried 4-0.

 

Sanne moved to begin advertising for a Police Chief or Police Officer. Yosten seconded the motion. Motion carried 4-0.

 

Keno grants were received from 2 organizations.

 

The Social Center requested $1,000 for purchase of a commercial mixer for the facility. Sanne moved to approve the grant. Smith seconded the motion. Motion carried 4-0.

 

The American Legion requested $2,500 for purchase of trees in the cemetery on Highway 20 west of the Catholic Church. Sanne moved to approve the grant. Smith seconded the motion. Motion carried 3-1 with Alder voting no.

 

Discussion was held on 2 properties recommended by the health board for nuisances.

 

The first is at 604 East Park Avenue, Plainview 4-27-4 T.L. 5 .43A. The fence on the property has fallen down and it does not meet zoning regulations for height. There is also various junk in the rear of the property that needs cleaned up. Alder moved to deem the property a nuisance and send to legal counsel for further action. Smith seconded the motion. Motion carried 4-0.

 

The second property is at 701 West Pilcher Avenue, Plainview Hammond’s Add Blk 1 Lot 1. The property has siding that is falling off, there appear to be several windows that are missing and are covered with plastic. Council would like more clarification on the status of the windows before moving forward. Sanne moved to table discussion to the August council meeting. Alder seconded the motion. Motion carried 4-0.

 

An interlocal agreement with Pierce County dispatch for non-emergency police and utility calls was presented to the Council. Pierce County Commissioners had approved the agreement at their meeting on July 11th. Yosten moved to approve the agreement. Smith seconded the motion. Motion carried 4-0.

 

At 7:00 PM Mayor Schlote opened the public hearing for the proposed Ordinance to update and amend City Code & Zoning Regulations pertaining to Municipal Planning and Small Box Discount Stores.

 

Mark Fitzgerald was present to discuss the motion to dismiss that was filed and the response from the District judge.

 

Sanne moved to close the public hearing at 7:07 PM. Alder seconded the motion. Motion carried 4-0.

 

At 7:09 PM, Alder moved to go into executive session to discuss legal strategy for the proposed Ordinance to update and amend City Code & Zoning Regulations pertaining to Municipal Planning and Small Box Discount Stores. Smith seconded the motion. Motion carried 4-0.

 

At 7:35 PM Sanne moved to come out of executive session. Yosten seconded the motion. Motion carried 4-0.

 

Motion was made by Smith and seconded by Sanne to approve Ordinance No. 978 on its first reading. Upon roll call vote, the following members voted AYE: Alder, Smith, Yosten and Sanne. The following voted NAY: None. Motion carried 4-0. Whereupon the Mayor declared said Ordinance No. 978 approved on its first reading.

 

Motion was made by Smith and seconded by Sanne to approve Ordinance No. 978 on its second and third readings. Upon roll call vote, the following members voted AYE:  Alder, Smith, Yosten and Sanne. The following voted NAY: None. Motion carried 4-0. Whereupon the Mayor declared said Ordinance No. 978 approved on its second and third reading.

 

ORDINANCE NO. 978

 

 

AN ORDINANCE OF THE CITY OF PLAINVIEW, NEBRASKA, to create a new code section in Chapter 11, Municipal Planning, Article 4.5, Section 11-4.5.1, Business Retention, Small Box/Variety Stores.  Competition and Regulation, and for consistency and clarity, add the same to the City of Plainview Zoning Regulations as (307) Commercial Use Types (q) Retail Service at #3 Small Box Discount Stores.

 

 

Discussion was held on TextMyGov which would provide a mass messaging service to citizens through text messaging. The contract proposed would have $1,000 set up fee with $2,000 annual charged for the service. The payment would be due on October 1. Smith moved to approve the system for 2 years. Sanne seconded the motion. Motion carried 4-0.

 

Discussion was held on moving forward with requesting bids again for Street Paving Projects 2021-1 through 2021-9. The previous bid received in March had been rejected by the council. City Administrator Tarr explained that the council could choose all the streets again or just select a few. Alder moved to request bids on the following Street Improvement Projects: Euclid Avenue between 2nd and 3rd Streets, Pilcher Avenue between 4th and 5th Streets and 6th Street between Pilcher and Woodland Avenues. Smith seconded the motion. Motion carried 4-0.

 

Council voted to table requesting bids on Lincoln Ave Paving project 2022-1.

 

City Administrator Tarr presented a brief overview of upcoming items for the 2022-2023 FY Budget which included repairs to the swimming pool, generators at the City Office, new flooring for the City Office and a snow blower for the skid steer. Wage increases were also discussed.

 

Susan Norris and Brook Curtiss, representing the Plainview Brunswick Community Foundation, presented on the continued fund raising for the proposed future community building. The PBCF currently has a planning account for the funds that have come in, but with a recent increase in the amount, the Nebraska Community Foundation has required that the PBCF open a capital campaign account. In order to open this account, an owner of the facility must be identified. Norris and Curtiss were asking for the City to agree to ownership of the facility to continue moving forward with receiving donations. Smith moved to add the necessary Resolution to the August agenda for council approval. Sanne seconded the motion. Motion carried 4-0.

 

 

Smith moved to adjourn the meeting. Alder seconded the motion. Motion carried 4-0
