THURSDAY, JULY 23, 2026

A meeting of the Mayor and Council of the City of Plainview, Nebraska, was held at the Council Chambers in said City on the 23rd day of July at 7:00 o’clock P.M.

Roll call was held and present were: Mayor Smith; Council Members: Born, Janovec, Sanne and Doty Absent: None

The Pledge of Allegiance was then recited.

Mayor Smith opened the meeting and announced to individuals in attendance that a full copy of the new Nebraska Open Meetings Act was on the back table of the Council Chambers.

Notice of the meeting was given in advance thereof by Posting, a designated method for giving notice, as shown by the Certificate of Posting attached to these minutes. Notice of this meeting was given to the Mayor and all members of the Council and a copy of their acknowledgment of receipt of notice and the agenda is attached to the minutes. Availability of the agenda was communicated in the advance notice and in the notice to the Mayor and Council of this meeting. All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.

Courtney Retzlaff was present as City Clerk.

Jeremy Tarr was present as City Administrator.

Discussion was held on the Memorandum of Understanding between the City of Plainview and the Plainview Brunswick Community Foundation for the proposed Plainview Community Building. The MOU is not a legal document, it is simply an understanding between the two parties in order to move forward with the project fundraising. The MOU will go back to the PBCF for their review and approval, and then to the Nebraska Community Foundation for final approval. Sanne moved to approve the MOU as presented. Doty seconded the motion. Motion carried 3-0 with Janovec abstaining.

Council member Born introduced the following resolution and moved for its adoption:

RESOLUTION NO. 757

A RESOLUTION TO DISPOSE OF OBSOLETE LIBRARY COMPUTERS AND SURPLUS FOR NOMINAL CONSIDERATION AT THE DISCRETION OF THE CITY LIBRARIAN

WHEREAS, the City of Plainview, Nebraska (the “City”), periodically accumulates personal property, including information technology hardware, that has exceeded its operational lifespan, is obsolete, and is no longer necessary, useful, or economically viable for municipal public purposes;

WHEREAS, Neb. Rev. Stat. § 17-501 grants the City the power to acquire, hold, and convey personal property, and Neb. Rev. Stat. § 17-503.02 provides that the power of a city of the second class to convey personal property owned by it shall be exercised by a resolution directing the sale or disposition and the manner and terms thereof;

WHEREAS, the City currently holds in its possession specific electronic hardware, including legacy desktop computers, monitors, and peripheral devices, as itemized herein (the “Property”);

WHEREAS, the desktop towers identified in the Property rely on legacy hardware microarchitectures that are strictly incompatible with, and non-upgradeable to, the Windows 11 operating system, thereby posing an imminent cybersecurity and operational liability to the City’s technological infrastructure upon the termination of Microsoft support for older operating systems;

WHEREAS, due to the advanced age, hardware limitations, and degraded operational status of the Property, the Mayor and City Council determine that the fair market value of the aggregate Property is definitively less than Five Thousand Dollars ($5,000.00), and is, in commercial terms, of $0.00 monetary value; and

WHEREAS, the cost of storing, marketing, or facilitating a public auction for the Property would vastly exceed its value, and the transfer of the Property to an electronics recycling facility or authorized non-profit organization relieves the City of the financial and environmental liabilities associated with electronic waste disposal, thereby serving a valid public purpose and avoiding an unconstitutional gift of public funds.

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLAINVIEW, NEBRASKA:

Section 1. Declaration of Surplus. The electronic equipment itemized in below is hereby declared to be obsolete, unfit for continued municipal use, and is officially classified as surplus personal property of the City of Plainview:

Two (2) HP Compaq Pro 6200 Desktop Towers
Four (4) HP Compaq Pro 6300 Desktop Towers
Two (2) Acer 18″ Monitors
One (1) Lenovo 20″ Monitor
Three (3) HP Keyboards
Two (2) Logitech Keyboards
One (1) Lenovo Keyboard
Two (2) HP Mice
One (1) Logitech Mouse
One (1) Lenovo Mouse
Section 2. Data Sanitization Mandate. Prior to the physical release or transfer of any computing asset listed in Section 1, the City Librarian shall ensure that all internal information storage media (hard disk drives or solid-state drives) are completely removed from the desktop chassis and retained by the City for physical destruction, or otherwise subjected to strict data sanitization protocols.

Section 3. Authorization of Disposition. The City Librarian, or her designee, is hereby authorized and directed to dispose of the Property for as little consideration as the City Librarian deems sufficient.

Section 4. Condition of Conveyance. All Property is conveyed strictly “AS-IS” and “WHERE-IS,” with all faults. The City of Plainview makes no representations or warranties, expressed or implied, regarding the merchantability, safety, or fitness for a particular purpose of the Property.

Section 5. Notice Requirement. In accordance with Neb. Rev. Stat. § 17-503.02, because the fair market value of the Property is less than $5,000.00, the City Clerk is hereby directed to post notice of this disposition in three prominent places within the City for a period of not less than seven (7) days prior to the final physical transfer of the Property. Publication in a legal newspaper is formally waived based on the valuation threshold.

Section 6. Repeal of Conflicting Resolutions. That all prior resolutions, or parts of resolutions, in direct conflict with the provisions of this Resolution are hereby repealed to the extent of such conflict.

Council member Sanne seconded the foregoing motion and on roll call on the passage and adoption of said resolution, the following voted Aye; Born, Janovec, Sanne and Doty Nay: None. Whereupon the Mayor declared said motion carried and Resolution #757 is passed and adopted
